DECLARATION
of 10 June 2009
on the testing test, the test for certification of the health profession without professional supervision, the final test of accredited qualification courses and the evaluation test and the procedure for verifying the knowledge of the Czech language (Ordinance on examinations according to the Law on non-medical health professions)
The Ministry of Health ("the Ministry ') provides, pursuant to § 90 (2) (a), (b) and (h) of Act No. 96 / 2004 Coll., on the conditions for obtaining and recognising eligibility for the pursuit of non-medical health professions and for the performance of activities related to the provision of health care and amending certain related laws (Act on non-medical health professions), as amended by Act No. 189 / 2008 Coll., (" the Act'):
BASIC PROVISIONS
This decree regulates in accordance with the law
(a) testing tests to obtain specialised competence in the performance of an unmedical medical profession;
(b) final examinations of an accredited qualification course to obtain professional competence for the performance of an unmedical medical profession;
(c) and probation examinations to obtain competence to pursue an unmedical medical profession in the territory of the Czech Republic, in the recognition of competence to pursue the medical profession of persons not covered by Part One, Title Seven,
(d) procedure for verifying the knowledge of the Czech language.
ATESTATION TEST
Division Attestation Commission
(1) The test shall be carried out before the Technical Attestation Commission (hereinafter referred to as the "Attestation Commission") set up by the Ministry under the law. The Commission shall have at least three members. For the practical part of the test, which takes place in an accredited establishment, at least 1 member of the testing committee and a trainer of the accredited establishment shall be present. The members of the committee shall elect a chairman who shall direct the meetings of the committee and shall be responsible for its activities. This option can be repeated twice. If the latter fails to elect a chairman, it shall be determined by drawing lots.
(2) The test is accessible to healthcare professionals (2) and to the staff of the Ministry or, where appropriate, to the staff of the organisation responsible for the administrative conduct of the examination, except for advice on the outcome of the examination or part thereof, which is not public.
(3) The result of the test or part of the test shall be decided by voting. In the event of a decisive vote, the President of the Commission shall vote.
Application to the test
(1) The application for the test shall be submitted by the candidate to the Ministry or, where appropriate, by an authorised organisation. The accuracy of the information provided in the application is confirmed by the instructor of the accredited establishment in which the training programme is carried out and by the employer of the tenderer.
(2) If the applicant has acquired professional or specialised competence to pursue a medical profession abroad or if the applicant has completed an accredited medical study programme in the Czech Republic with a language other than the Czech language, he shall add to the application an uncertified copy of the Ministry's decision to recognise the medical profession in the Czech Republic.
(3) Where candidates have been counted by the Ministry, where appropriate, by a delegated organisation, of modules which he has completed in another specialisation training and certified courses, he shall add to the application an uncertified copy of the acknowledgement of such offsetting.
(4) Where applicants have been counted by the Ministry, where appropriate, by the organisation responsible, a part of the study previously completed, they shall add an uncertified copy of the receipt to the application for the test.
(5) Where applicants have been counted by the Ministry or by a delegated organisation or part thereof,
(a) in another field of specialisation, where it corresponds to the content and scope of the programme concerned; or
(b) abroad, if it corresponds to the content and scope of the training programme concerned;
attach to the application an uncertified copy of the adjustment certificate to the test test.
Presumption for carrying out the test
The requirement for carrying out the test is to meet all the requirements set out in the training programme for the field of specialisation.
Date and place of the test
(1) The test shall be carried out at the dates specified by the Ministry or, where appropriate, the designated organisation for each field of specialisation training; The Ministry and, where appropriate, the designated organisation shall set at least two periods for each branch for the relevant calendar year, not later than 15 March for the second half of the calendar year and 15 September for the first half of the following calendar year. Where appropriate, the Ministry or, where appropriate, the designated organisation shall determine additional dates for the tests.
(2) The Ministry or, where appropriate, the designated organisation, shall determine the place of the test and confirm it together with the date of the test test at least 30 calendar days before the date of the test and all tenderers who submitted an application for the test referred to in Article 3 at least 50 calendar days before the date of the test and fulfil the conditions set out in Article 4. The Ministry and, where appropriate, the designated organisation shall also inform the members of the Committee on the date and place of the test. The Ministry or, if applicable, the designated organisation shall cancel the examination if at least 1 candidate in the relevant field does not apply within 50 calendar days before the date of the test.
(3) The Ministry or, where appropriate, the designated organisation shall publish the dates of the tests and the current list of test questions and recommended literature for the test tests in each field in a way that allows remote access.
Content, course and evaluation of the test
(1) The test shall consist of a part practical and theoretical and shall normally take place on one day. The practical part of the test run shall be held in an accredited establishment and shall be preceded by theoretical parts of the test run.
(2) Before the start of the test, the tenderer shall demonstrate his identity before the test committee and shall provide proof of payment of the costs associated with the organisation of the relevant part of the test. An entry in the test report shall be made on the submission of the identity document and the proof of payment of the costs associated with the organisation of the relevant test. If a multi-part test is carried out, identification may be required for each part of the test test.
(3) The practical part shall be considered as:
(a) verification of the successful management of practical performance;
(b) analysis of submitted nursing or laboratory diagnostic problems (case studies, model situations); or
(c) the defence of written work.
The method of performing the practical part of the test shall be recorded in the test report.
(4) The theoretical part of the test is to answer three expert questions. Questions from the theoretical part of the test shall be drawn and recorded in the test report. Once the questions have been drawn, the testing committee shall give the candidate a reasonable time to prepare the answers, but at least 15 minutes.
(5) In the event that the answer to any of the submitted questions in the theoretical part was insufficient, but the applicant did not show substantial ignorance, the testing committee will allow the tenderers to draw additional questions. The additional question will allow you to draw only once throughout the test run. The text of the supplementary question shall also be recorded in the test report.
(6) The individual parts of the test and its overall result are evaluated for benefit or benefit.
(7) If the practical part of the test test is evaluated did not benefit, the theoretical part of the test test is not continued and the overall evaluation of the test test is "failed '. If the candidate has not benefited from the theoretical part of the test, even after any additional question, the overall evaluation of the candidate for the test test is" not'.
(8) The overall evaluation of the test report will be announced by the test report after consultation of the result of the test report. The evaluation of individual parts of the test and the overall evaluation of the test shall be recorded in the test report. Without undue delay after successful completion of the test, the candidate shall receive a certificate of completion of the test, no later than 30 days after the date of successful completion of the test examination, as well as a supplement to the diploma, if any.
Non-participation in the test, withdrawal, repetition
(1) If the candidate cannot attend the test by the date for which he was invited, he may excuse his non-participation to the Ministry or, where appropriate, to the entrusted organisation. An apology is considered
(a) a written apology sent to the Ministry or, where appropriate, to the organisation before the date of the test;
(b) in the case of a serious reason, a written apology sent to the Ministry or, where appropriate, to the entrusted organisation within 10 calendar days of the date of the test; or
(c) withdrawal from the practical or theoretical part of the test run prior to the start of the test.
If the applicant asks, he may apply for the test test as soon as possible, if possible for organisational reasons. The reimbursement of costs associated with the organisation of testing tests shall not be refunded.
(2) A candidate who has successfully carried out only a practical part of the test and has apologized or failed to comply with the theoretical part of the test shall be recognised if the remaining part is successful within 2 years of the date of successful completion of the practical part of the test.
(3) If the candidate withdraws from the test run after or in the course of drawing up the questions, he shall be considered as failing the test run.
(4) If the candidate does not show up for the test without an apology, he is assessed as if he did not benefit from the test test.
(5) If the candidate has not benefited from the test, the test may be carried out at least 6 months after the date of the unsuccessfully completed test.
FINAL TEST OF ACREDITATED QUALIFICATION CURSE
Test panel, application and assumptions for the final examination
(1) The final examination of the accredited qualification course (hereinafter referred to as the "final examination") shall take place before the examination committee of the accredited establishment. The members of the Examination Board shall be appointed and withdrawn by the statutory body of the accredited establishment. The examination committee shall have at least 3 members, of which 1 member shall be the guarantor of the relevant training programme. The members of the Examination Board shall be elected by the Chairperson who shall be responsible for the deliberations of the Examination Board. This option can be repeated twice. If the latter fails to elect a chairman, it shall be determined by drawing lots.
(2) The results of the examination shall be decided by the Commission by public vote. In the event of a decisive vote, the President of the Commission shall vote.
(3) The application for the final test shall be submitted to an accredited establishment using a form issued for that purpose by an accredited establishment. The accuracy of the information provided in the application is confirmed by the expert guarantor of the training programme course.
(4) The requirement for carrying out the final examination shall be that all the requirements laid down in the relevant training programme be met.
(5) The procedure for setting off part of the study previously completed and part of the professional experience shall be determined by internal rules for accredited equipment and the credits granted shall be recorded in the application file.
Date and place of final examination
(1) The final examination shall take place in an accredited establishment within the time limits set by it. The accredited equipment shall inform the Ministry in writing of the date, place of the final examination and composition of the examination committee, at least 30 calendar days before the date of the examination. The Ministry is entitled to appoint and remove another member of the Test Committee4).
(2) Accredited equipment shall confirm to the tenderer the date and place of the final examination at least 30 calendar days before the date of the final examination. The candidate shall be assigned to the final examination date no later than 3 months after the fulfilment of all the requirements laid down in the relevant training programme.
Content, course and evaluation of the final test
(1) The final test of the accredited qualification course consists of a practical and theoretical part and is normally held on one day. The practical part of the final test shall be preceded by the parts theoretical; where the practical part of the final test is evaluated has not benefited, the theoretical part of the final test is not continued and the overall evaluation of the final test is "failed '.
(2) Before the final examination, the tenderer shall demonstrate his identity. An entry for the final test report shall be made on the submission of the identity document. If the final test is composed of several parts, identification may be required for each part of the test.
(3) The content and scope of the final examination of the accredited qualification course correspond to the content and extent of the knowledge and skills set out in the training programme to obtain the professional competence of the relevant health profession.
(4) The theoretical part of the final test consists in a response to at least three expert questions. Questions from the theoretical and practical part of the test shall be drawn and recorded in the final test report. Once the questions have been drawn, the examination committee shall provide a reasonable time to prepare the response, at least 15 minutes.
(5) The practical part shall be considered as:
(a) successful performance of practical performance; or
(b) analysis of submitted nursing or laboratory diagnostic problems.
The practical part of the final test shall be recorded in the final test report.
(6) The result of each part of the final test and the overall evaluation of the final test shall be evaluated for benefit or benefit.
(7) If the answer to any of the submitted questions in the theoretical part was insufficient, but the applicant failed to demonstrate the essential ignorance, the Examination Board may allow the drawing of an additional question. The drawing of an additional question may be allowed only once throughout the test. The text of the supplementary question shall also be recorded in the final test report. If the answer to any of the questions of the theoretical part of the final test is classified as non-profit-making after any additional question, or if the practical part is classified as non-profit-making, the overall assessment of the final test shall be "non-profit-making '.
(8) The overall outcome of the evaluation of the final examination shall be announced by the examination panel after consultation of the final examination. The evaluation of the individual parts of the final test and the overall evaluation of the final test shall be recorded in the final test report which records the accredited equipment in the final test application file. After successful completion of the final examination, the graduate shall receive, within a maximum of 30 days from the date of successful completion of the final examination, a certificate of professional competence obtained in the course of the medical profession on a form issued by the accredited establishment.
Non-participation in the final examination, withdrawal from the final examination, its repetition
(1) If the candidate cannot attend the final examination by the date for which he was invited, he may excuse his non-participation to the accredited establishment. An apology is considered
(a) a written apology delivered to an accredited establishment before the deadline for the final examination;
(b) in the case of serious reasons, a written apology received by an accredited establishment within 10 calendar days of the date of the final examination; or
(c) withdrawal from any part of the final examination before the beginning of the final examination.
(2) If the applicant makes an apology, he may apply for the final examination within the following time limit, if possible for organisational reasons.
(3) If the candidate withdraws from any part of the final exam after or during the drawing of the questions, he shall be assessed as if he had failed the final test.
(4) If the candidate does not show up for the final test without an apology, he is assessed as if he did not benefit from the final test.
(5) If the tenderer has failed any part of the final examination, that part of the final examination may be carried out not earlier than 2 months after the date of the final examination.
ANALYSIS TEST
Test Panel
(1) The approval test, with the exception of the written part and the practical exercise of the relevant health profession under professional supervision (hereinafter referred to as the "practical part"), is to be held before the examination committee set up by the Minister for Health under the law. The panel shall have at least three members. The members of the Examination Board shall be elected by the Chairperson who shall be responsible for the deliberations of the Examination Board. This option can be repeated twice. If the latter fails to elect a chairman, it shall be determined by drawing lots.
(2) The approval test is only accessible to healthcare practitioners (2) and to staff who carry out the examination administratively, except for advice on the outcome of the examination or part thereof, which is not public.
(3) The result of the examination and the probation test is decided by voting. In the event of a decisive vote, the President of the Commission shall vote.
(4) The written part of the probation test referred to in Paragraph 20 (3) shall be held in the presence of at least one Ministry employee.
Application for a probation test
The application shall be accompanied by a certified copy of the educational document, accompanied by a translation into the Czech language, which must be carried out by an interpreter on the list of experts and interpreters 5), a certified copy of the certificate of recognition of higher education or a notation of a certificate issued by a foreign school.
Deadline and venue of the probation examination
(1) The approval test shall be carried out at the dates specified by the Ministry or, where appropriate, by the designated organisation; The Ministry shall set at least 2 dates for the calendar year concerned, not later than 15 March for the second half of the calendar year concerned and 15 September for the first half of the following calendar year. Where necessary, the Ministry or, where appropriate, the designated organisation shall determine further dates and probation tests.
(2) The Ministry or, where appropriate, the designated organisation, shall determine the place of holding and the probation examination and confirm them together with the date of the probation examination at least 30 calendar days before the date of the examination and probation examination to all tenderers who submitted an application for and probation examination pursuant to Article 18 at least 50 days before the date of the probation examination. The Ministry or, where appropriate, the designated organisation shall inform the members of the examination committee of the date and place of the examination. The Ministry or, where applicable, the designated organisation shall cancel the examination if at least 1 tenderer does not apply within 50 calendar days before the date of the examination.
(3) The Ministry or, where appropriate, the designated organisation shall publish, in a way that allows remote access, the dates of the examinations and probation tests and the current list of test questions for oral examination in accordance with Section 20.
Content, course and evaluation of the probation test
(1) The Examination Committee verifies the aprobation test of professional theoretical knowledge, knowledge of the health system in the Czech Republic and the ability to speak in the Czech language to the extent necessary for the exercise of the medical profession.
(2) The content and scope of the individual parts of the probation examination correspond to the content and extent of the knowledge and skills set out in the fields of study to be eligible for the medical profession of secondary schools and higher vocational schools and in accredited medical study programmes to be eligible for the medical profession of higher education institutions in the Czech Republic or, where appropriate, in the training programmes of specialisation training or accredited qualification courses.
(3) Aprobation test is divided into 3 consecutive parts
(a) the first part shall be written tests; the first test verifies the expertise and the second test verifies the knowledge of the health system and the basis of the law in relation to the provision of healthcare in the Czech Republic. Tests can be carried out in Czech, English, French, German or Russian. Successful completion of written tests and probation tests is a prerequisite for the practical part,
(b) the second part is the completion of the practical part. Successful completion of the practical part is a prerequisite for the oral examination, which follows as soon as possible,
(c) the third part is an oral vocational examination which verifies the expertise or the ability to express itself in the Czech language.
(4) The practical part and the probation examination shall be carried out by the applicant by his successful completion of the period set out in the Annex to this Order, to the extent specified weekly working time under the professional supervision of a healthcare professional with no professional supervision in the relevant field, which shall evaluate in writing whether the practical part and probation examination have been successfully carried out. The practical part of the probation test is carried out by the health service provider or, where appropriate, by the social service provider.
(5) The oral examination shall consist of three questions. The questions shall be drawn and recorded in the application test report. Once the questions have been drawn, the examination committee shall provide the candidate with a reasonable time to prepare the answer, but at least 15 minutes. In the event that, in the oral examination, the answer to one of the questions submitted was not sufficient, but the applicant failed to demonstrate the essential ignorance, and the probation committee allowed the tenderers to draw additional questions. The additional question can only be drawn once throughout the oral professional examination. The course of the oral examination, including the text of the questions and any supplementary questions, shall be recorded in the report on the probation test.
(6) Before starting each part of the probation examination, the tenderer shall prove his identity before the commission and shall provide proof of payment of the costs associated with the organisation of the relevant part of the probation examination. Submission of an identity document and proof of payment of costs associated with the organisation of the relevant part of the probation test shall be recorded in the report on the probation test.
(7) Individual parts of the probation test, with the exception of the practical part, and its overall result are evaluated for benefit or benefit.
(8) The overall evaluation and probation test will be announced by the examination committee after consultation of the result and the probation test. The evaluation of the individual parts of and the probation test and the overall evaluation of and the probation test shall be recorded in the test report.
Non-participation in the Aprobation Test, withdrawal from the Aprobation Test, repetition
(1) If a candidate cannot attend the probation examination or part thereof within the time limit for which he was invited, he may excuse his non-participation to the Ministry or, where appropriate, to the entrusted organisation. An apology is considered
(a) a written apology received by the Ministry or, where appropriate, by an authorised organisation before the date of the probation examination;
(b) in the case of a serious reason, a written apology sent to the Ministry or, where applicable, to the entrusted organisation within 10 calendar days of the date of the examination; or
(c) withdrawal from any part of the probation test before it is initiated.
If the applicant makes an apology, he may apply for the approval test or part thereof within the following time limit, if possible for organisational reasons. The reimbursement of costs associated with organisation and probation tests shall not be refunded.
(2) If the candidate withdraws from any part of the probation and probation test after or in the course of drawing the questions, he shall be assessed as if he did not benefit from the probation test.
(3) If the candidate does not show up for the probation test without an apology, he shall be considered not to have benefited from the probation test or part thereof.
(4) If the candidate has not benefited, he may pass the probation test as soon as possible, if possible for organisational reasons.
(5) A candidate who has successfully passed a part of the and probation test is recognised if the remaining part of the test is successfully completed within 2 years of the successful completion of that part and the probation test.
PROCEDURE FOR VERIFICATION OF THE NOTIFICATION OF THE CZECH LANGUAGE
(1) The ability to express itself in the Czech language is verified by the Ministry
(a) an assessment of the proof of the Czech or Slovak language language examination,
(b) an assessment of education completed in Czech or Slovak;
(c) an assessment by other applicants of evidence of knowledge of the Czech language to the extent strictly necessary for the performance of the relevant health profession or for the activities related to the provision of health care; or
(d) by interview.
(2) The Ministry shall refrain from verifying the knowledge of the Czech language by interview if the applicant submits the documents referred to in paragraph 1 (a), (b) or (c). An alert shall be made on this operation on file.
(3) The knowledge of the Czech language is verified by a commission appointed by the Ministry, which has at least 3 members, of which at least 1 member has the competence to perform the non-medical medical profession and at least 1 member is a representative of the Ministry. The members of the Commission shall elect a chairman who shall direct the deliberations of the Commission and be responsible for its activities. If the latter fails to elect a chairman, it shall be determined by drawing lots.
(4) The outcome of the verification shall be decided by vote. In the event of a decisive vote, the President of the Commission shall vote.
Date and place of verification of Czech language
The date and place of the verification shall be determined by the Ministry and notified to the tenderer at least 15 calendar days before the date of the verification.
Contents, course and evaluation of Czech language verification by interview
(1) Knowledge of the Czech language is verified to the extent necessary for the pursuit of the profession. The applicant shall demonstrate the ability to express and communicate in the Czech language by reading the technical text in the Czech language, reproduction of the contents of the read text, interview with a fictitious patient or, where appropriate, with a person who is eligible for the non-medical medical profession and a written record relating to the performance of the relevant medical profession (6).
(2) Before the start of the verification of the knowledge of the Czech language, the applicant shall prove his identity before the commission and an entry shall be made to the protocol.
(3) The Commission will evaluate the applicant's knowledge of the Czech language in general and record it in the report on the verification of the Czech language. A record of the content of the interview shall be made in the report on the verification of Czech language knowledge.
(1) This section applies to the verification of the knowledge of the Czech language where the applicant has submitted an application referred to in the third sentence of Paragraph 81 (4) of the Act, an application referred to in § 85a (1) of the Act or, if the case referred to in § 85 (6) of the Act and the applicant complies with the minimum requirements laid down in the legislation governing minimum educational requirements for the acquisition of professional competence for the medical profession, an application referred to in § 85b (1) of the Act.
(2) This section also applies to the verification of the ability to speak in the Czech language in the case of persons referred to in Section 86 (1) of the Act, if not the case under Section 86 (2) of the Act.
TRANSITIONAL AND FINAL PROVISIONS
(1) A candidate entered for the test run before the date of application of this order shall carry out the test run in accordance with the existing legislation, but no later than 1 year after the date of entry into force of this order. If the tenderer fails the test within the period specified in the first sentence, this order shall be followed.
(2) A candidate who has applied for a probation test before the date of application of this Decree will carry out the probation test in accordance with the existing legislation, but no later than 1 year after the date of entry into force of this Decree. If the tenderer fails the test within the period specified in the first sentence, this order shall be followed.
Decree No. 394 / 2004 Coll., adjusting the details of the completion of the test, the tests for the certification of the medical profession without professional supervision, the final examinations of the accredited qualification courses, the probation examinations and the test schedule for those examinations shall be deleted.
Efficacy
This Decree shall take effect on 1 July 2009.
