laying down closer conditions for the implementation of the common market organisations as regards the system of export subsidies for agricultural products and processed agricultural products
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll.:
§ 1
Subject matter
This Regulation (1) regulates, following the directly applicable provisions of the European Communities (1a) (hereinafter referred to as "the European Communities'), the detailed conditions for the implementation of the common market organisations as regards the system of granting export subsidies for agricultural products and processed agricultural products.
§ 2
Where the concept of export refund is used in the European Communities (1a), this means export subsidy for the purposes of this Regulation.
§ 3
Export subsidy application, export subsidy advance and pre-financing of export subsidy
(1) An application for an export subsidy, an application for an export subsidy advance and an application for pre-financing of the export subsidy pursuant to the provisions of the European Communities (2) shall be deemed to be the original of the Single Administrative Document, indicating the export licence number (3) or the refund certificate number, (4) where such certificate has been issued.
(2) The exporter shall indicate on the single administrative document whether he is applying for the export subsidy, the export subsidy advance or the pre-financing of the export subsidy in accordance with the rules of the European Communities.2)
§ 3a
In the case of exports of agricultural products under the rules of the European Communities (4a), the exporter shall submit the transport documents4b) and, where the State Agricultural Intervention Fund (hereinafter referred to as the Fund) is invited in writing, also the documents provided for in the rules of the European Community4c).
§ 4
Manufacturer's registration
(1) A manufacturer whose products are to be exported in the form of regular exports under European Community rules (5) shall apply to the Fund for registration to this end.
(2) The manufacturer shall attach to the application for registration of the manufacturer referred to in paragraph 1:
(a) proof that he is an entrepreneur (6);
(b) the manufacturer's declaration using the form issued by the Fund
1. the composition of the product to be exported in the form of regular exports (7), indicating the quantities of basic products and products resulting from their processing and the own six-digit registration number under which the Fund will register this declaration,
2. the losses incurred in the production of the product to be exported in the form of regular exports (7).
(3) The application for registration of the manufacturer referred to in paragraph 1 shall be made using the form issued by the Fund.
§ 6
Efficacy
This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
