GOVERNMENT REGULATION
of 12 June 2024
amending Government Regulation No 240 / 2014 Coll., on the level of tolls and toll discounts and the procedure for applying the toll discount, as amended
The Government orders pursuant to Article 46 (1) of Act No. 13 / 1997 Coll., on Road, as amended by Act No. 80 / 2006 Coll., Act No. 152 / 2011 Coll., Act No. 196 / 2012 Coll., Act No. 227 / 2019 Coll., Act No. 349 / 2023 Coll. and Act No. 82 / 2024 Coll.:
Government Decree No. 240 / 2014 Coll., on the level of toll rates and discounts on tolls and on the procedure for applying the toll discount, as amended by Government Decree No. 479 / 2020 Coll. and Government Decree No. 40 / 2024 Coll., is amended as follows:
1. In the title of the Government Decree, the words "and tolls discounts and the procedure for applying tolls discounts' are replaced by the words", tolls discount and the level of remuneration for the provision of the European electronic toll service '.
2. In footnote 2, the sentence "Directive (EU) 2019 / 520 of the European Parliament and of the Council of 19 March 2019 on the interoperability of electronic toll collection systems and the facilitation of the cross-border exchange of information on the non-payment of road charges in the Union 'is inserted after the first sentence of the separate line.
3. At the end of the text of § 1, the words "and the method of determining the level of remuneration for the provision of the European electronic toll service 'are added.
4. The following Section 6a is inserted after Section 6:
Method of determining the remuneration for the provision of the European electronic toll service
(1) The remuneration for the provision of the European electronic toll service shall be fixed periodically over the calendar month period.
(2) The remuneration for the provision of the European electronic toll service is determined as a product of:
(a) the aggregate toll collected by the European Toll Provider pursuant to Article 22c (1) (g) of the Road Act during the calendar month for which the remuneration is fixed; and
(b) the remuneration coefficient of the European Toll Provider established for the calendar year covered by the calendar month for which the remuneration is fixed.
(3) The remuneration coefficient of the European Toll Provider is set as the product of:
(a) the cost-effectiveness of the electronic toll system; and
(b) the coefficient of similarity of services provided by the European Toll Provider.
(4) The cost return of the electronic toll system shall be determined as a proportion
(a) the average annual amount of actual and estimated payments by the operator of the electronic toll system paid by suppliers for its construction and operation during the period 1 December 2019 to 30 November 2029; and
(b) the estimated revenue from tolls stored during the calendar year in which the calendar month for which the remuneration is fixed falls.
(5) The coefficient of similarity of the services provided by the European Toll Provider is established as a proportion
(a) the amount of actual and estimated payments by the electronic toll system operator paid by suppliers of the electronic toll system for its construction and operation during the period from 1 December 2019 to 30 November 2029 relating only to types of comparable activities the performance of which is provided by both the European Toll Provider and the Electronic Toll System Provider, taking into account the scope of the services provided by them; and
(b) the amount of actual and estimated payments by the operator of the electronic toll system paid by suppliers for its construction and operation during the period from 1 December 2019 to 30 November 2029. ';
Efficacy
This Regulation shall take effect on 1 July 2024.
