DECLARATION
Czech Geodetic and Cartographic Office
of 31 January 1984
amending and supplementing Decree No. 23 / 1964 Coll., implementing Act No. 22 / 1964 Coll., on the Registration of Real Estate
The Czech Geodetic and Cartographic Office, in agreement with the participating ministries and other central authorities, provides for the Act No. 22 / 1964 Coll., as amended by Act No. 157 / 1983 Coll., amending and supplementing Act No. 22 / 1964 Coll.:
Decree No. 23 / 1964 Coll., implementing Act No. 22 / 1964 Coll., on the registration of real estate, as amended by Decree No. 133 / 1965 Coll., is amended as follows:
1. in Article 6 (1) (a), the words "judgment of the court on the forfeiture of property, notarial deed on the sale of immovable property" shall be replaced by the words "judgment of the court, written agreement or confirmation of the spouses on the settlement of the non-joint ownership of spouses, a declaration by the spouses agreed, within three years of the disappearance of the joint ownership of the spouses, that they have not submitted an application for settlement by the court, (1) confirmation by the State of the sale of the property in the enforcement of the judgment."
2. in Article 6 (1), the following shall be inserted after point (c):
"(d) if the maintenance of personal property relates to real estate or the maintenance of a right corresponding to a material burden, (2) the citizen's written declaration of a change in legal relationship to the property, containing property information according to the state of the real estate register and supported by a certificate of state notar3) the citizen's declaration of the circumstances, time and continuity of the possession of the property or the right corresponding to the material burden; state notaries shall state that neither the owner of the property concerned nor the local national committee in whose territory the property is situated have raised any reservations as to the creation of that citizen's entitlement. ';
3. In Paragraph 6 (1), the following provision is added as point (e):
"(e) if there is an end to the limitation of property rights in property or an end to the restriction of the right of personal use of the land: the decision of the authorised authority, the instrument of acquisition of property in state socialist property, the registered contract of termination of the burden in kind, the draft of the compulsory instrument of death of the creditor or, where applicable, of the compulsory instrument of termination of the claim."
4. In Paragraph 6 (2), the following sentence is added at the end: "If a document creates a material burden which relates only to a part of the plot, this part shall be marked on a geometric plan which is attached to the instrument as an inseparable part of it. '
5. in Article 10 (1) (d):
"(d) express their views on the acquisition of personal property by holding the property and on the acquisition of a right corresponding to the material burden of retention,"
point (d) is renumbered as point (e).
This Decree shall take effect on 1 April 1984.
