THE LAW
of 28 July 1999
amending Act No. 273 / 1996 Coll., on the jurisdiction of the Competition Authority
Parliament has decided on this law of the Czech Republic:
Act No. 273 / 1996 Coll., on the jurisdiction of the Competition Authority, is amended as follows:
1. in Paragraph 1 (3), including footnote 1, the following shall be added:
"(3) The Office shall be headed by a President appointed by the President of the Republic on a proposal from the Government. No one can be appointed President of the Office more than twice.
1) Paragraph 27 (4) of the Labour Code. ';
2. In Article 1, paragraphs 4 to 8 are added:
"(4) The office of President of the Office shall be incompatible with membership of a political party or political movement.
(5) The term of office of the President of the Office shall be six years.
(6) The President of the Republic may withdraw the President of the Office on a proposal from the Government. The President of the Office may waive this post.
(7) The duties of President of the Office are hereby terminated
(a) on the day immediately following the date of service of the written appeal, or of the written resignation, or of a later date specified in the notice of revocation or resignation;
(b) the expiry of his term of office;
(c) the date on which he became legally competent in a judgment which deprived him of his legal capacity or limited his legal capacity; or
(d) the date of the acquisition of legal power of the judgment by which he was sentenced for an intentional offence.
(8) The President of the Office may be removed from office, only:
(a) if he does not perform the function for more than 6 months; or
(b) if it seriously distorts the dignity of its function or distorts the independence and impartiality of the Office. "
The term of office of the President of the Office for the Protection of Competition, which shall take effect on the date of entry into force of this Act, shall begin to run on six years in accordance with Article 1 (5) of Act No. 273 / 1996 Coll., as amended by this Act, on the date of entry into force of this Act.
This Act shall take effect on the day of its publication.
