DECLARATION

amending Decree No. 16 / 2012 Coll., on the professional competence of persons driving a railway vehicle and persons conducting revisions, inspections and tests of designated technical equipment and amending Decree No. 101 / 1995 Coll., which gives rise to the Order on the Health and Proficiency of Persons in the Operation of Railways and Railway Transport, as amended, as amended
According to Article 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 426 / 2021 Coll., Act No. 152 / 2023 Coll. and Act No. 303 / 2023 Coll., ("the Act '), the Ministry of Transport provides for the implementation of § 45 (8), § 46c (3), § 46e (5) and § 46j (5) Act:
Decree No. 16 / 2012 Coll., on the competence of persons driving a railway vehicle and persons conducting revisions, inspections and tests of designated technical equipment and amending Decree No. 101 / 1995 Coll., which issues the Order on the Health and Proficiency of Persons in the Operation of Railways and Rail Transport, as amended, as amended, as amended by Decree No. 160 / 2015 Coll., Decree No. 130 / 2017 Coll. and Decree No. 260 / 2023 Coll., is amended as follows:
1. In the title of the decree, the words "and amending the Decree of the Ministry of Transport No. 101 / 1995 Coll., which is published by the Order on the Health and Proficiency of Persons in the Operation of Railways and Rail Transport, as amended," are deleted.
2. in Article 6 (a), "trolleybus" is deleted;
3. In Article 7 (b), the words "and trolleybus' are deleted.
4. In Paragraph 11, the following is added at the end of the text of paragraph 2: "; in the case of a proficiency test for the steering of a railway train, an authorised representative of an authorized person may also be chairman of the test committee under the Law on the Recognition of Results of Further Education9) for the professional qualification of Head of Cableway Operation."

5. In Article 14 (6), the words "Sections 1.8.6 and 1.8.7 and paragraph 6.8.2.4.6 'are deleted.
6. In Annex 2, point 2, "12 weeks' is replaced by" 480 hours';
7. In Annex 2, point 2, "1 week 'is replaced by" 40 hours';
8. In Annex 4, point 4.2, "2 weeks' is replaced by" 80 hours';
9. In Annex 4, point 4.3, "4 weeks' is replaced by" 160 hours';
10. In Annex 5, point 4.2, "2 weeks' is replaced by" 80 hours';
11. In Annex 5, point 4.3, "8 weeks' is replaced by" 320 hours';
12. In Annex 7, point 4.2, "15 'is replaced by" 10'.
13. In Annex 8, point 4.2, "4 weeks' is replaced by" 160 hours';
14. In Annex 8, point 4.3, "6 weeks' is replaced by" 240 hours';
Efficacy
This Decree shall take effect on 1 July 2024.
