GOVERNMENT REGULATION
of 26 June 2000
determining the value of the point and the amount of the payment of health care payable on public health insurance for the 2nd half of 2000
The Government orders pursuant to § 17 (5) of Act No. 48 / 1997 Coll., on Public Health Insurance and on the amendment and addition of certain related laws, as amended by Act No. 2 / 1998 Coll., hereinafter referred to as "the Act":
§ 1
For the second half of 2000, the values of the point and the amount of the health care payments paid by public health insurance not agreed under Section 17 (5) of the Act are set out in the Annex to this Regulation.
§ 2
This Regulation shall enter into force on 1 July 2000.

Values of the point and amount of health care payments paid from public health insurance for the 2nd half of 2000

Health care provided in health care institutions of the Czech Republic, except for health care in professional medical institutions, long-term sick and health care institutions reporting on treatment day 00005 (hereinafter referred to as "bed facilities')
This health care will be paid in the 3rd and 4th quarters of 2000 according to the contractual agreement between the health insurance company and the healthcare establishment
(a) flat rate
Standard rate procedure:
1) The basis for the flat rate shall be calculated as follows:

ZPS2. pol. 2000 = (B2. pol. 1999 x VCB2. pol. 2000) + Z2. pol. 1999,
where:
ZPS2. pol. 2000 = basis for the flat rate for the second half of 2000
B2. Pol. 1999 = the number of points for the medical performance provided, except for health performance in excess of the flat rate, transport performance and patient category in the second half of 1999 of the bed equipment in question, which were declared and recognised from 1.7.1999 to 31.5.2000; the number of points for the second half of 1999 does not include points for care in excess of the flat-rate payment
VCB2. pol. 2000 = the power price of the point in the amount of CZK 0,87 for the 2nd half of 2000
Z2. pol. 1999 = remuneration for the medicinal products separately charged and the material separately charged, except for the medicinal products separately charged and the material separately charged which were paid in excess of the flat rate and provided in the 2nd half of 1999 and which were declared and recognised from 1.7.1999 to 31.5.2000
2) Calculation of the individual power price of the point (hereinafter "IVCB2. 1999") of the medical establishment

IVCB2. pol. 1999 = HRADA2. pol. 1999- Z2. pol. 1999BODY2. pol. 1999
where:
POINT 2. 1999 = the number of points for the provided medical performance, transport performance and patient category in the second half of 1999 of the bed equipment which were declared and recognised from 1.7.1999 to 31.12.2000
Z2. pol. 1999 = remuneration for the medicinal products separately charged and the material separately charged, in addition to the medicinal products separately charged and the material separately charged in excess of the flat rate provided in the 2nd half of 1999, which were declared and recognised from 1.7.1999 to 31.5.2000
REMUNERATION 2. 1999 = remuneration for the health performance provided, transport performance and patient category in the second half of 1999 of the bed establishment and which were declared and recognised from 1.7.1999 to 31.5.2000
(3) Corridor risk = the percentage range within which the fixed flat rate referred to in point 4 may vary for the second half of 2000, compared to the second half of 1999, with the exceptions given below
(a) The lower risk of the corridor (DRS) shall be 96%, and for the sleepers referred to in Part D shall be 97%. For sleepers, the fixed flat rate may not be less than 96% or 97% (determined lower risk corridor) of the remuneration for the second half of 1999, except as indicated below;
b) DRS according to point (a) applies only on the assumption of an individual power price of up to CZK 0.95 based on the calculation for the 2nd half of 1999.
For sleeper devices whose individual power value of the point (IVCB2. pol. 1999) is greater than CZK 0.95, the value of the point 0.95 CZK shall be used for calculating the lower corridor risk.

DRS2. pol. 2000 = B2. pol. 1999 x 0,95 + Z2. pol. 1999
The lower risk of the corridor cannot fall below 85% of the remuneration for the second half of 1999;
(c) The upper risk of the corridor (HRS) is set at 117% of the remuneration for the second half of 1999. The upper risk of the corridor shall not be applied to the sleeper facilities listed in Part D.
(4) The flat rate shall be calculated as follows:
- PS2. pol. 2000 = DRS x HRADA2. pol. 1999 x K,
if ZPS2. pol. 2000 ≤ DRS x HRADA2. pol. 1999
- PS2. pol. 2000 = PS2. pol. 2000 x K,
if DRS x HRADA2. 1999 ≤ ZPS2. 2000 ≤ HRS x HRADA2. 1999
- PS2. pol. 2000 = HRS x HRADA2. pol. 1999 x K,
if HRS x HRADA2 / 1999 ≤ ZPS2 / 2000,
where:
PS2. pol. 2000 = flat rate for 2nd half 2000
DRS = lower risk corridor determined in accordance with point 3)
HRS = upper risk corridor determined in accordance with point 3)
REMUNERATION 2. 1999 = comparison volume of remuneration, i.e. remuneration for health care provided and recognised in the 2nd half of 1999 (remuneration for medical performance provided, transport performance and patient category in the 2nd half of 1999 of the bed establishment, which was declared and recognised from 1.7.1999 to 31.5.2000)
K = coefficient taking into account transfers of insured persons between health insurance companies
A national coefficient shall be applied to sleeper establishments providing specialised and superspecialised care referred to in Part C and a district coefficient shall be applied to other sleeper establishments. The coefficients are given in Part B. If, on the 8th reallocation, the national coefficient is changed by more than 3%, the Contracting Parties may agree to adjust the coefficient K accordingly for the fourth quarter of 2000.
The coefficient "K 'shall be calculated as follows:

K = PP05 / 2000PP05 / 1999,
where:
PP05 / 2000 = number of insured persons of the health insurance company at 1.5.2000 according to the central register of insured persons
PP05 / 1999 = number of insured persons of the health insurance company as at 1.5.1999 according to the central register of insured persons
The following shall be included in the remuneration for the second half of 1999:
1. adjustments of flat rates due to the application of regulatory mechanisms to the amount of care claimed;
2. individual adjustment of the flat-rate payments made by 31 May 2000 at the latest.
In addition to the flat rate, a remuneration will be made in the second half of 2000:
1. for cardioverters provided in the 2nd half of 2000,
2. for neuromodulation stimulators - provided in the 2nd half of 2000 in the treatment of epilepsy in selected bed facilities,
3. for in vitro fertilisation treatment (according to in vitro fertilisation rules) provided in the 2nd half of 2000 - for sleepers carrying out standard sterilisation treatment using the extra-body fertilisation method,
4. for the medical performance of haemodialysis No 18051, 18052, 18510, 18513, 18521, 18522, 18530, 18550, 18560, 18570, 18580 and 18590 provided in the second half of 2000 with a value of CZK 1 according to the Decree of the Ministry of Health No. 134 / 1998 Coll., which issues a list of health performance with points values, as amended, while for performances 18521, 18522, 18530, 18550, 18560, 18570, 18580 and 18590, the overhead costs are determined at 4 points / minute,
5. payment for selected medicinal products separately charged according to Part E for the treatment of haemophilia provided in the 2nd half of 2000;
6. payment for selected medicines specifically charged for HIV / AIDS treatment in selected sleepers listed in Part F provided in the 2nd half of 2000.
The following shall not be taken into account in the amount of the remuneration (FOREIGN 2 / 1999) and in the amount of the flat-rate base (ZPS2 / 2000):
health care to be paid in the 2nd half of 2000 in excess of the flat rate referred to in the preceding paragraph (points 1 to 6. - this treatment shall be deducted from the amount of ÚRADY2.
1. adjustments to flat rates resulting from the application of regulatory mechanisms to prescribed medicinal products and medical devices in the second half of 1999;
2. adjustments to flat rates due to the inclusion of sleepers in the DRG experiment;
3. payment for healthcare provided in the 2nd half of 1999 in cases where such care is not already provided by the hospital or is otherwise covered.
The advance payment shall be set at the flat rate calculated in accordance with point 4 for the third and fourth quarters of 2000 respectively,
or
b) This health care will be paid in accordance with the contractual agreement between the health insurance company and the bed establishment pursuant to Decree No. 134 / 1998 Coll., which publishes a list of health performance with point values, as amended, by payment for provided health performance, where the value of the point is set at CZK 0,87. This option can only be applied to sleeper establishments where there is a significantly fluctuating amount of health care provided by public health insurance, where it is not possible to set a flat rate for the comparison period - 2 December 1999 because of the small number of insured persons of the health insurance company concerned and where on average the sleeper establishments do not charge a specific health insurance company more than CZK 300,000 / calendar quarter. If the Contracting Parties agree, this option may also be chosen in the case of higher billing volumes, but the condition of fluctuating care must be fulfilled.
Other arrangements for payment referred to in points (a) and (b):
The condition of such remuneration is that the declared and recognised number of points for health care (for health performance, except for health performance in excess of the flat rate, transport performance and patient category) provided in the 2nd half of 2000 (outpatient and outpatient care and health transport) must be at least 90% of the number of points which form the basis for calculating the "K 'coefficient, multiplied by the" K' coefficient, taking into account transfers of insured persons between health insurance companies. In the event that a sleeper is less than 90% of the number of points in outpatient, outpatient and health care, the flat rate shall be reduced by a percentage by which the specified performance limit has not been met.
Where the payment for prescribed medicinal products and medical devices in the 2nd half of 2000 exceeds 101% of the comparative volume, which is the payment for prescribed medicinal products and medical devices in the 2nd half of 1999 and which has been multiplied by the transfer coefficient of "K 'insured persons, except for medicinal products authorised by a revision doctor, a reduction of 50% of that excess shall be fixed.
This regulatory mechanism will not be applied if the total cost of prescribed medicinal products and medical devices in the quarter 2000 does not exceed the planned costs of prescribed medicinal products and medical devices provided for by the health insurance plan of the relevant health insurance undertaking.
If the payment for prescribed medicinal products and medical devices in the 3rd and 4th quarters of 2000 is not more than 100% of the comparison volume, which is the payment for prescribed medicinal products and medical devices in the 3rd and 4th quarters of 1999, multiplied by the rate of transfer of insured persons, except for medicinal products and medical devices approved by the revision physician, the payment for the 3rd and 4th quarters of 2000 will be increased by 25% of the savings achieved.
The comparative period covers the health care provided by the bed establishment in question in the second half of 1999, declared and recognised from 1.7.1999 to 31.12.2000.
The pre-payment for the third and fourth quarters of 2000, respectively, shall be equal to the corresponding part of the flat-rate fixed for the second half of 2000, according to the number of reference points in the same quarters of the preceding year, with financial settlement being made after evaluation of the precipitation.
Health care provided in professional medical institutions
Health care provided in professional medical institutions will be paid in the 2nd half of 2000 according to the contractual agreement between the health insurance company and the professional medical institution as follows:
(a) a flat rate for health care amounting to 105% of the comparison amount. The comparative amount of remuneration for the relevant quarter shall be equal to the remuneration for the healthcare provided in the corresponding calendar quarter of last year, reported and recognised from 1.7.1999 to 31.5.2000, not including the remuneration for the healthcare provided during the comparative period in cases where such care is no longer provided in the healthcare establishment or is otherwise paid.
The condition of reimbursement for the healthcare provided is that:
1. The number of treatment days reported in the 2nd half of 2000 shall be at least 95% of the number of treatment days reported in the 2nd half of 1999. In the event that the professional treatment institution accounts for less than 95% of the treatment days thus determined, the fixed flat-rate fixed for the second half of 2000 for bed care shall be reduced by a percentage by which the limit of the number of treatment days has not been met.
2. The declared and recognised number of points in outpatient care in the 2nd half of 2000 must be at least 95% of the number of points for reported outpatient care performance in the 2nd half of 1999. In the event of less than 95% of the points thus determined, the part of the flat-rate for the 2nd half of 2000 for outpatient care shall be reduced by a percentage by which the specified performance limit has not been met.
3. The reported and recognised number of points in health transport in the 2nd half of 2000 shall be at least 95% of the points thus determined for the declared performance in health transport reported in the 2nd half of 1999. In the event that the medical professional institution accounts for less than 95% of the number of points, the part of the flat rate for health transport for the 2nd half of 2000 will be reduced by a percentage by which the specified performance limit has not been met,
or
b) health care in professional medical institutions will be paid by payment for the treatment day according to the Decree of the Ministry of Health No. 134 / 1998 Coll., which publishes a list of health performance with points, as amended. The value of the point is CZK 1. This option is only applicable to professional medical institutions which are only contracted for medical performance - a treatment day.
The advance payment shall be granted at the rate of 100% of the amount of the payment of the comparison period corresponding to the corresponding calendar quarter of the previous calendar year, provided that this amount is evidenced by the bill of payment of the healthcare provided. If the professional hospital accounts for a smaller amount of care, the interim payment shall be equal to the care declared and recognised.
Conditions for reimbursement under points (a) and (b) of this Article:
Where the average remuneration for prescribed medicinal products and medical devices in the 3rd and 4th quarters of 2000, excluding medicinal products and medical devices approved by the medical practitioner, exceeds 101% of the average remuneration in the 3rd and 4th quarters of 1999 respectively, a reduction of 50% of this excess shall be fixed.
This regulatory mechanism will not be applied if the total cost of prescribed medicinal products and medical devices in the quarter 2000 does not exceed the planned costs of prescribed medicinal products and medical devices provided for by the health insurance plan of the relevant health insurance undertaking.
Health care provided in long-term hospitals
Health care provided in long-term hospitals will be paid in the 3rd and 4th quarters of 2000 according to the contractual agreement between the health insurance company and the healthcare establishment as follows:
(a) a flat rate for health care of 100% of the comparative amount of remuneration multiplied by the national coefficient "K" taking into account transfers of insured persons between health insurance companies. The national coefficient "K 'is set out in Part B. The comparative amount of the remuneration for the relevant quarter is equal to the remuneration for the healthcare provided in the corresponding calendar quarter of last year, reported and recognised from 1.7.1999 to 31.5.2000, and does not include the remuneration for the healthcare provided in the comparative period where such care is no longer provided in a long-term hospital or is otherwise paid.
The condition of reimbursement for the healthcare provided is that:
The number of treatment days reported in the 2nd half of 2000 shall be at least 95% of the number of treatment days reported in the 2nd half of 1999 multiplied by the coefficient "K '. Where a long-term treatment facility accounts for less than 95% of the treatment days thus determined, the fixed flat rate for the second half of 2000 shall be reduced by a percentage by which the fixed limit on the number of treatment days has not been met,
or
b) this health care will be paid according to the Decree of the Ministry of Health No. 134 / 1998 Coll., which publishes a list of health performance with point values, as amended, when the value of the point is CZK 1, the value of the direction assigned to the point value of the treatment day will be increased by 30 points in the treatment facility for long-term patients and the drug flat rate will be increased by CZK 5 compared to the 2nd half of 1999.
Health care provided in healthcare establishments reporting treatment day No 00005
Health care provided in health care establishments reporting on treatment day 00005 will be paid at the 3rd and 4th quarter 2000 according to the contractual agreement between the health insurance company and health care establishment according to the Decree of the Ministry of Health No. 134 / 1998 Coll., which publishes a list of health performance with point values, as amended, when the value of the point is CZK 1.
Urgent health care in non-contractual medical institutions
The reimbursement of urgent health care, unless a contract is concluded between a healthcare establishment and a health insurance company, shall be made in the third and fourth quarters of 2000 for the health performance provided as follows:
(a) dental outpatient care will be paid at the rates applicable to health care provided by dental practitioners in the 3rd and 4th quarters of 2000;
b) Other health care will be paid according to the Decree of the Ministry of Health No. 134 / 1998 Coll., which publishes a list of health performance with point values, as amended, when the value of the point is set at CZK 0,80, whereby the health insurance company can apply regulatory mechanisms similar to those of the contractual health institutions, pursuant to § 40 (2) of Act No. 48 / 1997 Coll., on public health insurance and on amending and supplementing certain related laws.
