Decree of the State Planning Commission on Reducing Fuel and Energy Funds

DECLARATION
State Planning Commission
of 9 February 1988
on the reduction of fuel and energy funds
State Planning Commission pursuant to § 17 (4) of Act No. 145 / 1970 Coll., on National Economic Planning, states:
(1) This decree regulates the procedure for reducing fuel and energy supply funds set out in the breakdown of the plan for the inefficient use of fuels and energy identified by the State Energy Inspection Authorities in carrying out checks under specific regulations. 1)
(2) The non-economic use of fuels and energy shall be considered as cases in which the authorities of the State Energy Inspection will identify deficiencies in the energy economy affecting the level of fuel and energy consumption and impose a fine on the organisation under the State Energy Inspection Act (2).
(3) For the purposes of this Decree, fuels and energy are:
(a) black energy coal;
(b) black coking coal;
(c) brown coal, lignite and brown-coal briquettes;
(d) coke;
(e) natural carbon and diesel gas;
(f) lamp gas,
(g) light heating oils;
(h) fuel oil M and S,
(i) low sulphur fuel oil TD and M;
(j) electrical energy;
(k) other fuels and energy produced (reworked) from fuels referred to in paragraph 3 (a) to (j).
(1) The State Energy Inspection Authority shall notify the fund holder and the balance sheet gestor of the relevant fuel or energe.3)
(2) The assessment of the degree of inefficiency for fuels and energy referred to in Article 1 (3) (a) to (j) shall be carried out in the units of measurement of those fuels and energy. For other fuels referred to in § 1 (3) (k), the extent of inefficiency shall be evaluated by calculating the necessary fuel and energy needs referred to in § 1 (3) (a) to (j) for their production (reprocessing) within the organisation.
(1) On the basis of the notification referred to in Article 2 (1), the holder of the fondu4 shall, within 30 days of receipt of the notification referred to in Article 2 (1), ensure that an adjustment to the plan schedule is made to the extent found to be inefficient until the delivery funds of an organisation where fuel or energy has been inefficient and the modifications made are communicated to the supplier of the fuel or energy concerned.
(2) Appropriate adjustments shall be made to:
(a) the breakdown of the implementation plan for the year in which the fine for the inefficient use of fuels and energy was imposed;
(b) in the following years, in the schedule of the 8th Five-Year Plan.
(3) With the amount of fuel or energy by which the supply fund is reduced, the fund holder shall have as a reserve. 5) The reserve cannot be used for the benefit of an organisation for which the uneconomical use of fuels and energy has been found.
(4) On the basis of an adjustment to the schedule referred to in paragraph 1, organisations shall undertake to amend their commitments. 6) Where the customer organisation is simultaneously a supplier of fuels and energy to other organisations or populations, it shall not transfer to them the reduction of its supply funds.
This Decree shall take effect on 1 April 1988 and shall apply until 31 December 1990.
