DECLARATION

amending and supplementing Decree No. 37 / 1967 of the Ministry of Justice Coll., to implement the Law on Experts and Interpreters, as amended by Decree No. 11 / 1985 Coll.
The Ministry of Justice of the Czech Republic provides, pursuant to § 26 of Act No. 36 / 1967 Coll., on Experts and Interpreters:
The Decree of the Ministry of Justice No. 37 / 1967 Coll., implementing the Act on Experts and Interpreters, as amended by the Decree of the Ministry of Justice of the Czech Socialist Republic No. 11 / 1985 Coll., is amended as follows:
1. the following Part Three is inserted after Part Two:
Remuneration of institutions
The institutes and other workplaces referred to in Article 21 of the Act (hereinafter referred to as the "expert institutes') shall be remunerated and reimbursed for the performance of the expert's activities (hereinafter referred to as the" expert's fees') at an amount corresponding to the prescribed costs (1) or to the contractual prices charged by the expert's institutes under economic contracts for expert opinions, expertise or similar performances (2).
Where a special provision (3) provides for flat-rate remuneration and compensation for certain types of expert opinions, the expert institutes shall not proceed under this special provision.
Paragraph 25 (2) shall apply when deciding on the fees. The State authority shall be entitled to reduce the fees if the expert act has been carried out late or of poor quality. ';
2. Parts III and IV shall become Parts IV and V.
3. Paragraph 25 repeals paragraph 6.
For expert opinions received by the State authority before the date of entry into force of this Decree, the expert institutes shall be remunerated and reimbursed in accordance with the existing rules.
This Decree shall take effect on 1 July 1990.

Decree of the Ministry of Justice of the Czech Republic No. 219 / 88-org. on flat-rate remuneration and compensation for expert opinions on the price of buildings, land, permanent crops and fees for the establishment of the right to use land (reg. 6 / 1989 Coll.).
