Regulation establishing the Ministry of Buying

Government Regulation
of 27 May 1952
setting up the Ministry of Purchase.
The Government of the Czechoslovak Republic orders, with the consent of the President of the Republic, pursuant to § 1 of the Constitutional Act No. 47 / 1950 Coll., on adaptations to the organisation of public administration and under § 42 (1) of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
§ 1.
In order to ensure uniform management and successful implementation of the purchase of agricultural products and to ensure timely and complete compliance with the supply of the State and thus ensure the supply of the population and the expansion of the raw material base for industry, the Ministry of Purchase is hereby established.
§ 2.
The Ministry of Buying manages and organises the purchase of all agricultural products by state and cooperative organisations.
§ 3.
(1) The Ministry of Purchase is responsible in particular for:
1. draw up proposals for a comprehensive plan for buying-in, buying-in prices, quality standards and conditions for buying-in of agricultural products, as well as proposals for the amount of the costs of buying-in of agricultural products;
2. submit to the Government for approval proposals for measures taken in the buyout and in the supply of the State;
3. implement measures to consolidate state discipline in the purchase and supply of the State;
4. ensure and control the purchase of agricultural products.
(2) In order to ensure the buyout of agricultural products, the Ministry of Buying may issue both general legislation and orders for individual cases.
§ 4.
The Ministry of Buying may suspend the enforcement of decisions by other authorities if they are contrary to the rules on supply and redemption.
§ 5.
(1) The Ministry of Buying shall carry out its tasks directly or by its authorities:
(a) Minister of Buying for Slovakia,
(b) County officers of the Ministry of Buying;
(c) district officers of the Ministry of Purchase.
(2) The Government appoints the full power of the Ministry of Purchase for Slovakia.
(3) The full powers of the Ministry of Buying are independent of national committees in their activities; in carrying out their tasks, they shall rely on the assistance of the national committees. The full powers of the Ministry of Buying and the National Committees are obliged to cooperate closely with each other.
(4) A closer definition of the tasks between the national committees and experts of the Ministry of Purchase in the procurement of the buyout is laid down in specific provisions.
§ 6.
The Ministry of Buying shall take over, store and process agricultural products within the limits laid down by the Government; to that end, the buyout minister may set up national undertakings in his field of activity in agreement with the finance minister. The establishment of these enterprises and their legal situation is subject to Act No. 103 / 1950 Coll., on National Industrial Enterprises.
§ 7.
The Organisation of the Ministry of Redemption and its closer regulation as well as its bodies shall adapt the Statute of the Ministry of Redemption, as determined by the Government. The government shall also define to what extent the buying-in provisions apply to breeding animals of the bovine, seed and lard species.
§ 8.
In agreement with the relevant ministries, the Ministry of Purchase will take over the necessary number of employees of the ministries of internal trade and food industry, the mandates of trade and food industry and the staff of national committees.
§ 9.
This Regulation shall enter into force on the day of its publication; All members of the government will do it.
