DECLARATION
Ministry of Health

amending Decree No. 261 / 1997 of the Ministry of Health Coll., laying down works and workplaces which are prohibited from all women, pregnant women, mothers until the end of the ninth month after childbirth and adolescents, and the conditions under which adolescents may exceptionally perform such work in order to prepare for their profession
The Ministry of Health shall determine, in accordance with § 150 (2) and in agreement with the Ministry of Education, Youth and Sports pursuant to § 167 (2) of Act No. 65 / 1965 Coll., the Labour Code, as amended by Act No. 74 / 1994 Coll.:
Čl. I
Decree No. 261 / 1997 Coll., which provides for work and workplaces which are prohibited from all women, pregnant women, mothers until the end of the ninth month after childbirth and adolescents, and the conditions under which adolescents may exceptionally carry out such work in order to prepare for their profession are amended as follows:
1. in Paragraph 1 (a) (2), the words "when starting a towing force greater than 115 N or a force greater than 160 N," shall be deleted.
2. in Paragraph 1 (a) (3), the words "and the average full-time energy output exceeds 9,4 KJ.min-1 net" shall be deleted.
3. in Article 1 (b) (2), including footnote (1a),
"2. Hand-transmitted vibrations exceed the maximum permissible values in the detailed assessment 1a) and the force required to control the tools exceeds 10% Fmax (maximum muscle force in the given working position at maximum free effort), if it is working with static component predominance, or 30% Fmax, if it is working with dynamic component predominance;
(1a) Table 14 of the Annex to Decree No. 13 / 1977 Coll., on the protection of health against the adverse effects of noise and vibration, published under No. 41 / 1977 Coll. Directive No 53 / 1980, Coll.
4. In Article 1 (e), "18% 'is replaced by" 20%';
5. In Article 2 (h), the following is added at the end of point 1: "(chemicals identified in specific legislation R 39, R 40 and R 48). 3a) '.
6. the following footnote (3a) is inserted after footnote 3:
"3a) For example, Decree No. 84 / 1997 Coll., regulating the registration and treatment of plant protection products and the technical and technological requirements for plant protection mechanisation and testing of plant protection products."
7. In Article 2 (h), the following is deleted at the end of point 4 and the following words are added: "(chemicals in specific legislation marked R 24), 3a) '.
8. In Article 2 (h), the following is deleted at the end of point 5 and the following words are added: "(chemicals in special legislation marked R 42 and R 43), 3a) '.
9. In Article 2 (m) (3), the words "not for use in laboratories or in the provision of health or veterinary care 'shall be inserted after the words" classes, 5).
10. in Article 2, at the end of point (o), the dot is replaced by a comma and the following point (p) is added:
"(p) work in the treatment of patients placed in closed psychiatric departments of medical institutions."
11. in Article 4 (1) (a) (3), "7, 8 and 9" is replaced by "7 and 8."
12. in Article 4 (1) (g), "18%" is replaced by "20%."
13. in Paragraph 4 (1) (m), the following shall be added at the end of point 1: "(chemicals identified in specific legislation R 39, R 40 and R 48), 3a)."
14. in Paragraph 4 (1) (m), the following shall be added at the end of point 2: "(chemicals identified in specific legislation R 42 and R 43), 3a)."
15. in Paragraph 4 (1) (m), the following shall be added at the end of point 4: "(chemicals identified in specific legislation R 24), 3a)."
16. in Article 4 (2) (b):
"(b) in paragraph 1:
1. (d), (h), (i) and (k) with the exception of the manufacture and packaging of poisons;
2.
3. (m) (3), when it comes to working with lead and its compounds,
4. points (n) and (p) (2) and (3) and (4), if applicable, when using equipment for the storage and use of compressed, liquid or dissolved gases;
5.
The amount to be reported in column 060 of this row:
they do not apply if the work carried out for the purpose of preparation for the profession, provided that there is adequate protection of the health of young people by continuous professional supervision, organisation of work or other measures, such as by the use of personal protective equipment, ';
17. In Annex 3, the entry "Benzo [a] anthracene 'is deleted from the list of carcinogens of the first group.
18. Annex 9 shall be deleted;

This decree shall take effect on 1 September 1998.
