DECLARATION
of 9 June 2003
amending Decree No. 38 / 2001 Coll., laying down health requirements for food contact products and foodstuffs
According to Article 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws (hereinafter "the Act '), the Ministry of Health provides for the implementation of § 26 (1) (b) and (d) and paragraphs 2 and 3 of the Act:
Decree No. 38 / 2001 Coll., on sanitary requirements for products intended to come into contact with food and dishes, is amended as follows:
1. In Section 2, point 5, the words "and liquid food consistency 'shall be inserted after the words" drinks'.
2. in Article 2, point 19 is deleted;
Points 20 to 29 shall be renumbered 19 to 28.
3. the following points 29 to 31 are inserted after point 28 in Section 2:
"29. plastics, organic macromolecular compounds, obtained by polymerisation, polycondensation, polyation or other similar processes from molecules with lower molecular weight or chemical transformation of natural macromolecules. Additional substances or materials listed in Annex 3 to this Decree may be added to these macromolecular compounds under the terms of this Decree,
30. An addition of a polymer to a substance that is physically dispersed in polymers without significantly affecting the structure of the polymer and is added for reasons of influence on the processing properties or for the purpose of modifying the performance of the polymer,
31. good manufacturing practice, an established and maintained set of measures which guarantees the management of production processes and reproducible quality of products with the required characteristics. ';
4. In Article 3 (1), the words "in accordance with the principles of good manufacturing practice 'shall be inserted after the words" manufactured'.
5. In Paragraph 3 (1), a comma is inserted after the word "health 'and the words" or cause an unacceptable change in the composition of foodstuffs or affect the organoleptic properties of foodstuffs' are replaced by the words "cause an unacceptable change in the composition of foodstuffs and affect the organoleptic properties of foodstuffs'.
6. In Article 3, paragraphs 6 and 7 are added after paragraph 5:
"(6) Plastic materials and articles, varnishes, coatings and surface-treated products as well as adhesives containing or made from one or more of the following substances:
(a) 2,2bis [4- (2,3-epoxypropoxy) phenyl] propane and certain derivatives thereof,
b) bis (2,3-epoxypropyl) ether and certain derivatives thereof,
c. Neolac-glycidyl ethers and certain derivatives thereof
comply with the hygiene requirements of Annex 15 to this Decree.
(7) The requirements referred to in paragraph 6 shall not apply to containers and storage tanks of a capacity exceeding 10 000 litres, and to their pipelines and piping connected thereto, which are treated with high load (heavy duty) coating. ';
7. in Paragraph 8 (3) (a), the word "or" shall be deleted at the end of point 1.

Forms of the proposal to initiate the admissibility procedure of the substance
The application to initiate the procedure provided for in Article 26 (3) of the Act must contain:
(a) the chemical name of the proposed substance, its synonyms, trade name, CAS number, chemical composition, structural formula and purity data of the proposed substance;
(b) data on the concentration of the proposed substance in the material or product and justification for the technical necessity of its use;
(c) data on breakdown products resulting from the proposed substance in the manufacture, processing, or, where appropriate, ageing of material or arising as products of interaction in these processes;
(d) an indication of the intended use and the characteristics of the product produced using the proposed substance;
(e) toxicity data for the proposed substance,
(f) data on the specific migration of the proposed substance from the product, indicating the composition of the test product as well as the conditions of testing for the intended use;
(g) the method for the determination of the proposed substance and, where appropriate, the method for the determination of its impurities, the products of interaction and breakdown;
(h) available foreign documentation as to whether the proposed substance has been authorised in other States, if any. ';
9. Paragraph 10 (1) is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
10. in Paragraph 10 (1), the dot is replaced by a comma at the end of point (e) and the following point (f) is added:
"(f) silicones."
11. In Section 11, the words "and specifications' are added at the end of the text.
12. In Paragraph 11, the current text becomes paragraph 1 and the following paragraphs 2 and 3 are added:
"(2) The general specifications concerning plastic products and their materials are set out in Appendix II, Part A of Annex 3. Further specifications concerning certain substances included in the positive lists of Annex 3 are set out in Appendix II, Part B to this Annex.
(3) The lists of substances in Annex 3 do not include monomers and other starting substances used only for the manufacture of:
(a) surface treatment of resins or polymers in liquid, powder or dispersed form, such as varnishes, paints and paints;
(b) epoxy resins,
(c) adhesives and coatings improving adhesion,
(d) printing ink. ';
13. In Paragraph 13, paragraphs 8 and 9 are added after paragraph 7:
"(8) Verification of compliance with the specific migration limits may be carried out by establishing the quantity of the substance in the final material or product, provided that the relationship between that quantity and the value of the specific migration of the substance has been established by sufficient experiments or using generally accepted diffusion models based on scientific evidence. To demonstrate non-conformity of the material or product, confirmation of the determined migration value by experimental testing is required.
(9) For the substances listed in Annex 3 to this Decree, Chapter Incomplete list of additives which may be used for the production of plastics, Section B shall apply specific migration limits from 1 January 2004 if the verification of conformity is carried out using simulant D or using substitute fat simulants in accordance with Annex 4 to this Decree. ';
14. In Paragraph 20 (5), the words "approved types of polypropylene oil 'are replaced by" polypropylene oil'.
15. in Article 21 (3), the word 'food' is replaced by 'food';
16. in Article 23 (5) (b), the word "z" shall be inserted after the word "casings."
17. Annex 3 shall read as follows:

Requirements for plastics and plastic products
LIST OF MONOMERES, ACCESSORIES AND OTHER EAST SUBSTANCES WHICH MAY BE USED FOR THE PRODUCTION OF PLASTIC PRODUCTS
1. This Annex lists monomers, additives and other starting substances which may be used for the manufacture of plastics and plastic products intended to come into contact with food.
The list includes:
- a starting substance for polymerisation, which includes polycondensation, polyation or any other similar macromolecule formation process,
- natural or synthetic macromolecular substances used for the manufacture of modified macromolecules, where monomers or other starting substances necessary for their manufacture are not included in the list,
- substances used to modify existing natural or synthetic macromolecular substances,
- substances which are added to plastics to achieve a technical effect on the finished product and are intended to be contained in finished products,
- substances used to create an environment in which polymerisation occurs (e.g. emulsifiers, surfactants, dampening solutions, etc.).
2. The list does not include aluminium, calcium, iron, magnesium, potassium, sodium, zinc and ammonium salts (including double salts and acid salts) of authorised acids, phenols or alcohols, although they are also authorised. The name "salt 'is included in the list only if the corresponding free acid (free acids) is not listed (not listed). In such cases," salts "means salts of" aluminium, calcium, iron, magnesium, potassium, sodium, zinc and ammonium salts. "
3. The following substances are not included in the list, although they may be present:
(a) substances which may be present in the final product:
- impurities in the substances used,
- reaction intermediates,
- degradation products,
(b) oligomers and natural or synthetic macromolecular substances and mixtures thereof, where monomers or starting substances necessary for their synthesis are included in the list;
(c) mixtures of authorised substances,
(d) substances directly affecting polymer production (e.g. catalytic systems).
Products containing the substances referred to in points (a), (b) and (c) shall comply with the requirements laid down in Paragraph 3 (1) of this Decree.
4. Substances shall be of good technical quality as regards purity criteria.
5. Only products obtained by bacterial fermentation in accordance with Appendix I to this Annex may be used for contact with food.
6. The list shall contain the following information:
- column 1 (Ref. No): EEC reference number of packaging material for the substance in the list,
- column 2 (CAS No): CAS Registration Number (Chemical Abstracts Service),
- column 3 (Name): chemical name,
- column 4 (Restrictions and / or specifications) shall contain:
- specific migration limit (SML),
- the maximum authorised quantity of the substance in the final material or product (QM),
- the maximum authorised quantity of the substance in the final material or product, expressed in mg per 6 dm2 of food contact area (QMA),
- any other restriction specifically mentioned,
- all specifications concerning the substance or polymer.
7. Where a substance listed individually also belongs to a general group, the restrictions on that group shall apply to that substance individually.
8. If the CAS number does not correspond to the chemical name, the chemical name shall prevail over the CAS number. If the CAS number according to the EINECS registry does not correspond to the CAS number according to the CAS registry, the CAS applies according to the CAS registry.
9. In the tables in column 4, abbreviations and expressions are used which have the following meanings:
DL = limit of detection of analytical method,
FP = final material or product,
NCO = isocyanates,
ND = must not be detected. For the purposes of this decree, the substance must not be detected by a validated analytical method with a specified detection limit (DL). In the absence of such a method, pending the production of the validated method in accordance with Article 4 (1) of the Decree,
QM = maximum permissible amount of "residual 'substance in the material or product,
QM (T) = maximum permissible amount of "residual 'substance in the material or product expressed as total content of the scheduled substance or group of substances. For the purposes of this Decree, the quantity of the substance in the material or product shall be determined by a validated analytical method. In the absence of such a method, pending the production of the validated method in accordance with Article 4 (1) of the Decree,
QMA = maximum permissible quantity of "residual 'substances in the material or product, expressed in mg per 6 dm2 of food contact area,
QMA (T) = maximum permissible amount of "residual substances' in the material or product expressed as the total content of the scheduled substance or group of substances in mg per 6 dm2 of food contact area. For the purposes of this Decree, the quantity of the substance in the material or product shall be determined by a validated analytical method. In the absence of such a method, pending the production of the validated method in accordance with Article 4 (1) of the Decree,
SML = specific migration limit in food or food simulant, unless otherwise specified. For the purposes of this Decree, the specific migration value of a substance from a material or product shall be determined by a validated analytical method. In the absence of such a method, pending the production of the validated method in accordance with Article 4 (1) of the Decree,
SML (T) = specific migration limit in food or food simulant expressed as total content of the scheduled substance or group of substances. For the purposes of this Decree, the quantity of substance or group of substances in the material or product shall be determined by an established analytical method. In the absence of such a method, until the certified method has been established in accordance with Article 4 (1) of the Decree.
