implementing certain provisions of the Law on wine-growing and wine-growing and amending certain related legislation
The Ministry of Agriculture pursuant to § 5 (8), § 10 (4), § 13 (6), § 14 (3) and § 18 (5) of Act No. 115 / 1995 Coll., on wine-growing and wine-growing and amending certain related legislation ("the Act ') provides:
§ 1
Wine-growing communities in the various wine-growing regions and varieties for the production of wine-growing wines with added value
(k § 5 of the Act)
(1) The list of wine-growing communities in each wine-growing region is set out in Annex 1 to this Decree.
(2) The list of varieties which may be grown in individual wine-growing regions for the production of wine-growing wines with the addition is set out in Annex No 2 to this Decree.
Sorting, production and quality of vine wine and technology loss standards
(to Sections 10 and 13 of the Act)
§ 2
Details of vine wine sorting
(1) According to the method of technological processing of vine wine, the wine is classified and referred to as:
(a) sparkling wine produced by controlled secondary fermentation of wine or must in bottles or tanks and showing an excess pressure of at least 0,3 MPa in bottles at 20 ° C;
(b) semi-sparkling wine (not to be marked as a sect) produced by the artificial saturation of wine with carbon dioxide and showing an excess pressure of between 0,1 and 0,29 MPa at 20 ° C in bottles,
(c) grape wine of dessert, made from vine wine by the addition of refined sugar or concentrated must, fine refined alcohol or vine distillate,
(d) grape wine of dessert, prepared in accordance with the procedure referred to in (c), with the addition of spices or extracts made from such spices, complying with the specific provisions, 1)
(e) low-alcoholic vine wine produced from vine wine of which the alcoholic strength by volume does not exceed 6% vol;
(f) wine of vines which have been fortified, produced from vine wine for which an appropriate reduction in the alcoholic strength by volume of not more than 0,5% vol has been made.
(2) According to the colour of the vine wine, the wine is classified and referred to as:
(a) white vine wine (made from white, pink or red grapes),
(b) rosé grape wine (made from red or blue grapes without fermentation, for table and quality wine of grapevine and blended white and red wine),
(c) red grape wine (made from blue grapes by fermentation or heat treatment).
(3) According to the sugar content, vine wine, not sparkling or sparkling, shall be classified and referred to as:
(a) dry, if it contains not more than 4 g of sugar in litre, or not more than 9 g in litre, if the acidity expressed in grams of titrable acids in litre is less than 2 g in litre than the sugar content,
(b) semi-dry, if the sugar content is between 4 and 12 g in litre or 9 and 18 g in litre if acidity complies with the condition laid down in (a);
(c) semi-sweet if the sugar content is higher than (b) but less than 45 g in litre;
(d) sweet if the sugar content is at least 45 g in litre.
(4) According to the sugar content, sparkling wine and sparkling wine shall be classified as:
(a) extra dry, sugar content not exceeding 15 g in litre; sparkling wines may be designated "Brut'
(b) dry, sugar content between 15 and 35 g in litre; sparkling wines may be designated "Sec ',
(c) semi-dry, sugar content between 35 and 50 g in litre; sparkling wines may be designated "Demi sec ',
(d) semi-sweet, sugar content between 50 and 80 g in litre; sparkling wines may be designated "Demi doux ',
(e) sweet, sugar content of more than 80 g in litre; sparkling wines may be named "Doux."
§ 3
Quality requirements for vine wine
(1) The sensory requirements for the quality of vine wine are set out in Annexes 3 and 4 to this Decree.
(2) The chemical and physical quality requirements for vine wine are set out in Annex 5 to this Decree.
(3) The health requirements for vine wine are laid down in a specific Regulation (1).
§ 4
Substances and manufacturing operations in the production of vine wine
(1) In the manufacture of all types of vine wine, the following may be used:
(a) on the treatment of grape sorrows, grape must and vine wine with enzymatic preparations;
(b) the fermentation of grape sorrows and grape musts of pure yeast,

(d) to ensure that the grape must of normal pure diammonium phosphate is properly fermented up to 300 mg / l,
(e) for the sizing of grape grips, grape musts and wine of sulphur dioxide gas, potassium or sodium disulphite, a 6% aqueous solution of sulphuric acid or gases resulting from the combustion of sulphur slices;
(f) to reduce the excess amount of sulphur dioxide or longer lying down, or any other desulphurisation measures authorised by specific regulations, 1)
(g) for the screening of vine wine by a non-toxic means, in particular the tannin, edible gelatine, zinc, agar, casein for food purposes, fresh or dried egg whites, colloidal silica solution, healthy wine yeast, quail, kaolin, bentonite, activated charcoal, polyvinylpolypyrolidone, potassium hexacyanoferrate, or other preparations authorised by specific regulations, 1)
(h) to feed wine of vine, carbon dioxide intended for food use;
(i) on the treatment of grape sorrows, musts and wines in physical ways, provided that they do not adversely affect the quality of the finished products;
(j) additives:
1. food tartaric acid, not more than 2 g / l of wine,
2. ascorbic acid, not exceeding 100 mg / l of vine wine,
3. metataric acid, not exceeding 100 mg / l of vine wine.
(2) Potassium ferrocene can only be used for laboratory checks before and after the screening, and the wine must not contain any cyanide compounds after the screening.
§ 5
Other substances and production operations in the production of vine wine
(1) In the production of sparkling wine, in addition to the substances referred to in Section 4, it may also be used:
(a) citric acid, not more than 3 g / l,
(b) cognac, brandy or wine distillate,
(c) concentrated grape must or refined sugar.
(2) In the production of semi-sparkling wine, it may also be used in addition to the substances referred to in Section 4.
(a) cognac, brandy or wine distillate;
(b) concentrated grape must or refined sugar.
(3) In the production of grape wine of dessert and vine wine of dessert spicy wine, in addition to the substances referred to in § 4, may also be used:
(a) concentrated grape must or refined sugar;
(b) fine refined alcohol,
(c) wine distillate,
(d) spices or extracts from such spices approved under specific regulations, 1)
(e) caramelized sugar.
(4) When adjusting the sugar content to the values referred to in Articles 2 (3) and 2 (4), grape wine of quality may also be used in addition to the substances referred to in Article 4, concentrated with refined sugar. Only must concentrated by heat (freezing or evaporation) may be used to adjust the sugar content of grape wine of the quality.
§ 6
Evaluation of the quality of vine wine and sampling
(Article 14 (1) of the Law)
(1) The evaluation of the quality of vine wine in accordance with the requirements laid down in Annexes 3, 4 and 5 thereto shall be carried out:
(a) in the case of vine wine stored in sample storage containers after homogenisation of the whole content;
(b) for wine in bulk containers (tanks, tanks or barrels) for which the required homogenisation cannot be carried out, the average sample prepared by mixing the incremental samples; partial samples of the same volume and number shall be taken from the top layer in one tenth of the total height below the surface, the middle layer and the bottom layer in one tenth of the total height above the bottom;
(c) in the case of wine in bottles, 2 bottles with a lot size up to 100 bottles, 5 bottles with a lot size from 101 to 1000 bottles and 10 bottles with a lot size above 1000 bottles.
(2) The samples to be taken shall be evaluated immediately in appearance and the necessary number of samples in the necessary volume with the relevant sampling protocol shall be sent to the laboratory for analysis. For the determination of quality and health indicators, appropriate analytical methods of testing contained in technical standards shall be used which provide sufficient accuracy of the results. The frequency of sampling and quality control shall depend on the purpose of the check and the conditions under which wine is produced and put into circulation.
(3) Quality assessment according to the requirements laid down in Annexes 3 and 4 to this Decree is to be carried out for vine wine
(a) white and pink at 10 to 13 ° C;
(b) red at 14 to 17 ° C,
(c) sparkling or sparkling at 6 to 9 ° C.
§ 7
Negative deviations of the wine content and wine products in the consumer packaging
(1) The wine content or other wine products in the packaging intended for consumers (2) may be lower than the nominal content indicated on the packaging at most by:

The average content in 10 controlled packages (packages of the same content) shall not be less than the nominal content of the same package, marked on the label.
(2) The negatives referred to in paragraph 1 shall not apply to packaging before which the international symbol "e 'is indicated. The negatives in the contents of such labelled packages may not exceed the following values:

§ 8
Loss standards for wine production
(1) The losses in the production of vine wine relate to the quantities handled, the basis being the volume of wine after fermentation before the first fermentation from yeast sludge. A hectolitre (hl) is used as a unit of quantity in the production of wine.
(2) The standards of losses in the production of vine wine by operation, taking into account the production technology, are established as follows:

(3) The sum of losses from each production operation referred to in paragraph 2 shall not exceed the total permitted amount of losses of 12,5%.
(4) For the separate evaluation of individual operations, the
(a) 1. the bottling of wine produced before 1 bottleneck multiplied by the loss standard for 1 bottleneck;
(b) 2. the bottling of wine produced before the second bottling multiplied by the loss standard for the second bottling;
(c) the training of wine multiplied by the standard of loss for training,
(d) the filtration multiply the filtered quantity of wine by the loss standard for the filtration;
(e) the bottling of the quantities of wine delivered for bottling multiplied by the standard of loss for bottling;
(f) filling the containers takes as a basis the disposal of wine (in barrels, demijons, etc.) and multiplies the standard of loss;
(g) the filling into the tanks of the wine in the tanks multiplied by the appropriate loss standard;
(h) the handling takes as a basis for calculating the loss standard the amount of handling during returning, coupling, etc., carried out outside of 1 or 2 sludges,
(i) storage shall take as a basis the sum of initial and final stocks divided by two and multiplied by the relevant loss standard for the calculation of the loss standard. Storage losses shall be calculated from wine on yeast, wine wrapped 1 times, twice the bottled, trained wine and wine in bottles.
(5) The provisions of paragraphs 1 to 4 shall not apply to wine produced under research and breeding tasks and stored in containers of less than 50 l.
§ 9
Method of presentation and evaluation of samples of quality and quality wine of vine varieties with added value before their entry into circulation and of vine wines imported from abroad in tanks or barrels
(to Section 14 of the Act)
For the collection of the necessary number of samples and the necessary quantity of each sample of vine wines under Section 14 (1) of the Act, the provisions of Section 6 shall apply.
§ 10
Means of keeping records
(to Article 18 of the Act)
(1) The model forms for keeping records of wine-growing pursuant to Article 18 (1) of the Act are set out in Annexes 6 and 7 thereto.
(2) The method of keeping records of the weight and sugar content of the grapes harvested pursuant to Article 18 (1) of the Act and the model form is set out in Annex 8 to this Decree.
(3) The method of keeping records of the weight and sugar content of the grapes or grape must purchased in accordance with Article 18 (2) of the Act and the model form is set out in Annex 9 to this Decree.
(4) The method of keeping records of the weight and sugar content of the grapes or grape must sold in accordance with Article 18 (1) of the Act and the model form is set out in Annex 10 to this Order.
(5) The method of keeping records of the weight and sugar content of the processed grapes or grape must provided for in Article 18 (2) of the Act and the model form is set out in Annex 11 to this Decree.
(6) The method of keeping records of the weight of refined sugar purchased and processed in accordance with Section 18 (2) of the Act and the model form is set out in Annex 12 to this Decree.
(7) The method of keeping records of the manufacture of alcoholic beverages from marc pursuant to Article 18 (3) of the Act and the model form is set out in Annex 13 to this Decree.
(8) The method of keeping records of the production of alcoholic beverages from yeast lees provided for in Section 18 (3) of the Act and the model form is set out in Annex 14 to this Decree.
(9) The method of keeping records of the quantities of wine produced, stocks and circulation referred to in Article 18 (2) of the Act and the model form is set out in Annex 15 to this Decree.
§ 11
Efficacy
This Decree shall take effect on 1 September 1995.
