Law on compulsory diphtheria vaccination

on compulsory diphtheria vaccination.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
§ 1.
General provisions.
(1) In order to prevent and control diphtheria, mandatory protective vaccination (re-vaccination) against diphtheria ("vaccination") is introduced.
(2) Vaccination is carried out by district national committees through district and state municipal (urban) and district doctors and other health establishments.
§ 2.
Baby shots.
(1) Each child is subject to vaccination, which shall be carried out on a compulsory basis three times. The first vaccination may be carried out only after six months of life and must be carried out no later than two years. The second vaccination shall be subject to the child in the calendar year in which the third year of life is completed. The third vaccination shall be subject to the child in the calendar year in which the fifth year of life is completed.
(2) A child who completed the second year before the entry into force of this Act and did not exceed the fourth year of life must be vaccinated by the end of 1947 and in the calendar year in which the fifth year of life is completed. A child who completed the fifth year before the entry into force of this law and did not exceed the tenth year of life must be vaccinated by the end of 1947.
§ 3.
Extraordinary vaccinations.
If diphtheria occurs, or if otherwise public health interests require it, the national committee (in Slovakia) may extend the range of persons subject to vaccination, regardless of the restrictions set out in Section 2.
§ 4.
Suspension of vaccination.
Vaccination shall be postponed for persons who are demonstrated by a medical certificate or for whom the vaccinating physician finds that vaccination would endanger their health, for as long as the medical condition preventing vaccination persists.
§ 5.
Release the vaccine.
Vaccination shall not be subject to a person established by medical evidence that they have been vaccinated in the calendar year in which they were to be vaccinated.
§ 6.
Forced vaccination.
Vaccination can be enforced by political execution, especially by direct coercion.
§ 7.
Responsibility for vaccination of children.
Legal representatives of children and persons entrusted with childcare are required to ensure that children undergo vaccination under this law.
§ 8.
Vaccination lists.
(1) Under the directives issued by the Ministry of Health in agreement with the Ministry of Interior and Education and Education, the District National Committees are required to draw up lists of persons subject to vaccination for the cooperation of local national committees, matrices and school managers.
(2) Home owners or their representatives shall be required to submit complete lists of persons in the house subject to vaccination to invite the local national committee.
(3) The apartment users shall be obliged to supply the owner of the house or his representatives with a list of persons in the apartment subject to vaccination.
§ 9.
The cooperation of local national committees. Cost reimbursement.
(1) Local national committees shall be obliged to cooperate in carrying out vaccination and to provide the necessary auxiliary forces for vaccination, as well as to provide and maintain suitable rooms for their own cargo.
(2) The other costs of vaccination shall be borne by the State where the social security holder is not obliged to pay.
(3) Vaccination under this law is free of charge; both doctors and auxiliary forces may neither seek nor receive remuneration for vaccination activities from the parties.
(4) The national municipal (municipal) and district doctors are entitled to a refund for vaccination, the amount of which is fixed annually by the Minister for Health in agreement with the Minister for Finance by a decree in the Official Journal.
Provisions criminal and final.
§ 10.
The action and omission of the provisions of this law or of the regulations issued pursuant to it shall be punishable by the District National Committee, if not more strictly criminal, as an administrative offence by a fine of up to 10 000 CZK or by a prison (lockdown) within one month.
§ 11.
The Law of 15 May 1942, No 71 of the SLA, on vaccination against diphtheria, is hereby repealed.
§ 12.
This Act shall take effect on the day of its publication; It shall be implemented by the Minister for Health in agreement with the participating members of the Government.
