of 13 September 1946
on customs discounts for the import of machinery and apparatus.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
(1) For machinery of tariff class XL [except for machinery of tariff heading 531, 532, 533, 534a] and tariff notes 538], for machinery of tariff class 539 (except for engines and dynamos falling within the tariff note number 539), for electrical apparatus and electrical equipment of tariff heading 543 and for tractors and motor ploughs of tariff. Pol. 553d), stuffed between 1 July 1946 and 31 December 1948, a reduction of import duties may be allowed if they are not produced in the country and if their importation is necessary to introduce or improve a sector of industrial or agricultural production or to restore a production undertaking damaged by war.
(2) An import duty reduction may also be allowed for the most important and significant spare parts for such machinery imported from a foreign country which is not produced at all in the country, provided that they have been fitted between 1 July 1946 and 31 December 1948 and that their effective affiliation to those machinery is demonstrated.
Where this duty reduction is granted, the following shall be levied:
(a) in the case of rates of pol. 530a), 530b), 530c) 1-2 and 534b) reduced duty 50 CZK per 100 kg net weight;
(b) in the case of rates of Nos 526, 527, 528, 529, in the case of the tariff notes, pol. 530c), in the case of rates of 535, 536, 537, 538, 539 and 543, the reduced duty is 100 Kts per 100 kg net weight,
(c) for pol. pol. 553d) reduced duty 300 CZK per 100 kg net weight.
The Ministry of Finance may, before deciding on applications for a duty reduction under this Act, request the good appearance of the Advisory Council set up for that purpose by the Ministry of Finance.
This Act shall take effect on the day of its publication; it shall be implemented by the Finance Minister in agreement with the participating members of the Government.
