DECLARATION
Ministers of Internal Trade and Finance and Chief Arbiter of the Czechoslovak Socialist Republic
of 17 December 1960
on the purchase of goods in state and cooperative trade by socialist organisations
The Ministers of Internal Trade and Finance and the Chief Arbiter of the Czechoslovak Socialist Republic shall, in agreement with the Minister-President of the State Planning Commission pursuant to § 1 of Act No. 160 / 1949 Coll., on Internal Trade, under § 11 (2) of Act No. 83 / 1958 Coll., on the Financial Planning and Financial Management of National Enterprises and other Economic Organisations of the State Socialist Sector, under § 20 (1) (b) and § 2 of Act No. 8 / 1959 Coll., laying down basic rules on the State Budget and on the Management of Budgetary Funds, and under § 190 of Act No. 69 / 1958 Coll., on Economic Relations between Socialist Organisations:
Preliminary provisions
Socialist organisations (hereinafter referred to as "organisations') shall meet their needs within the framework of material technical supplies directly to production and, where appropriate, to its sales organisations; consumer goods sold in state and cooperative trade, which are primarily intended to meet the needs of the population, can therefore only be purchased at retail prices under other provisions of this decree.
Small purchases
(1) Organisations may purchase consumer goods at any retail outlet for a maximum amount of Kčs 600, - monthly (hereinafter referred to as the "monthly limit"), unless the superior authority determines a lower amount. This amount shall be calculated for each establishment (component) which holds the treasury or which has a settlement advance on small and urgent operating expenditure, or, where appropriate, the standard of cash expenditure directly from the sales. *)
(2) If the monthly limit is not exhausted in the current month, the remainder shall not be transferred to the next month.
Purchases not included in the monthly limit
(1) All organisations may purchase without counting up to the monthly limit in accordance with § 2
(a) all kinds of food goods;
(b) the types of industrial goods listed in the Annex hereto.
(2) In addition to the goods referred to in paragraph 1, they may purchase other types of goods without counting up to the monthly limit referred to in § 2
(a) single agricultural cooperatives;
(b) schools of all kinds when purchasing for the free provision of the school needs of pupils;
(c) basic nine-year and general education secondary schools for polytechnical teaching of pupils, vocational and higher education institutions for research, teaching and scientific purposes, research institutes and development centres for research and development purposes;
(d) the establishment and budgetary organisation of local national committees on paid services, small establishments of local national committees and municipal services undertakings of up to 50 employees, to which the local (urban) national committee has granted the character of small enterprises, in all cases in their supplementary supply to the population for the performance of paid services;
(e) basic components (divergences, groups, unity, etc.) of voluntary social organisations;
f) Central administration of Czech film up to 250 000 KKS per year, Czechoslovak TV up to 150 000 KKS per year, Czechoslovak Radio up to 100 000 KKS per year, National Theatre in Prague up to 100 000 KKS per year, National Theatre in Bratislava up to 50 000 KKS per year and Theatre Service in Prague up to 50 000 KKS per year,
(g) children's and youth 'homes when purchasing footwear and clothing components for young people;
(h) organisation of purchases from means of foreign relations;
(i) organisation of purchases from collections or donations from the population.
Organisations with the exception of single agricultural cooperatives may not purchase professional and protective clothing, footwear and protective equipment, provided free of charge to employees, either within the monthly limit or in accordance with § 3.
Method of payment
(1) All purchases are paid by the organization to Kčs 600, - cash, above Kčs 600, - cashless to invoice.
(2) In the case of repeated purchases of food goods by organisations operating regular cooking and catering, payments of such purchases may be made cash at the same time, but no later than 10 days, by mutual agreement between the seller and the buyer.
(3) When buying without payment, the organisation is obliged to submit a written order indicating the bank connection. In these cases, the economic contract for the supply of products is concluded even if the supplier is in compliance with the order within the time limit for receipt.
Purchase records
(1) Sellers are required to register all cashless purchases of organisations and to list them on a quarterly basis in the accounting statements.
(2) Buyers are required to register all cash purchases in the store separately in the ticket books, or on the forms for booking advances *) and to list them on a quarterly basis in the accounting statements.
(3) The provisions of paragraph 2 shall not apply to single agricultural cooperatives, advance organisation of national committees, local national committees and their awareness-raising facilities, building housing cooperatives and the essential components (divergences, groups, unity, etc.) of voluntary social organisations. The survey of cash purchases of these organisations shall be carried out with a sample survey.
Final provisions
The Ministry of Internal Trade, other ministries or central offices and authorities superior to the retail turnover components and national committees may restrict or prohibit the sale of certain types of consumer goods to organisations within the limits of their competence.
(1) The bodies of the financial system, in particular the Czechoslovak State Bank, also control at random compliance with the provisions of this Decree.
(2) In case of detected defects, it shall be followed according to the relevant regulations. * *)
Order No 161 / 1957 Ú. l., on the purchase of goods in state and cooperative trade by economic, budgetary and other organisations, as amended by Regulations No 160 / 1958 Ú. l. and No 138 / 1959 Ú. l.
This Decree shall take effect from 1 January 1961.
