amending Government Regulation No 73 / 2023 Coll., laying down rules on cross-compliance of payments to farmers, as amended by Government Regulation No 62 / 2024 Coll., and certain other related government regulations
The Government orders pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll., Act No. 179 / 2014 Coll. and Act No. 382 / 2022 Coll., and § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation on the establishment of cross-compliance rules for payments to farmers
Government Regulation No 73 / 2023 Coll., on the establishment of cross-compliance rules for payments to farmers, as amended by Government Regulation No 62 / 2024 Coll., is amended as follows:
1. in Paragraph 2 (2) (b), "4" is replaced by "2."
2. Paragraph 8 (1) to (3) reads as follows:
"(1) The applicant shall ensure that there is no continuous area on the soil block used by him with agricultural culture.
(a) maize, potatoes, sugar beet, field bean, soya, sunflower or sorghum with
1. between 2.01 and 4 hectares, which contains a continuous area of strongly eroded land greater than 2 hectares; and
2. more than 4 hectares containing a continuous area of strongly eroded land greater than 2 hectares or the area of which is more than 50% covered by strongly eroded land;
(b) rape or colza, with the exception of maize and sorghum, grown without application of the corresponding soil protection technology referred to in Annex 1 to this Regulation with a size of
1. between 2.01 and 4 hectares, which contains a continuous area of strongly eroded land greater than 2 hectares; and
2. more than 4 hectares containing a continuous area of strongly eroded land greater than 2 hectares or the area of which is more than 50% covered by strongly eroded land;
(c) maize, potatoes, sugar beet, field bean, soya bean, sunflower or sorghum grown without application of the corresponding soil protection technology referred to in Annex 3 to this Regulation for these crops of the size of:
1. between 2,01 and 4 hectares containing a continuous area of erosion-vulnerable land greater than 2 hectares not referred to in point (a) (1); and
2. more than 4 hectares containing a continuous area of erosion at risk of more than 2 hectares or the area of which is more than 50% covered by erosion at risk by soil not referred to in point (a) (2), the applicant may not comply with this condition on a part of a soil block of more than 4 hectares, which does not contain a continuous area of erosion at risk of more than 2 hectares, or whose area is not covered by erosion at risk not referred to in point (a) (2).
(2) The applicant may not comply with the condition set out in paragraph 1 (a) (2) and paragraph 1 (b). (b) point 2 of the part of the soil block of more than 4 hectares which does not contain a continuous area of strongly eroded land greater than 2 hectares or whose area is not more than 50% covered by strongly eroded land.
(3) For protective belt protection technologies according to:
(a) in the case of paragraph 1 (b) of Annex 1 to this Regulation, the crops listed in Annex 2 to this Regulation shall be used; and
(b) Annex 3 to this Regulation shall apply, in the case of paragraph 1 (c), to the crops listed in Annex 4 to this Regulation. ';
3. Paragraph 8 (1) to (3) reads as follows:
"(1) The applicant shall ensure that standard arable land determined as:
(a) strongly eroded cereals, with the exception of maize and sorghum, or rape (hereinafter referred to as "crop with a medium conservation effect of vegetation"), shall be grown on a continuous surface of more than 2 hectares using the appropriate soil protection technology referred to in Annex 1 to this Regulation only; and
(b) a slightly eroded, at higher risk as set out in Annex 16 to this Regulation, growing a winter crop with a medium degree of protection for vegetation on a continuous surface of more than 2 hectares using only the appropriate soil protection technology listed in Annex 3 to this Regulation.
(2) The continuous area of the crop shall be considered to be the area sown by crops having a level of protection equal to or lower than the level of protection which is separated from another continuous area sown by crops with the same or lower level of protection at least 6 metres, which is not a landscape element at the same time.
(3) For soil protection technology
(a) No 1 as referred to in Annex 1 to this Regulation and Soil Protection Technology Nos 2 and 5 to 8 as referred to in Annex 3 to this Regulation, the crops referred to in Annex 2 to this Regulation shall be used;
(b) No 4 as set out in Annex 1 to this Regulation and Soil Protection Technology No 4 as set out in Annex 3 to this Regulation, the crops referred to in Annexes 11 and 12 to this Regulation shall be used,
(c) No 8 as referred to in Annex 1 to this Regulation and Soil Protection Technology No 12 as referred to in Annex 3 to this Regulation shall apply the crops referred to in Annex 5 to this Regulation, with the exception of beans and soya; and
(d) No 7 as provided for in Annex 1 to this Regulation shall apply the crops referred to in Annex 5 to this Regulation, with the exception of beans and soya, or the crops referred to in Annexes 11 and 12 to this Regulation. "
4. Paragraph 8 (1) to (3) reads as follows:
"(1) The applicant shall ensure that standard arable land specified as:
(a) strongly eroded in accordance with Annex 16 to this Regulation;
1. does not grow sorghum, potatoes, maize, beet, sunflower or soya (hereinafter referred to as "crop with a low degree of protection of vegetation") on a continuous surface of more than 2 hectares; and
2. Cultures beans, cereals, with the exception of maize and sorghum, or rape (hereinafter referred to as "crop with a medium degree of protection for vegetation") on a continuous surface of more than 2 hectares using only the corresponding soil protection technology listed in Annex 1 to this Regulation,
(b) slightly eroded at higher risk as set out in Annex 16 to this Regulation;
1. Cultures a crop with a low degree of protection of vegetation on a continuous surface of more than 2 hectares only using the appropriate soil protection technology set out in Annex 17 to this Regulation; and
2. Cultures a crop with a medium degree of protection for vegetation on a continuous surface of more than 2 hectares only using the corresponding soil protection technology referred to in Annex 3 to this Regulation; and
(c) slightly eroded, with a lower risk as set out in Annex 16 to this Regulation, it shall only grow a crop with a low degree of protection of vegetation on a continuous surface of more than 2 hectares using the appropriate soil protection technology set out in Annex 18 to this Regulation.
(2) The continuous area of the crop shall be considered to be the area sown by crops having a uniform or lower level of protection which is separated from another continuous area sown by crops with the same or lower level of protection at least 12 metres, which is not a landscape element at the same time.
(3) For soil protection technology
(a) No 1 under Annex 1 to this Regulation, Soil Protection Technology Nos 2 and 5 to 8 under Annex 3 to this Regulation, Soil Protection Technology Nos 1 to 3 under Annex 17 to this Regulation and Soil Protection Technology Nos 1 to 3 under Annex 18 to this Regulation shall apply the crops listed in Annex 2 to this Regulation;
(b) No 4 as set out in Annex 1 to this Regulation and Soil Protection Technology No 4 as set out in Annex 3 to this Regulation, the crops referred to in Annexes 11 and 12 to this Regulation shall be used,
(c) No 8 under Annex 1 to this Regulation, Soil Protection Technology No 12 under Annex 3 to this Regulation, Soil Protection Technology No 7 under Annex 17 to this Regulation and Soil Protection Technology No 8 under Annex 18 to this Regulation, the crops referred to in Annex 5 to this Regulation shall be used, with the exception of beans and soya; and
(d) No 7 as set out in Annex 1 to this Regulation and Soil Protection Technology No 6 as set out in Annex 17 to this Regulation shall apply the crops listed in Annex 5 to this Regulation, with the exception of beans and soya, or the crops listed in Annexes 11 and 12 to this Regulation. "
5. In Article 9 (5), the words "on which ocopannins, root or tuber vegetables are grown on heavy clay soils with the characteristics of the main soil unit 06 or 07 according to Decree No. 227 / 2018 Coll., on the characteristics of the soil units and the procedure for their management and updating 'are deleted.
6. In Article 11 (3) (b), the words "or areas of another crop 'shall be inserted after the word" belt'.
7. Paragraph 12 (1) and (2) are deleted.
Paragraphs 3 to 11 shall be renumbered paragraphs 1 to 9.
8. Paragraph 12 (8) is deleted.
Paragraph 9 shall become paragraph 8.
9. Annex 1 shall read as follows:

Za zlepšující plodinu se považuje travní porost a plodiny podle přílohy č. 5 k tomuto nařízení, s výjimkou bobu a sóji, a jejich směsi nebo jejich využití v podsevu podle příloh č. 11 a 12 k tomuto nařízení. |
Transitional provisions
1. Legal relationships arising under Government Decree No. 73 / 2023 Coll., as effective before 1 July 2024, shall be assessed under Government Decree No. 73 / 2023 Coll., as effective before 1 July 2024, with the exception of the provisions of § 12 of Government Decree No. 73 / 2023 Coll., which shall apply as effective from 1 July 2024.
2. The procedure for applications making use of the conditions laid down in Government Decree No. 73 / 2023 Coll., as effective before 1 July 2024, shall be completed in accordance with Government Decree No. 73 / 2023 Coll., as effective before 1 July 2024, with the exception of the provisions of Section 11 (3) (b) of Government Decree No. 73 / 2023 Coll., which shall apply as from 1 July 2024.
Amendment of the Government Regulation on the conditions for the implementation of agri-environmental climate measures
Government Decree No 80 / 2023 Coll., laying down the conditions for the implementation of agri-environmental climate measures, as amended by Government Decree No 61 / 2024 Coll., is amended as follows:
1. Paragraph 26 (9) is deleted.
Paragraphs 10 to 31 shall be renumbered paragraphs 9 to 30.
2. Paragraph 26 (10) is deleted.
Paragraphs 11 to 30 shall become paragraphs 10 to 29.
3. Paragraph 26 (13) is deleted.
Paragraphs 14 to 29 shall be renumbered paragraphs 13 to 28.
4. Paragraph 26 (14) is deleted.
Paragraphs 15 to 28 shall be renumbered paragraphs 14 to 27.
5. In Paragraph 26 (24), "27 'is replaced by" 23'.
6. In Annexes 13 and 14, Part A., the words "25% 'shall be inserted after the words" subsidy'.
7. In Annexes 13 and 14 to Part B, the words "no subsidy shall be granted 'are replaced by the words" reduced subsidy'.
8. In Annex No 13, Part C., the words "exclusion from sub-measures' are replaced by the words" no subsidy will be granted '.
9. In Annex No 14, Part C, the words "the exclusion of integrated vegetable production, the integrated production of multi-annual crops, the integrated potato production or the integrated production of strawberry according to § 24 shall be replaced by" no subsidy shall be granted. "
Transitional provisions
1. Applications for 2023 initiated pursuant to Government Regulation No 80 / 2023 Coll., as effective before 1 July 2024, shall be completed in accordance with Government Regulation No 80 / 2023 Coll., as effective before 1 July 2024.
2. Applications for 2024 initiated pursuant to Government Decree No. 80 / 2023 Coll., as effective before 1 July 2024, shall be completed in accordance with Government Decree No. 80 / 2023 Coll., as effective from 1 July 2024.
3. For the purposes of the procedure for the application for subsidy lodged in 2024 pursuant to Government Regulation No 80 / 2023 Coll., as amended by Regulation No 83 / 2023 Coll., as amended, the sown area of the intercrop, biostrip, the nesting area of the squid or of the species rich in arable land covered by the application for direct payment pursuant to Article 5 (c) of the Government Regulation No 83 / 2023 Coll., as amended, is referred to as the non-production area referred to in Article 12 (1) of the Government Regulation No 73 / 2023 Coll., as effective before 1 July 2024, as the non-production area referred to in paragraphs 83 / 2023 Coll., as from 1 July 2024.
Amendment of the Government Regulation on the conditions for granting direct payments to farmers
Government Decree No. 83 / 2023 Coll., establishing the conditions for granting direct payments to farmers, as amended by Government Decree No. 68 / 2024 Coll., is amended as follows:
1. in Article 13 (1) (a), the words "or 11" shall be inserted after the words "10."
2. In Articles 23 (3) and 24 (9), the words "the agricultural land to be classified by the applicant 'are replaced by the words" the parts of the soil blocks to be classified by the applicant'.
3. In Annex No 20 to Explanatory Note 7:
"7) The average annual nitrogen intake by symbiotic fixation of the air nitrogen for crops bound by air nitrogen referred to in Annex 7 to this Regulation grown as the main crop at 180 kg N / ha of clover or lucerne, 120 kg N / ha of peas, beans and soya grown for seed or 80 kg N / ha of other crops bound by air nitrogen or mixtures of crops bound by air nitrogen with other crops. '
Amendment of the Government Regulation on the conditions for the implementation of agroforestry measures
Government Decree No. 140 / 2023 Coll., laying down the conditions for the implementation of agroforestry measures, as amended by Government Decree No. 44 / 2024 Coll., is amended as follows:
1. In Article 6 (2), the words "on the soil block with a type of agricultural culture of permanent grassland 'are deleted.
2. in Articles 6 (3) (d) and 10 (5), the words "with a type of agricultural culture permanent grassland" shall be deleted;
3. In Paragraph 7 (4), the words "with the marking of the protective strips of timber 'are deleted.
4. In Article 7 (5) (c), "or (j) 'is replaced by", (j) or (k)';
Transitional provision
Applications initiated under Government Regulation No. 140 / 2023 Coll., as effective before 1 July 2024, shall be completed under Government Regulation No. 140 / 2023 Coll., as effective before 1 July 2024.
EFFECTIVE
This Regulation shall be binding in its entirety and directly applicable in all Member States.
(a) point 19, which shall take effect on 1 January 2025;
(b) points 3, 10, 12 and 20, which shall take effect on 1 July 2025; and
(c) points 4 and 22, which shall become effective on 1 January 2026.
