amending and supplementing Decree No. 104 / 1964 Coll., implementing the Act on Social Security of Cooperative Farmers, as amended by Decree No. 142 / 1965 Coll., No. 117 / 1967 Coll. and No. 92 / 1968 Coll.
The Ministry of Labour and Social Affairs shall, in agreement with the Ministry of Agriculture and Nutrition, with the Central Council of Trade Unions and other participating central bodies pursuant to § 144 of Act No. 103 / 1964 Coll., on Social Security of Cooperative Farmers, as amended by Acts No. 141 / 1965 Coll., No. 116 / 1967 Coll., No. 89 / 1968 Coll. and No. 161 / 1968 Coll. ("the Act '):
Decree of the State Social Security Office No. 104 / 1964 Coll., implementing the Act on Social Security of Cooperative Farmers, as amended by Decree No. 142 / 1965 Coll., No. 117 / 1967 Coll. and No. 92 / 1968 Coll., is amended as follows:
1. Article 1 (1) (b) reads as follows:
"(b) the premiums granted by the cooperative's operating resources as part of the remuneration and share of the cooperative's economic performance; other premiums to the extent specified by the Ministry of Labour and Social Affairs, ';
Article 43 (1) (b) reads as follows:
"(b) the premiums granted by the cooperative's operating resources as part of the remuneration and share of the cooperative's economic performance; other premiums to the extent specified by the Ministry of Labour and Social Affairs, ';
In the same paragraph, the following sentence is added at the end:
"Part of the cooperative's contribution to the partial reimbursement of social security costs shall also be considered as part of the income from the work; that part shall be 11,2% between 1 January 1964 and 31 December 1967 and from 1 January 1968 12,5% of the total of the cooperative's occupational income referred to in points (a) to (f). ';
3. The following Section 47a is inserted after Section 47:
Pension as the main source of nutrition
On § 47 (4), § 48 (3), § 58 (4), § 59 (5), § 66 (3) and § 137a of the Law
As a general rule, retirement is considered to be the main source of nutrition for a pensioner if his other income does not amount to more than 200 CZK per month, and if a pensioner's family member is also dependent on the pension, more than 400 CZK per month. The income of a pensioner or his family member shall not be taken into account if those persons are over 70 years of age. ';
4.
Article 54 and Article 74e (6) of the Law
If a fully (partly) disabled member of the resistance who has suffered health damage as a result of participation in the resistance (imprisonment or internment for reasons of fascist persecution in a period of non-freedom), it shall be assumed that the full (partial) disability has arisen in connection with the resistance activity (imprisonment, intervention), unless this connection is excluded by the nature of the case. ';
5. Paragraphs 57 (3) and 60 (4) change the age of the child from 25 to 26 years.
This Decree shall take effect on 1 January 1969.
