GOVERNMENT REGULATION
of 31 March 2004
on the implementation of certain measures of the common organisation of the market in cereals
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll.:
Subject matter
This Regulation governs certain measures for the implementation of the common organisation of the market in cereals, the adaptation of which by binding legislation of the European Communities (1) (hereinafter referred to as the "European Communities') orders or allows Member States of the European Union to adapt separately.
Storage of intervention cereals
Storage of intervention cereals shall be carried out in accordance with specific legislation.2)
Sale of intervention cereals for sale on the market in the European Communities
(1) The offer to buy-in intervention cereals under tendering procedure (3) for the sale of such cereals by the State Agricultural Intervention Fund (hereinafter referred to as the Fund) on the market in the European Communities under the rules of the European Communities (3) is valid if it contains a guarantee under the rules of the European Communities (4) corresponding to a guarantee of at least EUR 5 per tonne of such cereals.
(2) The Fund shall conclude a purchase contract with the person selected under the invitation to tender provided for in paragraph 1 for the sale of intervention cereals intended for the market in the European Communities.
Sales of cereals purchased from intervention for export
The Fund shall conclude a contract of sale with the person selected in the invitation to tender for the sale of intervention cereals bought in for export under the European Communities Code (3) for the sale of intervention cereals for export.
Repeal
Government Regulation No 237 / 2001 Coll., laying down the conditions and principles for the implementation of intervention buying-in, storage and selling of cereals on the domestic market and for export and for the implementation of further measures for the organisation of the cereals market, and laying down the conditions and principles for declaring the intervention price (conditions and principles for the implementation of intervention buying-in, storage and selling of cereals) is hereby repealed.
Efficacy
This Regulation shall enter into force on the date of the entry into force of the Treaty of Accession of the Czech Republic to the European Union.
