DECLARATION
Management of federal material reserves
of 4 December 1989
amending Decree No 174 / 1964 Coll., laying down the basic conditions for the supply of State reserves
The management of federal material reserves after discussion with the participating central authorities of the state administration and the State Arbitration of the Czechoslovak Socialist Republic provides, pursuant to Article 392 (1) (d) of Economic Code No. 109 / 1964 Coll., in the full version published under No. 80 / 1989 Coll. ("the Act '):
Čl. I
Decree No. 174 / 1964 Coll., on the basic conditions for the supply of State reserves, is amended as follows:
1. The title of the Order reads:
"Decree of the Federal Physical Reserve Administration on the basic conditions for the supply of State tangible reserves'.

„§ 1
Subject matter
(1) These basic conditions of supply shall apply to all deliveries made to federal tangible provisions, including those from imports and to all deliveries from federal tangible provisions, with the exception of deliveries for export.
(2) Furthermore, these basic conditions apply to the supply of national reserves for the economic mobilisation preparation of the national economy. "
3. In Section 2, the words "or the State Arbitration of the Czechoslovak Socialist Republic" shall be inserted after the words "Provincial Ministries."
4. In Paragraph 3 (1), the word "material 'is inserted after the word" state' and the word "state 'is replaced by" federal'.
5. In Paragraph 3 (2), "State 'is replaced by" Federal'.

„§ 5
Guarantee period
(to Section 135 of the Act)
The guarantee period - unless the basic terms of delivery issued by the supplier ministries or the State Arbitration of the Czechoslovak Socialist Republic are set - is a different period - 6 months after delivery. In the case of supplies to State tangible reserves, the guarantee period shall end 6 months after the end of the protection period. The period of protection is determined by the resolution of the Government of the Czechoslovak Socialist Republic. If not provided for in this way, it shall be agreed by the organisation in the contract. ';
7. in Article 6 (1), (2) and (4), the word "material" shall be inserted after the word "State."
8. In Article 6 (3), the word "material 'is inserted after the word" State' and the last sentence is deleted.
9. In Article 7 (1), the word "material 'shall be inserted after the word" State'.
10. in Article 9, the word "material" shall be inserted after the word "State."
11. in Article 10, the word "material" shall be inserted after the word "State."
12. Article 11 is deleted.
13. in Article 12 (2), the text in brackets shall be deleted and the word "material" shall be inserted after the word "State."
14. in Article 12 (3) (b), the words "undertaking entrusted" shall be replaced by "organisation entrusted" and the words "material" shall be inserted after the words "State."

„§ 13
Property sanctions
(to Section 204 of the Act)
For delays in the supply of state reserves for economic mobilization preparation of the national economy, the supplier shall be obliged to pay property penalties at twice the legal rate. ';

This Decree shall take effect on 1 January 1990.
