Ministry of Labour and Social Affairs
of 20 December 1968
amending and supplementing Decree No. 105 / 1964 of the State Social Security Office Coll., on pension insurance for individual farmers and other self-employed persons and on the provision of a provision to members of their families, as amended by Decree No. 93 / 1968 Coll.
The Ministry of Labour and Social Affairs shall provide, in agreement with the Ministry of Agriculture and Nutrition, with the Central Council of Trade Unions and other participating central bodies pursuant to § 145 of Act No. 103 / 1964 Coll., on Social Security of Cooperative Farmers, as amended by Act No. 141 / 1965 Coll., No. 116 / 1967 Coll., No. 89 / 1968 Coll. and No. 161 / 1968 Coll. ("the Act '):
Čl. I
The Decree of the State Social Security Office No 105 / 1964 Coll., on the pension insurance of individual farmers and other persons self-employed and on the provision of a provision to members of their families, as amended by Decree No 93 / 1968 Coll., is amended as follows:
1. In Paragraph 1 (3), the words' and, from 1 January 1969, the wife of the individual farmer and the wife of the cooperating family member 'are inserted after the words' schooling '.
In the same paragraph, paragraph 4 is deleted.
2. Article 6 (2) shall be deleted; as a consequence, the indication of paragraph 1 of this paragraph shall be deleted.

"An old-age pension belongs to an individual farmer who, during the period of insurance or up to two years after his death, has reached the age of 65, is insured for at least 15 years and does not receive an invalidity pension '.
4. Article 9 (1) reads as follows:
"(1) The old-age (invalidity) pension of an individual farmer shall be:

5. In Article 9, the following paragraphs 3 and 4 are added:
"(3) If the old-age (invalidity) pension is the sole or main source of nutrition of the pensioner, the amount of at least 445 CZK per month shall be determined, and if the pension is also referred to by the family member of the pensioner, the amount of at least 645 CZK per month; if this family member is a spouse who has a pension, the old-age (invalidity) pension shall be calculated in such a way that, together with the pension belonging to the spouse, it does not amount to less than 750 Cds per month.
(4) As a general rule, retirement is considered to be the main source of nutrition for a pensioner if his other income does not amount to more than 200 CZK per month, and if a pensioner's family member is also dependent on the pension, more than 400 CZK per month. The income of a pensioner or his family member shall not be taken into account if those persons are over 70 years of age. ';
6. Article 11 (3) reads as follows:
"(3) The widow's pension shall be 60% of the old-age (invalidity) pension; Paragraph 66 (4) and (5) of the Act applies mutatis mutandis. If the widow's pension is the sole or main source of nutrition for the pensioner, it shall be 445 CZK per month. '

„§ 14
Increase in pensions and education for helplessness
The pensions of individual farm farmers may be increased by 100 to 400 CZK per month for the helplessness of the pensioner under the conditions laid down in § 74 of the Act; Similarly, it may be increased for the helplessness of a child from the seventh year of his age, orphan's pension and education allowance. '

„§ 19
Amount of invalidity (partial invalidity) pension
(1) The invalidity pension of a member of the family of an individual farmer is 210 CZK per month and may be increased by 50 CZK per month.
(2) The partial invalidity pension of a member of the individual farmer's family amounts to 105 CZK per month and can be increased by 30 CZK per month.
(3) Family members of compulsory education may be granted an invalidity pension (partial invalidity) of only half of the pension referred to in the preceding paragraphs until the end of compulsory education.
(4) The education allowance does not apply to the pensions of family members. "
9. In Paragraph 21 (4), the second sentence is deleted.
10. the following Part Four is inserted after Section 22:

Pension insurance of resistance participants and survivors
§ 22a
Preliminary provisions
For the pension insurance of an individual farmer (§ 1) and other self-employed persons (§ 21), if they are members of the resistance and the survivors of them, the provisions of this decree shall apply, unless otherwise provided in this section.
§ 22b
Age required for entitlement to an old-age pension
(1) The age required for entitlement to the old-age pension of the Resistance Party I and II shall be determined by deducting one year from the age of 65 for each starting year of the resistance activity; However, the required age shall be at least 60 years if it is a participant in resistance I of the group and 62 years if it is a participant in resistance II of the group.
(2) The age required for entitlement to the retirement pension of a member of the resistance group III who has been imprisoned for at least six months because of fascist persecution is 64 years.
§ 22c
Increase in old-age and invalidity pensions
For each starting year of resistance activity, the pension of the resistance participant shall be increased

11. The fourth to sixth shall be referred to as the fifth to seventh.
12. The following Sections 24a and 24b are inserted after Section 24:
„§ 24a
The spouse of an individual farmer and a cooperating member of the family shall be assessed as the insurance period of the cooperating member of the family, at the request of the co-worker no later than 31 December 1971, if:
(a) meet the conditions laid down in Article 1 (3) in that period;
(b) the period for which it has requested to be evaluated shall be at least five years of the total duration of its participation in the gainful activity of the spouse and, if its participation in the gainful activity of the spouse has lasted for less than five years, that shorter period; and
(c) the premium for the period in question has been duly paid.
§ 24b
The invalidity (partial invalidity) pensions of the spouses of the individual farmers and spouses of the cooperating members of the family * due before 1 January 1969 shall be considered as invalidity pensions of the cooperating members of the family as from that date, at the rate they were due on 31 December 1968. '
13. In Paragraph 25, the following point 20 is added after point 19:
"20. On groups of resistance participants, on the invalidity (partial disability) pension of resistance participants, if full (partial) invalidity arises in connection with the resistance activity, on the highest and lowest size of the old-age and disability pension of the resistance participant, on the lowest level of the widow's widow's pension after the resistance participant or widow's participation in the resistance, on the shortening of their widower's pension in connection with the income from the gainful activity, on the amount of the orphan's pension of the child after the resistance participant, on the amount of the income of the parents of the resistance participant, on the exemption from the special income tax of the resistance participants entitled before 1 January 1969."
As a result of this amendment, in the same section, points 20 to 22 are renumbered as points 21 to 23.
Čl. II
Paragraph 9 (1), as amended by this Decree, shall also apply to pension rights for old-age and invalidity pensions incurred before 1 January 1969. The amount of the old-age and invalidity pension will be adjusted at the request of the pensioner first starting with the payment of the pension due in January 1969.
Čl. III
This Decree shall take effect on 1 January 1969.
