of 18 June 2007
on the derogating adjustment of the working and rest periods of the members of the fire brigade
The Government orders pursuant to § 100 (2) of Act No. 262 / 2006 Coll., Labour Code:
This Regulation implements the relevant provisions of the European Communities (1) and provides for derogations from the arrangements for working and rest periods for members of the Fire Rescue Corps (2), composed of employees of the employer who operate in that Unit as a job, whose duties include the performance of the task of that Unit (hereinafter referred to as "member of the Unit ').
(1) The employer shall plan the working time of the member of the unit in such a way that the length of his shift does not exceed 16 hours at an uneven schedule.
(2) The length of the working time may not exceed 24 hours within 26 consecutive hours if the member of the unit is over 18 years of age and is called upon to perform the task under Paragraph 70 (1) (a) or (b) of the Fire Protection Act.
(1) Continuous daily rest (3) may be reduced to a member of a unit older than 18 years up to 8 hours in a 24-hour period, provided that such reduction is strictly necessary to ensure the capability of the fire brigade unit. The continuous daily rest, shortened according to the first sentence, shall be replaced by the member of the unit in the following week.
(2) If, as a result of the determination of the length of the working time referred to in Article 2 (2), a member of the unit is not given even a short continuous daily rest as referred to in paragraph 1, the employer shall provide him with a continuous daily rest immediately after the end of the working time, which shall consist of a non-continuous daily rest period and an immediate follow-up to the continuous daily rest period referred to in Article 90 (1) of the Labour Code. The rest according to the first sentence shall not be reduced. Paragraph 1 shall not apply in such a case.
This Regulation shall enter into force on the day of its publication.
