Regulation on the interim training of apprentices

of 7 July 1949
on the interim training of apprentices.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42, paragraph 1 of the Act of 27 October 1948, No 241 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
(1) The training of apprentices is the continuous preparation of workers for vocational work in teaching fields (paragraph 2).
(4) The training of apprentices may be carried out by any enterprise (entrepreneur), institute and operator of another establishment where the conditions for successful training in the field of instruction are met (paragraph 5). However, the Institute and the operator of another establishment also need permission from the Regional National Committee to train apprentices. This authorisation is not required by the institutes and operators of other establishments carrying out apprenticeship training under existing regulations or administrative decisions.
(5) The training of apprentices in the fields of learning declared in accordance with paragraph 2 shall be subject, unless otherwise provided for in this Regulation, to the existing rules on apprenticeship training, mutatis mutandis, in respect of undertakings, establishments, institutes and other establishments not subject to a trade order or trade law.
§ 2.
(1) The Czechoslovak Institute of Labour will draw up descriptions of teaching fields and syllabus of training approved by the Ministry of Labour and Social Welfare in agreement with the participating Ministry after hearing the Unified Trade Union Organisation. A description of the curriculum and syllabus of training, the approval of which has been published by the Ministry of Labour and Social Welfare in the Official Journal, is mandatory for apprenticeship training.
(2) The Regional National Committee shall supervise the training of apprentices.
§ 3.
(1) The apprentices are subject to the apprenticeship test at the end of the apprenticeship period. The management of these tests belongs to the Regional National Committee.
(2) An apprentice who has successfully passed the apprenticeship exam shall issue a certificate of instruction to the Regional National Committee after the end of the teaching period.
§ 4.
(1) In cases of special consideration, the Regional National Committee may allow the apprenticeship examination to be carried out before the end of the teaching period, but not before the end of half of the prescribed teaching period (§ 1 (3)).
(2) If the apprentice successfully performs the apprenticeship examination referred to in paragraph 1, the remainder of the teaching period shall be forgiven; The regional national committee shall issue him a certificate of instruction.
§ 5.
(1) However, in cases of special consideration, the Regional National Committee may also authorise apprenticeship examinations from a particular field of study to be carried out by persons over 21 years of age who have not undergone vocational training in the course of the course, but have been employed for at least twice as long as the teaching period laid down in Section 1 (3) of that field.
(2) Where new teaching fields declared to be effective in this Regulation are concerned and if the conditions set out in paragraph 1 are otherwise fulfilled, the Regional National Committee may exceptionally authorise the apprenticeship examination to be carried out after a period of less than that referred to in paragraph 1, but not less than the period corresponding to the prescribed teaching period (§ 1 (3)).
(3) To the persons referred to in paragraphs 1 and 2 who have successfully passed the apprenticeship examination, the Regional National Committee shall issue a teaching certificate.
§ 6.
The Ministry of Labour and Social Welfare shall, in agreement with the participating Ministry and the Ministry of Education, Science and Arts, after hearing the Unified Trade Union Organisation in the Official Journal, publish regulations on apprenticeship examinations (§ 3), in particular on the conditions under which an apprenticeship examination may be granted before the end of the teaching period (§ 4) and on persons who have failed to submit to vocational training in the classroom (§ 5).
§ 7.
The competence which falls within the competence of the Regional National Committee under this Regulation, the regulations issued under it or other rules on apprenticeship training, shall be exercised by the second stools of the mining apprentices.
§ 8.
Proceedings and omissions transposing the provisions of § 2, sentence 2 or § 135, paragraph 1 or 2, § 137 or 140 of the Trade Code shall be punishable, if not by a criminal offence, by the District National Committee as a penalty of up to 10.000 CZK or by a prison (lock-up) within 1 month or both. In the event of non-availability of the fine, the replacement prison sentence (lockdown) shall be calculated according to the rate of guilt within 1 month. If both types of punishment are imposed at the same time, the sentence on the free side, together with the replacement penalty, must not exceed 1 month for an impenetrable cash penalty.
§ 9.
(1) Any provisions contrary to this Regulation and those adopted pursuant to it are hereby repealed, where applicable.
(2) In particular, the validity, where applicable:
(a) Articles 15, 6, 17, 2, 136, 1 and 2, 147, 2 and 3, 148 to 151, 160, 3, (b) and (c), 195, 1, (f) and 211, 2, k) of the Commercial Act;
(b) § 1, § 1, § 5, § 6, § 1, § 7, § 1 to 4, § 8, § 9, § 1, § 11 and 12, § 15 to 17, § 19 and § 20, § 3 of the Decree of 3 July 1943, No 200 Coll., on the modification of professional training.
(3) Until the provisions laid down in Sections 1, 2 and 3 and in Section 6 are laid down, the training of apprentices shall be carried out in accordance with the existing rules on matters to be regulated.
§ 10.
This Regulation shall enter into force on 1 July 1949 and shall expire on 31 December 1953; they shall be carried out by the Minister for Labour and Social Welfare in agreement with the Ministers involved.
