DECLARATION
of 21 May 2008
amending Decree No. 205 / 1999 Coll., implementing Act No. 168 / 1999 Coll., on insurance of liability for damage caused by the operation of a vehicle and amending certain related laws (Act on insurance of liability from the operation of a vehicle), as amended
The Ministry of Finance provides pursuant to § 6 (5), § 13 (1) (b) and § 15 (1) of Act No. 168 / 1999 Coll., on liability insurance for damage caused by the operation of the vehicle and on the amendment of certain related laws (Act on Insurance of Liability from the operation of the vehicle), as amended by Act No. 137 / 2008 Coll.:
Decree No. 205 / 1999 Coll., implementing Act No. 168 / 1999 Coll., on insurance of liability for damage caused by the operation of a vehicle and amending certain related laws (Act on Insurance of Liability from the operation of a vehicle), as amended by Decree No. 429 / 2002 Coll. and Decree No. 309 / 2004 Coll., are amended as follows:

Scope of liability insurance information communicated by the insurer to the Czech Insurers' Office
The insurer shall communicate to the Czech Insurance Office the following information on the creation, time of interruption, change and termination of liability insurance:
(a) the green card number, the date of its issue, the period of validity;
(b) the name, the name and, where applicable, the name and the name of the owner of the vehicle, the name or business name or the name of the vehicle operator, or the name of the vehicle owner, or the name and address of the owner of the vehicle and, where applicable, the name, surname and address of the policy holder or of the business name and registered office of the policy holder; in the case of a vehicle which is not subject to registration of road vehicles under the law governing the conditions of use of vehicles on the road, only the name and, where applicable, the name, surname and address of the owner of the vehicle or the name and address of the owner of the vehicle and the name and address of the owner of the vehicle and, where applicable, the name, surname and address of the policy holder or the name and address of the policy holder,
(c) the business firm and the head office of the insurer;
(d) the duration of the insurance and the period of interruption of the insurance, if agreed;
(e) the type of vehicle, its factory brand and its type;
(f) the vehicle identification number; If not allocated, the body or chassis number of the vehicle,
(g) vehicle registration or military registration,
(h) the number of the vehicle's technical licence;
(i) the number of the insurance contract. ';
(2) Paragraph 2 shall be deleted, including the title.
3. In Section 3, the words "for damage caused by the operation of the vehicle 'and the word" deceased' are deleted.
4. In Article 3, the following paragraph 1 is inserted:
"(1) The certificate of the duration of the liability insurance and the malfunctioning of the insurance issued during the life of the liability insurance shall include:
(a) the name and, where applicable, the name, surname, birth number or date of birth and residence of a natural person or a commercial firm or the name and registered office of a legal person as a policy holder; if the owner or the vehicle operator is not the same person as the policyholder, the certificate and the particulars of such persons shall be provided, according to the vehicle technical licence;
(b) the business firm and the head office of the insurer;
(c) the registration number or military registration number of the vehicle, the vehicle identification number or, if not allocated, the chassis or bodywork number of the vehicle referred to in the insurance policy;
(d) the number of the insurance contract, the duration of the liability insurance valid on the date of receipt of the application pursuant to Article 13 (1) (b) of the Vehicle Liability Insurance Act, and the total duration of the liability insurance, including the duration of the liability insurance, evidenced on the occurrence of the applicable liability insurance;
(e) information on claims incurred during the period of insurance of liability under the insurance contract referred to in (d), in particular their number, indicating the date of occurrence of the event;
(f) information on claims arising from previous liability insurance, as provided for in earlier certificates on the duration of the insurance, broken down by duration of individual liability insurance, indicating the company of the relevant insurer, in particular their number, and the date of the occurrence of the event;
(g) the date and reason for the termination of the previous liability insurance;
(h) signature, date of issue of the certificate and stamp of the insurer. ';
Article 3 is renumbered paragraph 2.
5. In Article 3 (2), the words "for damage caused by the operation of a vehicle (hereinafter referred to as" liability insurance ") and the harmful course of insurance terminated 'are replaced by the words" and the harmful course of insurance after the loss of liability insurance'.
6. in Article 3 (2) (a), the words "place of permanent or long-term residence" shall be replaced by the words "residence" and "holder" shall be deleted;
7. in Paragraph 3 (2) (b), the word "name" is replaced by "company."
8. in Article 3 (2) (c):
"(c) the registration number or the military registration number of the vehicle, the vehicle identification number or, if not assigned, the chassis or bodywork number of the vehicle referred to in the insurance policy;"
9. in Article 3 (2) (h), the word "stamp" shall be replaced by "stamp imprint."
10. in Article 4, the words "Bulgaria, 'and" Romania' are deleted and the words "Serbia and Montenegro 'are replaced by the words" Serbia and Montenegro';
11. Annex No 1 shall be deleted;
This Decree shall take effect on 1 June 2008.
