Decree on the issue of work cards and sickness insurance applications

Decree of the Minister for Social Welfare
of 26 September 1946
on the issue of work cards and sickness insurance applications.
The Minister of Social Welfare declares in the agreement with the Social Welfare Officer in accordance with § 3, § 5 and § 5 and § 9 of the Act of 12 February 1946, No 29 Coll., introducing working papers:
§ 1.
A model shall be used for the work card, as printed in Annex 1.
§ 2.
Work cards shall be drawn up:
(a) persons who have a working book, issued pursuant to the Government Decree of 26 June 1941, No 241 Coll., introducing working books, according to this working book, completed or corrected by the employer on the basis of duly presented documents and endorsed by the race board (confidant);
(b) persons who do not have working books, according to a questionnaire, the specimen of which is printed in Annex 2.
§ 3.
(1) The Regional Labour Protection Offices (branches) may impose an obligation on employers to:
(a) have submitted the working books of their staff to draw up a work card (§ 2 (a));
(b) compare the data in the questionnaires [§ 2 (b)] of their employees with the relevant documents (§ 6), confirm the accuracy of the data in the questionnaires and submit these questionnaires for the completion of the work card.
(2) Employers are required to collect the necessary forms of questionnaires for employees from the Regional Labour Protection Offices (branches) according to the instructions of those Offices and to allow the Regional Labour Protection Offices (branches) to compare employee questionnaires and documents if necessary in the plant.
§ 4.
(1) Domestic traders, domestic workers, persons with multiple employers and co-employed family members are required to collect a questionnaire form from the District Office of Labour Protection (branch) or, if they have a work book, to have a work card drawn up under this document [§ 2 (a)] by the District Office of Labour Protection (branch) responsible for the post.
(2) Persons who, following the effectiveness of this decree, enter into employment and do not yet have a job card will be issued without any involvement of the employer by the Regional Labour Protection Office (branch), responsible for the post. The employment card will be issued either according to the work book or to the questionnaire (§ 2), which can be confirmed by the school's directorate for persons entering the first job directly from schools of relief, general, urban and secondary.
§ 5.
Persons to whom a work card is to be issued are required to complete the questionnaire correctly, completely and legibly. Those who enter incorrect or incomplete data in the questionnaire will be punished in accordance with § 7, § 2, point (a) of Act No. 29 / 1946 Coll.
§ 6.
(1) To draw up a work card on the basis of a working book [Section 2, point (a)], a work book must be presented.
(2) In order to draw up a work card on the basis of a questionnaire [§ 2 (b)], the following documents should be submitted:
(a) the personal data card:
(aa) the birth certificate itself or the extract of the matrices;
(bb) a birth certificate or an extract from a birth certificate or other document showing the dates of birth of children under 21 years of age, unless they are required to have their own work card;
(b) the nationality card:
(aa) Czechoslovak citizens Certificate of Czechoslovak citizenship or Certificate of National Confidence pursuant to § 1, paragraph 4 of the Constitutional Decree of 2 August 1945, No 33 Coll., on the adaptation of Czechoslovak citizenship to the nationality of persons of German and Hungarian nationality or on the preservation of Czechoslovak citizenship pursuant to § 2 of the Act of Citation or on the preparation of an option under the contract between the Czechoslovak Republic and the Union of the Socialist Republic of Zakarpatsky of 29 June 1945, or on the acceptance of an option declaration pursuant to § 4 of the Government Decree of 24 August 1945, No 61 Coll.
(bb) a passport or other document of the same probability and residence permit issued in accordance with the applicable rules;
(c) in Slovakia, an employment card (identity card) under the Decree of 11 September 1942, No 188 of the SLA, on employment cards (legitimacy).
(3) If a person is not required to have a work card, the documents referred to in paragraph 2, the office issuing the work card may, in Slovakia, determine by which other document the necessary data must be provided. The same applies to the issue of work cards in Czech countries to persons of Slovak nationality, after the case of persons who are intermediate or assigned from Slovakia to work in Czech countries.
(4) Military service, honours in national competition in the construction of the Republic, professional and university training, examinations, special training, etc., as well as longer-term employment must be supported by a certificate or other certificate.
(5) The submission of the documents referred to in paragraph 2 may be waived if the questionnaire has been confirmed by the school's Directorate (§ 4 (2)).
§ 7.
The person issuing the work card shall sign both the receipt of the work card and the accuracy of the entries on the work card.
§ 8.
The employment card shall be provided with a number to be communicated by the social security holder designated by the Ministry of Social Welfare.
§ 9.
(1) Changes and additions to the registration on pages 1 to 5 and on pages 28 to 30 may be made only by the district labour protection office (branch) responsible for the last job. Any such amendment or supplement shall be stamped, dated and signed.
(2) The employer may repair or supplement his own entries on pages 6 to 27; the repair or supplement must be confirmed by the race board (confidant).
§ 10.
(1) The loss or damage to a work card which makes it no longer applicable must be reported immediately to the County Labour Protection Office (branch) responsible for the last job.
(2) Before a replacement employment card is issued, the person whose work card has been lost or damaged must report to the District Office of Labour Protection (branch), as far as proof is concerned, all the circumstances which led to the loss or damage of the work card.
§ 11.
For the issue of a replacement employment card, a levy shall be levied on official administrative operations in accordance with the A levy rate (2); the levy collected shall be charged to the Treasury.
§ 12.
(1) Persons required to have a work card must be declared at the Regional Labour Protection Office (Branch Office) before entering the service in order to obtain an application for sickness insurance, unless the Regional Labour Protection Office (Branch) objects to the employment agreement.
(2) On the application form, the Regional Labour Protection Office (branch) shall complete the name and surname, date of birth, residence, group and type of occupation of the person entering the employment and the employer's address. The employer shall fill in the other information on the application form.
(3) The forms of applications are uniform for all social insurance holders and will be issued free of charge by the Regional Labour Protection Offices (branches). Other forms of applications may not be used. The model of the application is attached in Annex 3.
(4) The provisions of the preceding paragraphs shall not apply to:
(a) non-permanent employed persons whose employment is usually concluded for less than 7 consecutive calendar days;
(b) auxiliary workers who are not employed on the necessary agricultural work without interruption for more than 4 weeks;
(c) persons who have been admitted to the removal of an emergency (e.g. the consequences of natural disasters);
(d) persons re-registered for sickness insurance under § 17, paragraph 2 of the Act of 9 October 1924, No 221 Coll., on the insurance of staff in the event of sickness, invalidity and old age, as amended by the legislation amending it and supplementing it.
(5) The forms of applications of a different colour shall be used for reporting on sickness insurance of the persons referred to in paragraph 4. These reports shall be carried out in accordance with existing rules.
§ 13.
(1) An employment voucher (Annex 3) of the Regional Labour Protection Office (branch) is attached to the application form, which must be completed by the employer and sent together with the application to the carrier of the sickness insurance.
(2) Carriers of sickness insurance will separate the working order and send it immediately to the Regional Labour Protection Office (branch) which issued the application.
§ 14.
In Slovakia, it is possible to derogate from the provisions of Section 12 (3) of the Decree in respect of the model of the application form for sickness insurance and to use the form to be determined by the social security officer.
§ 15.
The obligations imposed by this decree on the employer after the case of the employee shall apply, unless otherwise provided, mutatis mutandis to domestic workers and head of the family, to domestic workers, domestic traders, domestic workers and co-workers.
§ 16.
The employment card issued pursuant to Act No. 29 / 1946 Coll. and this decree is also an employee card in Slovakia (legitimacy for social insurance purposes) under the Decree with power of Act No. 188 / 1942 Coll. z.
§ 17.
This decree takes effect on the day announced in the Czech and Moravian-Silesian countries by the Minister for Social Welfare in the Official Journal, Slovakia by the Social Welfare Officer in the Official Journal. The applicability of the Government Decree of 26 June 1941, No. 241 Coll., introducing working books and regulations issued for its implementation shall be deleted from the date on which the Decree becomes effective in the Czech and Moravian-Silesian countries; However, working books issued under this legislation shall remain valid until the date on which they are replaced by working cards.
