of 27 December 1982
on the basic conditions of supply to ensure scientific and technological development
The Federal Ministry of Technical and Investment Development, in agreement with the State Arbitration of the CSSR and after consulting the participating central authorities, provides, pursuant to Article 392 (3) of the Economic Code No. 109 / 1964 Coll., as published under No. 37 / 1971 Coll. and as amended by Act No. 165 / 1982 Coll. ("the Act '):
INTRODUCTORY AND GENERAL PROVISIONS
Subject matter
(1) This Decree regulates the economic obligations of:
(a) carrying out scientific and technical work;
(b) the use of results from scientific and technical work.
(2) The economic obligations arising from the implementation of scientific and technical work and the use of the results of scientific and technical work to ensure the defence and security of the State shall be covered by this decree, unless specific provisions provide otherwise. 1)
It is not possible to advertise after 5 years of delivery.
New product development contract
It shall not be possible to complain after 5 years of delivery, except in the case of defects in prototypes or uniquities, where the time limit for the complaint is 18 months from delivery.
Discrimination may not be made after 5 years of delivery, except for defects in an installation where the period for the complaint is 18 months after the facility is put into service; This period shall be extended by the period during which it is possible to claim defects in the set of machines and equipment in which the device has become part.
Final provision
This Decree shall take effect on 1 January 1983.
