GOVERNMENT REGULATION
of 26 June 2013
amending Decree No. 142 / 1994 Coll., determining the amount of interest on late payments and the late payment fee under the Civil Code, as amended
The Government orders the implementation of § 517 paragraph 2 of Act No. 40 / 1964 Coll., Civil Code, as amended by Act No. 509 / 1991 Coll., and pursuant to § 369 paragraph 1 of Act No. 513 / 1991 Coll., Commercial Code, as amended by Act No. 370 / 2000 Coll. and Act No. 179 / 2013 Coll.:
Čl. I
Government Decree No. 142 / 1994 Coll., determining the amount of interest on late payment and the fee for late payment under the Civil Code, as amended by Government Decree No. 163 / 2005 Coll. and Government Decree No. 33 / 2010 Coll., is amended as follows:
1. At the end of the title of the Government Regulation, the words "and setting the minimum amount of costs associated with the application of the claim 'shall be added.
2. In the introductory sentence of the Decree of the Government, the word "orders" is inserted after the word "government," and the word "orders" is replaced by "and according to Article 369 (1) of Act No. 513 / 1991 Coll., Commercial Code, as amended by Act No. 370 / 2000 Coll. and Act No. 179 / 2013 Coll."
3. In Section 1, "seven 'is replaced by" eight';
4. The following Section 2a is inserted after Section 2:
„§ 2a
If it is a binding relationship between the entrepreneur or if it is the content of a mutual obligation between the entrepreneur and the contracting authority to deliver goods or to provide a service for consideration to the contracting authority, the minimum cost associated with the application of each claim shall be CZK 1,200. '
Čl. II
Transitional provisions
1. The amount of interest on late payments made before the date of entry into force of this Regulation shall be governed by existing legislation.
2. The minimum amount of the costs associated with the application of the claim under Government Decree No. 142 / 1994 Coll., as amended by this Regulation, shall be borne by the creditor if the delay in the performance of the obligation occurred after the date of entry into force of this Regulation.
Čl. III
Efficacy
This Regulation shall enter into force on the first day of the first calendar month following its publication.
