amending and supplementing certain other provisions of the Decree of the President of the Republic on racing and business councils.
The National Assembly of the Czechoslovak Republic decided on the following Act:
Čl. I.
The decree of the President of the Republic of 24 October 1945, No. 104 Coll., on racing and business councils, is amended as follows:

„§ 24.
Share in net profit.
(1) The management of the plant in which the race board, the racing confidant or the replacement body of the race council is or is to be set up shall be obliged to pay to the single fund of workers (§ 24 (a) 10% share of net profit. The amount of the share of net profit paid to the single fund operating in public undertakings shall be determined by the Government by regulation.
(2) If several establishments constitute an undertaking (Section 6), the basis for calculating the share referred to in paragraph 1 shall be the net profit of the whole enterprise.
(3) The Government will issue by regulation more detailed provisions on the co-operation of plant management and public authorities in the implementation of this Act and on the way in which the basis for calculating the share of net profits, its maturity and the method of contribution is established in accordance with Paragraph 32.
(4) Disputes concerning performance or the amount of the share of net profit referred to in paragraph 1, first sentence, shall be decided exclusively on the proposal of the single fund of workers or the administration of the establishment by the arbitration panel responsible (§ 33). "
2. The following Section 24a is inserted after Section 24:
„§ 24a.
(1) The Single Workers' Fund shall be established as a separate legal entity in the Single Trade Union Organisation. Its task is to support efforts to improve the social, health and cultural status of workers.
(2) The rules on the institutions, the management and management of the single fund of workers and on the use of its resources and on its tasks and on the accounting and clearance of accounts shall contain the statutes to be laid down by the Government following the hearing of the competent authority of the Single Trade Union Organisation.
(3) The single fund of workers is exempt from fees and charges for official acts in administrative matters. His assets are exempt from the fee equivalent.
(4) The bodies of the single fund of workers shall remain fully silent on the production, trade and operational secrets of the plant which they have learned in the performance of their duties. ';

„§ 32.
In the facilities of public administrations, the administration shall provide the single fund of workers with an amount to be fixed by the Government Regulation. ';
4. Paragraph 37 (1) (d) reads as follows:
"(d) a member of the racing board, a race confidant, a member of the business council, a member of the replacement body of the race council or of the single fund of workers who infringes the obligation of confidentiality (§ 14, par. 2, par. 24a, par. 4) with intent to profit or harm the management of the race,"
5. the following shall be inserted after Paragraph 37 (1) (e):
"(f) a member of the race or business council, a racing confidant, a member of the replacement body of the race council or of the single fund of workers who, by any other means, grossly infringes the obligations arising from their duties."
6. Paragraph 37 (3) reads as follows:
"(3) The criminal proceedings shall be carried out by the Regional National Committees, in the cases referred to in paragraph 1 (f), on a proposal from the competent authority of the Single Trade Union Organisation. ';
7. The following paragraph 6 is inserted after Paragraph 37 (5):
"(6) Who, intentionally or negligently, will cause the funds of the single fund of workers or the funds allocated to them to be used for purposes other than those specified by them, in particular who, as a member (alternate) of the race council, votes for such use, will, first of all, be punished by a prison court within 6 months of the offence being committed. '
Čl. II.
(1) The single workers' fund is transferred by the race council to the share of net profit (§ 24) and to the contribution (§ 32), unless the share has already been paid under the current rules. A paid share or contribution, if not properly used, shall be required by the race councils to carry out a single fund of workers under directives issued by the competent authority of the single trade union.
(2) Pending the establishment of the bodies of the Single Workers' Fund, the competent authority of the Single Trade Union Organisation shall exercise the rights and fulfil the obligations of the Fund.
Čl. III.
This Act shall take effect on the day of its publication; It shall be carried out by the Minister for Social Welfare in agreement with participating members of the Government.
