of 18 June 2019
amending Act No. 634 / 1992 Coll., on Consumer Protection, as amended
Parliament has decided on this law of the Czech Republic:

1. in Article 1 (1), the words "European Union31), 32), 36)" are replaced by the words "European Union48";
footnote 48:
"48) Regulation (EC) No 765 / 2008 of the European Parliament and of the Council of 9 July 2008 laying down requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation (EEC) No 339 / 93. Regulation (EU) No 1007 / 2011 of the European Parliament and of the Council of 27 September 2011 on textile fibre names and related labelling of the material composition of textile products and repealing Council Directive 73 / 44 / EEC and Directives 96 / 73 / EC and 2008 / 121 / EC of the European Parliament and of the Council. 2. In Article 20l, the following paragraph 3 is added, including footnote 49:
"(3) The European Consumer Centre, the Czech Republic, provides the consumer with practical assistance in the event of a dispute with a trader arising as a result of the application of the directly applicable regulation of the European Union governing the unauthorised geographical blocking (49).
49) Regulation (EU) 2018 / 302. '
3. Paragraph 23 (11) reads as follows:
"(11) The Energy Regulatory Authority shall supervise on the energy sector business section compliance with the obligations set out in Sections 4 to 6, 12 and 14 and by a directly applicable European Union regulation regulating unauthorised geographical blocking 49)."
4. In Article 23 (16), the words "and directly applicable European Union regulation governing unauthorised geographical blocking 49 'shall be inserted after the word" the law'.
5. In Article 23, paragraph 20 is added:
"(20) The Czech Trade Inspection Centre shall supervise compliance with the obligations laid down by the directly applicable European Union regulation governing unauthorised geographical blocking 49)."
6. Paragraph 24 (8) reads as follows:
"(8) The seller commits an offence by:
(a) in breach of Article 23a (6), it shall not, without undue delay or within a time limit set by the supervisory authority, inform the manufacturer, importer or supplier that the product is withdrawn from the market by decision of the supervisory authority;
(b) without delay, contrary to Article 23a (6), ensure that the product which is dangerous is returned by its interchangeability with food;
(c) in contravention of Article 23a (6), does not inform the supervisory authority of the return or re-take of the withdrawn product; or
(d) infringes or infringes any of the prohibitions provided for in Article 3, 4 or 5 of the directly applicable European Union regulation governing unauthorised geographical blocking (49). ';
7. In Article 24 (14), the words "and paragraph 8 (d) 'shall be added at the end of the text in point (c).
8. In Article 24 (14), the text "(a), (b), (c) 'is added at the end of the text in point (e).
Efficacy
This Act shall take effect on the day of its publication.
