DECLARATION
of 2 June 2010
on the declaration of the National Natural Monuments of the Cave of the Border and the establishment of its closer protection conditions
The Ministry of the Environment provides pursuant to § 79 (4) (h) of Act No. 114 / 1992 Coll., on the Conservation of Nature and Landscape, as amended by Act No. 218 / 2004 Coll., Act No. 312 / 2008 Coll. and Act No. 349 / 2009 Coll.:
Definition of national natural heritage
(1) The National Natural Monument of the Cave of the Border ("National Natural Monument") is announced.
(2) The national natural monument is situated in the territory of the Olomouc Region, in the cadastral territory of Vápenná and Dolní Lip. The boundaries of the national natural monument shall be determined by a closed geometric pattern with direct sides whose vertices are determined by the coordinates given in the uniform trigonometric network of the cadastral1). The list of coordinates of the closed geometric pattern and its individual vertices arranged as they follow in the pattern is contained in Annex 1 to this decree. An indicative graphic representation of the territory of the national natural monument is contained in Annex 2 to this decree.
Subject matter of protection
National natural monuments are protected by:
a) a complex of caves On the Border with all underground and surface karst phenomena, including the filling of caves and natural communities in caves;
(b) fragments of flowery beech and rubble forests and grassland communities with rare and endangered plant and animal species;
(c) habitat types and species for which another legislation on m2 has been declared) a European-important locality of Rychleb Mountain - Sokolský lobe and situated in the territory of a national natural monument.
Closer protection conditions
Only with the consent of the competent nature conservation authority can the national natural monument
(a) to make changes to the type of land or the way in which it is used (3);
(b) make changes to completed constructions or changes to structures before their completion (4);
(c) to operate for the public the accessible parts of the Cave Na Border, including sales and other related services;
(d) carry out research in caves or research into natural phenomena on the surface that are related to caves that do not cause changes or damage to the national natural heritage;
e) enter the public of inaccessible caves,
(f) to carry out geological work linked to interference with the earth's surface, which will not cause changes or damage to the national natural heritage;
(g) indicate cycling or pedestrian routes; or
(h) feed animals.
Efficacy
This Decree shall take effect on 1 July 2010.
