of 28 June 1999
laying down technical requirements for the efficiency of hot water boilers burning liquid or gaseous fuels
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts (hereinafter referred to as "the Act") to implement Sections 12 (1) and (4) and 13 (2) and (4) of the Act:
§ 1
(1) This Regulation lays down technical requirements for the efficiency of liquid or gaseous fuel hot water boilers in accordance with European Community law (1) and the international contract (2).
(2) This Regulation shall apply to new hot water boilers, which comprise combined heat units, consisting of a boiler body and a burner, designed to heat water by the combustion of gas or liquid fuel, with a rated output of 4 to 400 kW including (hereinafter referred to as "boilers') and to boiler bodies intended for installation with a burner or for burners intended for installation in a boiler body, where they are separately placed on the market (hereinafter referred to as" components').
§ 2
The specified products under Section 12 (1) of the Act are boilers and components except:
(a) hot water boilers which may burn other than gaseous or liquid fuels, including solid fuel hot water boilers;
(b) equipment for the immediate preparation of hot water (flow heaters);
(c) boilers intended for fuels whose characteristics differ substantially from those of liquid and gaseous fuels normally available on the market (waste industrial gases, biogas, etc.),
(d) stoves and appliances intended primarily for heating the premises in which they are installed and which have as an additional function the supply of hot water for central heating and hot commercial water;
(e) appliances with a rated output of less than 6 kW, with self-contained circulation, intended only for the preparation of storage hot water for use in the container;
(f) boilers produced individually.
§ 3
(1) The technical requirements for the efficiency of boilers (hereinafter referred to as "essential requirements") which the boilers must meet when operating with the rated Pn power expressed in kW and with the mean water temperature in the boiler 70 ° C (hereinafter referred to as "rated power") and when operating with 30% load and with the mean water temperature in the boiler, which varies according to the type of boiler (hereinafter referred to as "partial power") are given in the table below.

(2) In relation to the essential requirements referred to in paragraph 1:
(a) a standard boiler means a boiler for which the mean water temperature may be limited by its design;
(b) a low-temperature boiler means a boiler which can permanently operate at a temperature of 35 to 40 ° C of the water supplied, in which condensation may take place under certain conditions, including condensing liquid fuel boilers;
(c) gas condensing boiler means a boiler in which a large part of the water vapour contained in the flue gas is permanently condensed;
(d) supplementary heat exchanger means a part of a boiler intended for the supply of a central heating system which is installed in a exhaust gas and which is connected to a gas heater;
(e) a boiler for accommodation means a boiler with a rated heat output of up to 37 kW, designed to transmit heat from a boiler having an open expansion vessel to that part of the housing in which the boiler is installed, and to supply hot water, a self-loading cycle is used, such boilers shall be indicated on their mantle that they are intended to be installed in the living space;
(f) rated power (expressed in kW) means the maximum heat output determined and guaranteed by the manufacturer, which can be achieved in the continuous operation of the boiler and in the efficiency declared by the manufacturer;
(g) efficiency (expressed in%) means the ratio between the heat output transmitted by the water in the boiler and the corresponding calorific value at constant overpressure and fuel consumption per unit of time;
(h) partial power (expressed in%) means the ratio between the boiler power and the rated power if the boiler operates intermittently or with a power lower than the rated power;
(i) the mean temperature of the boiler water means the arithmetic mean between the temperature of the water at the inlet and outlet of the boiler.
(3) In the case of dual-function boilers, i.e. boilers intended for heating and hot water preparation, the essential requirements concern only the heating function.
(4) Boilers intended as supplementary heat exchangers and accommodation boilers which are largely installed at the date of entry into force of this Regulation may be put into service if their efficiency is greater than that laid down for the standard boilers referred to in paragraph 1, reduced by 4%.
(5) Where the essential requirements are specified by harmonised Czech technical standards (§ 4a (1) of the Act) or by foreign technical standards transposing harmonised European standards in the European Union States and the characteristics of boilers or components are compatible with them, it is considered that the essential requirements are met.
(6) The methods for verifying the efficiency of boilers for production and measurement are set out in the technical standards referred to in paragraph 5.
(7) Boilers which do not comply with the efficiency requirements of paragraph 1 shall not be put into service.
§ 4
(1) Before placing on the market mass-produced boilers and components, the manufacturer or importer shall carry out an assessment of conformity with the essential requirements of this Regulation by EC type-examination in accordance with Annex 3 to this Regulation and shall, at his choice, carry out the following additional procedures (Section 12 (4) of the Act):
(a) by verifying the conformity of the product with the certified type referred to in Part I of Annex 4 to this Regulation;
(b) the assessment of the quality system of production referred to in Part II of Annex 4 to this Regulation; or
(c) the assessment of the quality system of products referred to in Part III of Annex 4 to this Regulation.
(2) An authorised person who has carried out an EC type-examination in accordance with Annex 3 to this Regulation shall issue an EC type-examination certificate on a boiler or component.
(3) In the case of gas boilers, conformity assessment procedures according to a specific legislation are also applied in parallel with the procedures for their effectiveness. 3)
§ 4a
(1) On the basis of the conformity assessment referred to in Article 4, the manufacturer or importer shall issue a certificate of conformity pursuant to Part I, II or III of Annex 4 to this Regulation, depending on the conformity assessment procedure used, and bear the CE marking of the product.
(2) For boilers or components which comply with the requirements of this Regulation, the CE marking referred to in Annex 1 (1) shall be affixed to the product, the condition of which is to draw up a written declaration of conformity indicating that the boilers or components conform to the type described in the EC type-examination certificate and comply with the essential requirements. At the same time, parameters are defined to enable the components, after assembly of the boiler for which they are intended, to reach the required level of efficiency referred to in § 3 (1).
(3) The CE marking shall be placed on the boiler and components in a visible, easily legible and indelible manner. The boiler and components may be labelled other than the CE marking provided that the visibility and legibility of the CE marking are not thereby reduced.
(4) Where boilers or components are also subject to other government regulations which relate to other requirements and also provide for the location of the CE marking, the CE marking shall also indicate compliance with the provisions of those other government regulations.
(5) However, if one or more of these regulations of the Government for a transitional period allow the manufacturer to choose which provisions he will follow, the CE marking or the declaration of conformity shall only indicate compliance with those provisions of the Government Regulations which the manufacturer has used. In this case, the accompanying documentation, warnings or instructions required by the government regulations concerned and annexed to the relevant boilers or components shall include a list of the government regulations used.
§ 5
(1) The evidence of the conformity assessment procedure used pursuant to Article 13 (8) of the Act includes the technical documentation referred to in point 3 of Annex 3 to this Regulation and the documents and certificates issued when assessing conformity by an authorised person and the declaration of conformity issued pursuant to Article 4a (2). In cases resulting from Paragraph 13 (8) of the Act, the importer shall submit to the supervisory authority documentation in the language of one of the Member States of the European Union or in a language agreed with the supervisory authority.
§ 6
The manufacturer or importer shall be entitled to mark the boiler using the efficiency symbol set out in Annex 1 to this Regulation with the marks referred to in Annex 2 to this Regulation if the conformity assessment procedures referred to in Section 4 show that the essential requirements have been complied with or that they have increased efficiency as follows:
(a) if the efficiency of the boiler at rated power and at partial power is equal to or greater than the relevant values for the standard boiler, the boiler may be marked with the symbol "latter" (one five-point black star) in accordance with Annex 2 to this Regulation;
(b) where the efficiency of the boiler at rated power and at partial power is three or more per cent (%) higher than the relevant values for the standard boiler, the boiler may be marked with the symbol "latter" (two five-pointed black stars) in accordance with Annex 2 to this Regulation;
(c) any additional 3% increase in efficiency both at rated and partial power shall allow the use of the additional symbol "," as specified in Annex 2 to this Regulation.
§ 8
Boilers and components which will be placed on the market after the entry into force of this Regulation may, instead of the technical requirements laid down in this Regulation, meet the requirements for their characteristics as laid down in the present Regulations but not later than 31 December 2002. The CE marking shall not be affixed to such products.
§ 9
This Regulation shall enter into force on 1 January 2000.

1. CE marking
The graphical form of the CE marking shall be determined in accordance with the specific legislation.4)
2. Additional specific markings
(a) The last two digits of the year in which the CE marking was affixed.
(b) The energy efficiency symbol referred to in Article 6 of this Regulation shall take the following graphic form:

EC TYPE REVIEW
(Paragraph 4 (1) - Module B)
1. EC type-examination is a procedure whereby the authorised person ascertains and certifies that the sample representing the intended production complies with the relevant provisions of this Regulation.
2. The application for EC type-examination shall be submitted by the manufacturer or, where appropriate, by an authorised representative or importer to an authorised person at his choice.
The application shall include:
(a) identification of the manufacturer, i.e. for legal persons, the business name and registered office and, for natural persons, the name, surname and address. Where an application is submitted by an authorised representative or importer, it shall also contain their identification details,
(b) a written declaration that the same application has not been submitted to another authorised person;
(c) the technical documentation, the content of which is given in point 3;
(d) a sample of the production envisaged (hereinafter referred to as "type"), whereby the authorised person may request further samples if they are needed to carry out the test programme.
3. The technical documentation shall include data relating to the design, production and operation of the boiler necessary to assess the conformity of the boiler with the requirements of this Regulation and shall include:
(a) a general description of the type,
(b) design, production drawings, drawings of assemblies, sub-assemblies, circuits, necessary for conformity assessment;
(c) descriptions and explanations necessary for understanding the drawings and graphs and the operation (s) of the boiler;
(d) a list of harmonised Czech technical standards used in whole or in part and descriptions of the solutions adopted to meet the essential requirements where those standards have not been applied;
(e) the results of design calculations or tests carried out;
(f) checking protocols.
4. Authorised Person
4.1 It shall examine the technical documentation, verify that the type has been manufactured in accordance with this documentation, and identify the elements which have been designed in accordance with the relevant provisions of the technical standards referred to in Article 3 (5), as well as the components which have been designed without applying the relevant provisions of those standards.
4.2 It shall carry out or have the appropriate verifications and tests carried out to determine whether, where the technical standards referred to in Article 3 (5) have not been applied, the solution adopted by the manufacturer meets the essential requirements.
4.3. It shall carry out or have carried out the relevant verifications and tests necessary to determine whether they have actually been used where the application of the relevant technical standards has been chosen pursuant to Article 3 (5).
4.4 The manufacturer or importer shall agree with the place where the verification and the necessary tests are to be carried out.
5. Where the type complies with the relevant provisions of this Regulation, the authorised person shall issue a certificate to the manufacturer or, where appropriate, to the authorised representative or importer in accordance with Article 4 (2). This certificate shall contain the identification data of the manufacturer or importer, the test conclusions and the necessary data for the identification of the certified type. The certificate shall be accompanied by a list of the relevant part of the technical file, one copy of which shall remain with the authorised person.
If the authorised person refuses to issue a certificate to the manufacturer or, where appropriate, to the authorised representative or importer, he shall inform the manufacturer of the detailed reasons for the refusal and give him the opportunity to object to the refusal.
6. The applicant who owns the said technical documentation for the certified type shall inform the authorised person of any change to the boiler or component which requires additional approval. The additional approval shall be confirmed in the form of a supplement to the original certificate.
7. The manufacturer or, where appropriate, the authorised representative or importer shall, together with the technical documentation, keep copies of the certificates issued pursuant to Paragraph 4 (2) and their additions for at least 10 years after the date of the last manufacture of the product concerned.
9. The authorised person shall provide other relevant authorised persons and the Technical Standardisation, Metrology and State Testing Office (hereinafter referred to as "the Office ') with information on the certificates and additions they have issued and revoked. They shall also be made available, upon request, to them by the annexes to the certificates.

I. VERIFICATION OF CONFORMITY OF PRODUCTION WITH CERTAIN TYPE
(Paragraph 4 (1) (a) - Module C)
1. The verification of the conformity of the product with the certified type is a procedure whereby the manufacturer and, where appropriate, the authorised representative convince and declare that the boilers or components comply with the type described in the certificate issued in accordance with Article 4 (2) and meet the relevant requirements of this Regulation. The manufacturer or authorised representative shall place on each product the CE marking and issue a written declaration of conformity in accordance with the first sentence.
2. The manufacturer shall ensure all measures necessary for the production process to ensure compliance of the boilers or components produced with the type described in the certificate issued in accordance with § 4 (2) and with the essential requirements.
3. Authorised person, chosen by the manufacturer, shall carry out or have the product tested at random intervals. An appropriate sample of finished products randomly selected by an authorized person shall be tested and the relevant tests, as defined in the technical standards referred to in Article 3 (5), shall be carried out or equivalent tests shall be carried out to determine whether the products comply with the essential requirements. Where one or more samples of the products tested do not comply, the authorised person shall take the necessary measures (in particular, inform the manufacturer to prevent the placing on the market of the products).
II. ASSESSMENT OF THE PRODUCTION QUALITY SYSTEM
(Paragraph 4 (1) (b) - Module D)
1. Assessment of the production quality system is a procedure whereby the manufacturer or importer, meeting the provisions of point 2, is satisfied and declares that the boilers or their components are in conformity with the type described in the certificate issued in accordance with Section 4 (2) and comply with the requirements of this Regulation. The manufacturer shall place on each product the CE marking and draw up a declaration of conformity in accordance with the first sentence. The CE marking shall be accompanied by the identification number of the authorised person supervising the quality system referred to in point 4.
2. The manufacturer shall apply the production quality system referred to in point 3 and shall be supervised in accordance with point 4.
3. Quality system
3.1. The manufacturer shall submit an application for an assessment of his quality system for the boilers or components concerned, authorised by his choice. The application shall include:
(a) all necessary information on boilers and components,
(b) documentation of the quality system of production,
(c) technical documentation relating to the certified type and a copy of the type certificate issued pursuant to Article 4 (2).
3.2 The production quality system shall ensure compliance of boilers or components with the type described in the certificate issued in accordance with Section 4 (2) and with the requirements of this Regulation which apply to them.
All measures taken by the manufacturer shall be documented in a systematic and proper manner in the form of instructions, procedures and instructions. The quality system documentation shall allow a uniform interpretation of the programmes, plans, manuals and quality records. In particular, the documentation shall contain an adequate description of:
(a) the quality, organisational and responsibility objectives of the statutory bodies and their competence in relation to the quality of boilers or components;
(b) production, quality management and quality assurance procedures, other processes used and systematic activities;
(c) examinations and tests to be carried out at the pre-production, production and post-production stages, including their frequency;
(d) quality records such as inspection reports and test data, calibration data, qualification records of relevant personnel, etc.,
(e) means of monitoring whether the required quality of boilers or components and the effective functioning of the quality system have been achieved.
3.3 The authorised person shall assess the quality system for compliance with the requirements set out in section 3.2. The presumption of compliance with these requirements is fulfilled for quality systems which comply with the relevant technical standard referred to in Section 3 (5). The procedure shall also include an assessment at the manufacturer's workplace. The competent team of assessors shall have at least one member with experience in assessing the relevant production technology.
The authorised person shall transmit a report to the manufacturer or importer containing the results of the assessment relating to the boilers or components concerned and the reasoned decision on their approval.
3.4 The boiler or component manufacturer shall ensure that the obligations arising from the approved quality system are fulfilled and maintained in such a way that they remain adequate and effective.
The manufacturer or, where appropriate, the authorised representative or importer shall inform the authorised person who approved the quality system of any intended change in the quality system, e.g. as a result of new technologies and quality concepts.
The authorised person shall assess the proposed changes and decide whether the modified quality system will continue to comply with the requirements set out in section 3.2 or whether a new assessment is necessary. It shall notify the manufacturer or importer of its decision. This notification shall contain a reasoned conclusion of the assessment.
4. Supervision of the quality system
4.1 The purpose of supervision is to ensure that the manufacturer complies adequately with the obligations under the approved quality system.
4.2 For the purposes of supervision, the manufacturer shall allow the authorised person access to the premises of production, inspection, testing and storage of boilers or components and provide the necessary supporting documents, in particular:
(a) documentation of the quality system;
(b) quality documents, such as inspection reports and test results, calibration data, qualification data for relevant personnel, etc.
4.3 The authorised person shall carry out regular supervision, including on-the-spot assessments, to ensure that the producer of boilers or components maintains and uses the quality system and shall report to the manufacturer on the results of the supervision.
4.4 In addition, the authorised person may carry out unannounced surveillance with the manufacturer. During unannounced supervision, the authorised person may carry out tests or have them performed to verify the proper functioning of the quality system. The authorised person shall provide the manufacturer with a report on the results of the surveillance and, if he has carried out the tests, with a test report.
4.5. The manufacturer shall keep for at least 10 years after the date of the last manufacture of the product:
(a) the documents referred to in point 3.1;
(b) the update referred to in point 3.4;
(c) the notifications, protocols and reports of the authorised person referred to in the last paragraph of point 3.4 and points 4.3 and 4.4.
4.7 Each authorised person shall provide other competent authorised persons and the Office with information on documents relating to the quality system approval issued and cancelled.
III. ASSESSMENT OF THE PRODUCTION QUALITY SYSTEM
(Paragraph 4 (1) (c) - Module E)
1. Assessment of the product quality system is a procedure whereby a manufacturer or importer complying with the provisions of point 2 is satisfied and declares that the boilers or components are in conformity with the type described in the certificate issued in accordance with Article 4 (2) and meet the requirements of this Regulation. The manufacturer shall place on each boiler or component the CE marking and draw up a written declaration of conformity with the content according to the first sentence.
1.1 The CE marking shall be accompanied by the identification number of the authorised person carrying out the supervision referred to in point 4.
2. The manufacturer shall apply an approved quality system of inspection and testing of the finished boilers or components referred to in point 3 and shall be subject to the supervision referred to in point 4.
3. Quality system
3.1 The manufacturer or importer shall submit an application for assessment of his quality system for boilers or components authorised to the person at his choice and shall provide the authorised person with:
(a) any relevant information concerning boilers or components;
(b) documentation of the product quality system,
(c) technical documentation relating to the certified type and a copy of the type certificate issued pursuant to Article 4 (2).
3.2 Within the quality system, each boiler or component shall be tested according to the technical standards referred to in Section 3 (5) or equivalent tests shall be carried out to establish compliance with the essential requirements. All measures taken by the manufacturer shall be documented in a systematic and proper manner in the form of instructions, procedures and written instructions. The quality system documentation shall allow a uniform interpretation of the programmes, plans, manuals and quality records. In particular, the documentation shall contain an adequate description of:
(a) the quality objectives, organisational structure and responsibilities of the statutory bodies and their competence with regard to the quality of boilers or components;
(b) examinations and tests to be carried out after manufacture, other processes used and systematic activities;
(c) means of monitoring the effectiveness of the quality system;
(d) quality records such as inspection reports and test data, calibration data, qualification records of relevant personnel, etc.
3.3 The authorised person shall assess the quality system for compliance with the requirements set out in section 3.2. The presumption of conformity with these requirements is met for quality systems which comply with the relevant harmonised Czech technical standard. The competent team of assessors shall have at least one member with experience in assessing the relevant production technology. The procedure shall also include an assessment at the manufacturer's workplace.
The authorised person shall forward his decision to the manufacturer or importer, which shall include the results of the assessment relating to the boilers or components to which it relates, with an evaluation.
3.4 The manufacturer or authorised representative of the boiler or component shall ensure that the obligations arising from the approved quality system are fulfilled and maintained in such a way that they remain adequate and effective.
The manufacturer or authorised representative or importer shall inform the authorised person who assessed the quality system of any intended change in the quality system, e.g. as a result of new technologies and quality concepts.
The authorised person shall assess the proposed changes and decide whether the modified quality system will continue to comply with the requirements of point 3.2 or whether a new assessment is necessary. It shall notify the manufacturer or importer of its decision. This notification shall contain a reasoned conclusion of the assessment.
4. Supervision of the quality system
4.1 The purpose of supervision is to ensure that the manufacturer complies adequately with the obligations under the approved quality system.
4.2 For the purposes of supervision, the manufacturer shall allow the authorised person access to the premises of production, inspection, testing and storage of boilers or components and provide the necessary supporting documents, in particular:
(a) documentation of the quality system;
(b) technical documentation;
(c) quality documentation such as verification reports, test reports, calibration data, qualification data for relevant personnel, etc.
4.3 The authorised person shall carry out regular supervision, including on-the-spot assessments, to ensure that the boiler or component manufacturer maintains and uses the quality system and shall transmit to the manufacturer a report on the results of the supervision.
4.4 In addition, the authorised person may carry out unannounced surveillance with the manufacturer. During unannounced supervision, the authorised person may carry out tests or have them performed to verify the proper functioning of the quality system. The authorised person shall provide the manufacturer with a report on the results of the surveillance and, if he has carried out the tests, with a test report.
4.5 The manufacturer shall keep for at least 10 years after the date of the last production of the boiler or component:
(a) the documents referred to in point 3.1 (c);
(b) details of changes in accordance with the second paragraph of point 3.4;
(c) the notifications and protocols of the authorised person referred to in the third paragraph of point 3.4 and points 4.3 and 4.4.
4.7 Each authorised person shall provide other competent authorised persons or the Office with information on documents relating to the quality system approval issued and cancelled.

AUTORISATION CONDITIONS
The conditions of authorisation under Section 11 (2) of the Act are:
1. The Authorised Person, its Director and the staff responsible for carrying out the verification tests shall not be the designers, manufacturers, suppliers or installers carrying out the installation of boilers or components they verify, nor shall the authorised representatives of any of these Parties. They shall not participate directly or as authorised representatives in the design, manufacture, placing on the market or maintenance of such boilers and components. This shall not preclude the possibility of exchanging technical information between the manufacturer and the authorised person.
2. The Authorised Person and its staff shall carry out verification tests at the highest level of professionalism and competence and shall avoid any coercion and motivation, in particular financial ones, which could affect their assessment of the results of the checks, in particular for persons or groups of persons interested in the outcome of the verification.
3. The authorised person shall have at his disposal the necessary staff and own the necessary facilities to enable the administrative and technical tasks related to verification to be carried out properly; shall also have access to the equipment required for special verification.
4. The staff responsible for the inspection shall have:
(a) proper technical and professional training;
(b) satisfactory knowledge of the requirements of the tests they carry out and adequate experience for carrying out those tests;
(c) the ability to draw up certificates, records and protocols required to record the test course.
5. The authorised person shall ensure the impartiality of the control staff. Their remuneration shall not depend on the number of tests carried out or the results of such tests.
6. Maintaining the confidentiality of the authorised person's staff on all the facts they are aware of in the activities of the authorised person under this Regulation. This obligation shall not apply to competent national authorities.
7. The authorised person is obliged to take out liability insurance (Section 11 (3) of the Act).
