DECLARATION
of 16 August 2018
amending the Decree implementing electoral laws
The Ministry of the Interior provides in the agreement with the Ministry of Labour and Social Affairs and the Ministry of Finance pursuant to § 92 (1) (d) of Act No. 247 / 1995 Coll., on the elections to Parliament of the Czech Republic and on the amendment and amendment of certain other laws, as amended by Act No. 204 / 2000 Coll., as amended by Act No. 320 / 2009 Coll., on the Agreement with the Ministry of Labour and Social Affairs and the Ministry of Finance pursuant to § 74 (a) of Act No. 491 / 2001 Coll., on the elections to the Councils of the Communities and on the amendment of certain laws, as amended by Act No. 320 / 2009 Coll., in the Agreement with the Ministry of Labour and Social Affairs and the Ministry of Finance pursuant to § 70 (d) of Act No. 62 / 2003 Coll.
Amendment to Decree No 152 / 2000 Coll.
The Decree of the Ministry of Interior No 152 / 2000 Coll., on the implementation of certain provisions of Act No. 130 / 2000 Coll., on Regional Councils and on the amendment of certain laws, as amended by Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll., Decree No. 442 / 2009 Coll., Decree No. 233 / 2012 Coll., Decree No. 452 / 2013 Coll., Decree No. 91 / 2017 Coll., and Decree No. 475 / 2017 Coll., is amended as follows:
1. Paragraph 17 (1) and (2), including footnote 25, read:
"(1) The President of the District Electoral Commission is responsible for the performance of the special remuneration of 20) (hereinafter referred to as" remuneration ") of CZK 2,200, the Vice-President and the minutes of the District Electoral Commission of CZK 2,100 and the other members of the District Electoral Commission of CZK 1,800. If the vote is repeated, the reward will increase by 400 CZK.
(2) If elections are held for regional councils in the run-up to other election21), the remuneration of a member of the District Electoral Commission pursuant to paragraph 1 is increased by 400 CZK for each subsequent election. If the second round is held in the elections, the remuneration for the next round of elections to the Senate of the Parliament of the Czech Republic or the election of the President of the Republic under the special legislature25 will be increased.
25) Paragraph 12 (2) of Decree No 233 / 2000 Coll. § 6 (1) of Decree No 294 / 2012 Coll., on the implementation of certain provisions of the Act on the Election of the President of the Republic, as amended. '
2. In the second sentence of Article 17 (4), the words "the President or 'shall be deleted after the words" as referred to in paragraph 1' shall be replaced by the words "and 2 'and the words" their' shall be replaced by the words "his'.
Amendment to Decree No 233 / 2000 Coll.
Decree No. 233 / 2000 Coll., on the implementation of certain provisions of Act No. 247 / 1995 Coll., on the Election to Parliament of the Czech Republic and on the amendment and addition of certain other laws, as amended by Act No. 212 / 1996 Coll., the finding of the Constitutional Court published under No. 243 / 1999 Coll. and Act No. 204 / 2000 Coll., as amended by Decree No. 80 / 2002 Coll., Decree No. 188 / 2002 Coll., Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll., Decree No. 321 / 2009 Coll., Decree No. 442 / 2009 Coll., Decree No. 452 / 2013 Coll., Decree No. 91 / 2017 Coll., and Decree No. 475 / 2017 Coll., is amended as follows:
1. Paragraph 12 (1) to (3), including footnote 27, reads:
"(1) In the elections to the Chamber of Deputies of the Parliament of the Czech Republic, the President of the District Electoral Commission and the Special District Electoral Commission are responsible for the performance of the special remuneration of 22) (hereinafter referred to as" the remuneration ') of CZK 2,200, CZK 1,800, CZK 2,100 and CZK 1,800 respectively.
(2) In the elections to the Senate of the Parliament of the Czech Republic, the President of the District Electoral Commission shall be remunerated at CZK 2,200, the Vice-President and the minutes of the District Electoral Commission shall be remunerated at CZK 2,100 and the other members of the District Electoral Commission shall be remunerated at CZK 1,800 if the elections to the Senate of the Parliament of the Czech Republic were held in one round. For the next round of elections to the Senate of the Parliament of the Czech Republic, the remuneration according to the first sentence is increased by CZK 1 000 to the President, Vice-President and minutes of the District Electoral Commission and other members of the District Electoral Commission by CZK 700. If the vote is repeated, the reward will increase by another 400 CZK.
(3) If elections to the Chamber of Deputies of the Parliament of the Czech Republic or elections to the Senate of the Parliament of the Czech Republic are held in conjunction with other election23), the remuneration of a member of the District Electoral Commission and a member of a special District Electoral Commission pursuant to paragraphs 1 and 2 is increased by 400 CZK for each subsequent election. If the second round of the election of the President of the Republic is held in parallel, the remuneration for the next round of the election of the President of the Republic shall also be increased by the amount of the remuneration for the next round of the election of the President of the Republic under the special legislature27).

2. In Article 12 (5) and (6), the words "the President and 'and the words" the President or' shall be deleted and the words "their 'shall be replaced by the words" his'.
Amendment of Decree No 59 / 2002 Coll.
The Decree of the Ministry of Interior No. 59 / 2002 Coll., on the implementation of certain provisions of Act No. 491 / 2001 Coll., on the elections to municipal councils and on the amendment of certain laws, as amended by Decree No. 401 / 2002 Coll., Decree No. 565 / 2002 Coll., Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll., Decree No. 442 / 2009 Coll., Decree No. 452 / 2013 Coll., Decree No. 91 / 2017 Coll., and Decree No. 475 / 2017 Coll., are amended as follows:
1. Paragraph 1 (1) reads as follows:
"(1) The President of the District Electoral Commission is responsible for the performance of the special remuneration (hereinafter referred to as" remuneration ") of CZK 2,200, the Vice-President and the minutes of the District Electoral Commission of CZK 2,100 and the other members of the District Electoral Commission of CZK 1,800. For the performance of his duties in the District Electoral Commission in a territorial division of the statutory city and in the capital of Prague, the reward according to the first sentence is increased by 400 CZK. In the event of a repeat vote, the remuneration shall be increased by an additional CZK 400."
2. In Article 1, the following paragraph 2 is inserted after paragraph 1, including footnote 24:
"(2) If elections are held for municipal councils in the run-up to other election2), the remuneration of a member of the District Electoral Commission pursuant to paragraph 1 is increased by 400 CZK for each subsequent election. If the second round is held in the elections, the remuneration for the next round of elections to the Senate of the Parliament of the Czech Republic or the election of the President of the Republic under another legislature24 will be increased.
24) Paragraph 12 (2) of Decree No. 233 / 2000 Coll., on the implementation of certain provisions of Act No. 247 / 1995 Coll., on elections to Parliament of the Czech Republic and on the amendment and addition of certain other laws, as amended. Article 6 (1) of Decree No 294 / 2012 Coll., on the implementation of certain provisions of the Law on the Election of the President of the Republic, as amended. '
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
3. In Article 1 (3) and (4), the words "and 2 'shall be inserted after the words" pursuant to paragraph 1'.
4. In the first sentence of Article 1 (4), "paragraph 2 'is replaced by" paragraph 3'.
5. In the second sentence of Article 1 (4), the words "the President or 'shall be deleted and the words" their' shall be replaced by the words "his'.
Amendment to Decree No. 409 / 2003 Coll.
Decree No. 409 / 2003 Coll., implementing Act No. 62 / 2003 Coll., on elections to the European Parliament and amending certain laws, as amended by Decree No. 251 / 2006 Coll., Decree No. 368 / 2008 Coll., Decree No. 442 / 2009 Coll., Decree No. 452 / 2013 Coll., Decree No. 63 / 2014 Coll., Decree No. 91 / 2017 Coll. and Decree No. 475 / 2017 Coll., are amended as follows:
1. Paragraph 10 (1) and (2), including footnote 17, read:
"(1) The President of the District Electoral Commission shall be given a special remuneration of CZK 2,200 (hereinafter referred to as" remuneration ') for the performance of his or her duties in the European Parliament (hereinafter referred to as "remuneration'), a remuneration of CZK 2,100 and a remuneration of CZK 1,800 to the Vice-President and the minutes of the District Electoral Commission.
(2) If elections to the European Parliament are held in conjunction with other elections, the remuneration of a member of the District Election Commission pursuant to paragraph 1 shall be increased by CZK 400 for each subsequent election. If the second round is held, the remuneration for the next round of elections to the Senate of the Parliament of the Czech Republic or the election of the President of the Republic under another legislature17 will be increased.
17) Paragraph 12 (2) of Decree No 233 / 2000 Coll. § 6 (1) of Decree No 294 / 2012 Coll., on the implementation of certain provisions of the Act on the Election of the President of the Republic, as amended. '
2. In Paragraph 10 (4), the words "or its President 'are deleted and the words" theirs' are replaced by the words "its'.
Amendment to Decree No 294 / 2012 Coll.
Decree No. 294 / 2012 Coll., on the implementation of certain provisions of the Act on the Election of the President of the Republic, as amended by Decree No. 452 / 2013 Coll., Decree No. 91 / 2017 Coll. and Decree No. 475 / 2017 Coll., is amended as follows:
1. Paragraph 6 (1) reads as follows:
"(1) The President of the District Electoral Commission and the Special District Electoral Commission shall be given special remuneration for the performance of their duties (hereinafter referred to as" remuneration ") of CZK 2,200, the Vice-President and the recorders of the District Electoral Commission and the Special District Electoral Commission of CZK 2,100 and the other members of the District Electoral Commission and the Special District Electoral Commission of CZK 1,800 in case the election of the President of the Republic took place only in one round. For the next round of the election of the President of the Republic, the remuneration according to the first sentence shall be increased by CZK 1 000 to the President, Vice-President and Registers of the District Electoral Commission and the Special District Electoral Commission and by CZK 700 to the other members of the District Electoral Commission and the Special District Electoral Commission. In the event of a repeat vote, the remuneration shall be increased by an additional CZK 400."
2. In Article 6, at the end of the text of paragraph 2, the words "for each subsequent election shall be added. If the second round is held in the elections held in parallel, the remuneration for the next round of elections to the Senate of the Parliament of the Czech Republic shall be increased in accordance with another legislative act (2)."

EFFECTIVE
This Decision shall enter into force on 1 September 2018.
