DECLARATION
of 7 July 2015
amending Decree No. 432 / 2003 Coll., laying down the conditions for the classification of works into categories, the limit values for biological exposure test indicators, the conditions for the collection of biological material for carrying out biological exposure tests and the formalities for reporting work with asbestos and biological agents, as amended by Decree No. 107 / 2013 Coll.
The Ministry of Health provides pursuant to § 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related laws, as amended by Act No. 274 / 2003 Coll., Act No. 392 / 2005 Coll. and Act No. 222 / 2006 Coll. to implement § § 37 (1), § 39 (3) and (4) and § 41 (1) of the Act:
Decree No. 432 / 2003 Coll., laying down the conditions for the classification of works into categories, the limit values of the biological exposure test indicators, the conditions for the collection of biological material for carrying out biological exposure tests and the formalities for reporting of work with asbestos and biological agents, as amended by Decree No. 107 / 2013 Coll., are amended as follows:
1. In Annex No 1, Part 2, Chapter "Category 2 ', point (c) is deleted after" H334, H317'.
2. In Annex No 1, Part 2, Chapter "Category Three ', at the end of the text in point (c), the words" where work with them does not fall under the results of a comprehensive assessment of the exposure of workers to category two' are added.
3. In Annex No 1, Part 6, Chapter "Category 2 '(b) (1), the words" the forces deployed which are part of a regular work activity and which do not occasionally exceed 70% of the Fmax' are replaced by the words "or work in which there are occasional acts involving the exercise of muscle forces greater than 70% of the Fmax but which are not part of the work '.
4. In Annex No 1, Part 6, Chapter "Category 2" (c), the words "neither on occasion shall exceed 45% of Fmax" shall be replaced by "or work in which occasional operations occur involving the disposal of muscle forces greater than 45% Fmax but which are not part of the regular work activity."
5. In Annex No 1, Part 6, Chapter "Category of third ', including the title:
"Category 3
(1) The work referred to in the chapter "Category 2 '(b) (1) and (c) under conditions in which the criteria for classification in the second category are exceeded shall be classified in the third category.
(2) The third category also includes work
(a) carried out by small muscle groups in the case of the excess of the dynamic component, where the average all-shift load exceeds 30% of Fmax or where work takes place requiring a short-term use of the force from 55 to 70% Fmax more than 600 times for the average shift when a measuring device is used to scan once per second or where operations occur during work involving the use of muscle forces greater than 70% Fmax and are a regular part of the work;
(b) carried out by small muscle groups when the static component is outweighed, in which the average all-exchange muscle force exceeds 10% of Fmax or during work occurs acts involving the use of muscle forces greater than 45% of Fmax and are a regular part of the work. "
6. In Annex 1, Part 7, Chapter "Working position ', paragraph 2 is deleted and the designation of paragraph 1 is deleted.
7. footnotes 5 to 9 are deleted.
Efficacy
This Order shall take effect on the first day of the third calendar month following its publication.
