DECLARATION
of 4 May 2005
amending Decree No 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended by Decree No 83 / 2000 Coll.
The Ministry of Transport provides pursuant to Section 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll. and Act No. 118 / 2004 Coll., hereinafter referred to as "the Act ':
Čl. I
Decree No 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended by Decree No 83 / 2000 Coll., is amended as follows:
1. Paragraph 1, including footnote 1, reads as follows:
„§ 1
This decree implements the relevant provisions of the European Community1).
1) Council Directive 82 / 714 / EEC of 4 October 1982 laying down technical requirements for inland waterway vessels (Article 4), Directive 94 / 25 / EC of the European Parliament and of the Council of 16 June 1994 on the approximation of the laws, regulations and administrative provisions of the Member States relating to recreational craft (Article 4). "
2. The following Section 1a is inserted after Section 1:
„§ 1a
Waterways sailing zones
(1) For the purposes of this decree, waterways shall be divided into navigation zones:
(a) zone 1 - with a wave incidence of up to 2,0 m high,
(b) zone 2 - with a wave range of up to 1,2 m;
(c) zone 3 - with waves up to 0,6 m high,
(d) zone 4 - with waves up to 0,3 m high
(2) The sailing zones of the monitored waterways of the Czech Republic are listed in Annex 1. '
3. In Section 3, the words "and shall be made as unsinkable in accordance with Annex 3, point 2.02.1 'shall be added at the end of paragraph 3.
4. In Article 4 (1), the dot after point (c) is replaced by a comma and the following points (d) and (e) are added:
"(d) vessels whose fitness to operate on a waterway is confirmed by a valid ship certificate issued in accordance with Article 22 of the Revised Convention for the Navigation of the Rhine (2) on the basis of a technical inspection of the vessel, if the certificate is renewed,
(e) ferry ships with a maximum occupancy of 12 persons exclusively operating on waterways of transport significant usable, special purpose waterways and other waterways.
2) Article 4 of Council Directive 82 / 714 / EEC of 4 October 1982 laying down technical requirements for inland waterway vessels. '
Footnotes 1 to 4 to date shall be renumbered as footnotes 3 to 6, including references to those notes.
5. In Section 7 (1) of the Introductory Part of the provision, the words "for the purpose of the certificate of competence of a vessel to operate on a waterway 'are inserted after the words" on a waterway'.
6. In Article 7, at the end of paragraph 2, the words "or the validity of a vessel's certificate issued pursuant to Article 22 of the Revised Convention for the Navigation of the Rhine 'shall be added.
7. In Article 7 (3), the words "or the presentation of a valid vessel certificate issued pursuant to Article 22 of the Revised Convention for the Navigation of the Rhine 'shall be inserted after the words" classification surveys'.
8. In Annex 3 to Article 1.01, the following paragraphs 1.01.4. and 1.01.5. are added:
"1.01.4. Where a small vessel, which is a recreational vessel under a special legislation7), bears the CE marking and the manufacturer, its authorised representative or importer has applied the relevant conformity assessment procedures to the technical requirements for that vessel and has issued an EC declaration of conformity under European Community law (7), (8), it shall at the time of placing on the market comply with the technical conditions of eligibility of small vessels under this Annex, except Articles 1.03.2, 5.02.3, 5.03, 5.05.4, 5.05.5, 5.06.3, 5.06.4 and 6.01 to 6.04.
1.01.5. If a small craft, which is a jet ski under a special legislation (7), bears the CE marking and the manufacturer, its authorised representative or importer has applied the appropriate conformity assessment procedures to the technical requirements for that vessel and has issued an EC declaration of conformity under European Community law (7), (8), it shall at the time of placing on the market comply with the technical conditions for the competence of small vessels under this Annex.
7) Government Decree No. 174 / 2005 Coll., laying down technical requirements for recreational craft, semi-manufactured recreational craft and their selected parts, for water scooters and propulsion engines for recreational craft and water scooters.
8) Directive 94 / 25 / EC of the European Parliament and of the Council of 16 June 1994 on the approximation of the laws, regulations and administrative provisions of the Member States relating to recreational craft. Directive 2003 / 44 / EC of the European Parliament and of the Council of 16 June 2003 amending Directive 94 / 25 / EC on the approximation of the laws, regulations and administrative provisions of the Member States relating to recreational craft. ';

This decree shall take effect on the day of its publication.
