fixing the guarantee periods for supplies for the construction of residential buildings
The Ministry of Chemical Industry, Construction, Consumer Industry, Heavy Industry and Foreign Trade, in agreement with the participating central authorities, and after approval by the main arbitrator of the CSSR, provides for Section 392 of Economic Code No. 109 / 1964 Coll. ("the law '):
(1) The guarantee period for supplies to the investor for the construction of housing buildings *) is 3 years after the delivery is completed; in the case of supplies for residential construction carried out by self-employed housing cooperatives, the guarantee period shall be 3 years from the issue of the permit for permanent use of the building (approval), but not more than 4 years from completion of the supply.
(2) In the case of transactions in kind provided by a supplier to an investor under the liability for defects referred to in paragraph 1, unless otherwise agreed in accordance with Section 297 of the law, the guarantee period provided for in the law (Sections 198, 300, 308, 313 and 317); However, these guarantee periods shall not end before the guarantee period for the original performance.
(3) The guarantee period for subcontracting of all stages intended for deliveries referred to in paragraph 1 shall be for the period during which the customer is obliged to fulfil his obligations under liability for defects, but not more than 4 years after the subcontracting has been completed.
(4) The guarantee period for the performance provided under the liability for subcontracting defects referred to in paragraph 3 shall be for the period during which the customer is obliged to fulfil his liability obligations for defects, but not more than 4 years after the fulfilment of the liability obligations by the subcontractor.
The warranty periods referred to in § 1 shall not apply to supplies or parts thereof,
(a) for which a shorter warranty period or repair, replacement or renewal of customers (users) is provided for in the Annex to this Decree or in technical standards within a shorter period of three or four years of completion of the delivery;
(b) which constitute the so-called built-in civic equipment of * *) housing buildings such as commercial and non-residential rooms.
This Decree shall take effect on the date of its publication and shall apply to deliveries and subcontracting to which economic contracts have been concluded after that date.

*) If a product with inevitably shorter service life than the warranty period provided for by the law or by this decree is part of the delivery, it may not be possible. defects detected after the expiry of the life-cycle successfully claimed if the reason for the complaint were only that circumstance.
