DECLARATION

amending and supplementing Federal Ministry of Interior Decree 119 / 1984 Coll., implementing the Civil ID Act
The Federal Ministry of the Interior, in agreement with the participating central authorities, provides, pursuant to § 2 and 13 of Act No. 75 / 1957 Coll., on Civil Documents:
Decree No. 119 / 1984 Coll., implementing the Civil ID Act, is amended as follows:
1.
(1) A citizen who applies for the issue of his first identity card in the calendar year in which he reaches the age of 15 must submit:
(a) birth certificate;
(b) two sharp, non-retreaded, non-woven black and white photographs made of the same negative on a smooth, shiny half-carton with a diameter of 3,5 × 4,5 cm, of which the lower white edge is 0,5 cm wide, showing the citizen in a three-quarter profile, in civil clothing, without headgear and without glasses with dark glasses, height of the face part of the head (from the eyes to the chin) at least 13 mm (hereinafter referred to as "photographs"),
(c) proof of birth number, (1) if the birth number is not indicated on the birth certificate.
(2) A citizen who applies for the issue of his first identity card after returning his / her legal capacity shall submit:
(a) birth certificate (birth certificate and birth certificate),
(b) two photographs;
(c) a decision by the court on the return of eligibility to legal acts provided for in the rule of law;
(d) proof of the birth number if the birth number is not indicated on another document submitted.
(3) A citizen who applies for the issue of his first identity card after obtaining Czechoslovak citizenship or his permanent residence abroad is obliged to submit:
(a) birth certificate (birth certificate and birth certificate),
(b) two photographs;
(c) proof of grounds for issuing a citizen's card (e.g. proof of Czechoslovak citizenship),
(d) a document of the status (marriage certificate, court decision on divorce of a marriage or a declaration of invalidity, accompanied by a clause of legal authority, a death certificate of the spouse or a decision of the court on the declaration of the spouse's death provided by a legal instrument), if the citizen is married, divorced or widowed,
(e) birth certificates of children (adopted) under the age of 15 (hereinafter referred to as "children"), if they are parents or adopters,
(f) proof of the birth number and, if married, proof of the birth number and place of birth of the spouse, provided that such information is not shown on another document submitted '.
2.
(1) When applying for a new identity card, the citizen is obliged to present his current identity card and two photographs.
(2) If a citizen applies for a new identity card and cannot present the current identity card, although it has already been issued to him, he shall submit:
(a) a certificate of surrender, loss or theft of the identity card;
(b) two photographs;
(c) a certificate of the last working or similar relationship or, where appropriate, a Member's relationship with the production cooperative or the single agricultural cooperative (hereinafter referred to as the "employment relationship") or, where applicable, the termination within the last 12 months; the certificate shall not be more than seven working days old. A citizen who is not in employment but is a student, carries out as his main occupation an activity which he has been authorised by the National Committee; (2) is engaged in a free occupation or a pensioner; he is obliged to submit a document confirming that fact (confirmation of the school, national committee, cultural fund or artistic agency, or artistic union, decision to grant a pension); a household citizen confirms this by written declaration.
(3) A citizen who has been refunded to legal proceedings is required to submit, in addition to two photographs, a decision by the court to return to legal proceedings provided for in the rule of law.
(4) If a citizen applies for a new identity card after the termination of his permanent residence abroad, he shall submit, in addition to two photographs, a certificate of surrender of a travel document authorising him to stay abroad and, if a man older than 19 years, also a card of goal, a military book, a release note or a certificate of incapacity for military active service for consultation and copying of relevant data.
(5) In addition to the documents referred to in paragraph 1 or, where appropriate, in paragraphs 2, 3 or 4, a citizen is required to submit:
(a) the birth certificate (birth certificate and birth certificate), if it had no parent details on the current identity card or if it had an existing identity card issued after the change of surname and no surname on it;
(b) the marriage certificate and, where applicable, the proof of the spouse's birth number if he is married and has not had on the current identity card details of the spouse (name, surname, surname, birth number and place of birth);
(c) proof of the birth number, if the birth number did not appear on the current identity card and does not appear on another document presented,
(d) proof of the birth number of the children, if they did not appear on the current identity card.
(6) If the reason for the issue of a new identity card is a change in the surname, name or birth number, or if a citizen simultaneously requests the identification of a new identity card, he shall also be required to provide proof of that change or a document confirming a new entry.
(7) If, when issuing a new citizenship card, a citizen simultaneously applies for the registration of a university graduate who did not have a degree in his current citizenship card, he is required to submit proof of such a degree (e.g. diploma, proof of the composition of a rigid examination). When two or more titles are obtained, only one of these titles is recorded before the citizen's surname; the remaining titles shall be entered under the heading "Special Records" at the request of the citizen. ';

(1) Soldiers in the occupation of the Czechoslovak People's Army who apply for the issue of an identity card at the time of termination of service are required to submit a passport to the General, Officer or Ensign of the Czechoslovak People's Army for consultation and copying of relevant data; At the same time, they shall be required to submit a document proving the termination of their duties and two photographs.
(2) If the citizens referred to in paragraph 1 are unable to submit the personal ID of the General, Officer or Ensign of the Czechoslovak People's Army, if they do not have all the necessary information in those cards, or if they are asking for the entry of further information (e.g. educational experience), they shall be required to submit all necessary documents proving the facts which are the subject of the ID. ';

(1) At the invitation of the district administration of the National Security Corps, a citizen is required to submit evidence of Czechoslovak citizenship if there is doubt about his citizenship. 3)
(2) Instead of a matrix document issued by an authority of a foreign state, a citizen is obliged to submit an extract of a special matrix; 4) an extract of the matrix to be used abroad cannot be presented. 5)
(3) At the invitation of the district administration of the National Security Corps, a citizen is obliged to submit, together with the decision of the foreign court, a decision of the Supreme Court of the Czechoslovak Socialist Republic on the recognition of the ruling of the foreign court in the territory of the Czechoslovak Socialist Republic, if that recognition is required under the law.6). "
5.
(1) The documents must be presented in an original or certified copy (certified photocopy). In the case of foreign language documents, the citizen is obliged to submit a certified translation into the Czech or Slovak language at the invitation of the Regional Administration of the National Security Corps.
(2) If doubts arise as to the accuracy or completeness of the documents or the particulars mentioned therein, the citizen is obliged to submit a new document at the request of the district administration of the National Security Corps.
(3) The documents required for the issue of the identity card may be presented by a person close to him or living with him or his authorised representative for the citizen requesting it.
(4) The citizen is obliged to take over the ID in person and to confirm the accuracy of the information contained in it by signing it. The district administration of the National Security Department shall return the documents submitted to the citizen when the identity card is transferred, with the exception of the current identity card and the certificate of surrender, loss or theft of the identity card; employment certificates issued by organisations for the purpose of issuing a new identity card shall be returned at the request of citizens. ';
6.
(1) When issuing the identity card, the district administration of the National Security Corps records the data on the basis of pre-printed sections on the basis of the documents submitted.
(2) Upon receipt of the identity card, the citizen shall be required to submit it to the competent national health institute for the registration of vaccination - re-vaccination against tetanus or for the verification of such an alert if he has undergone such vaccination.
(3) Upon receipt of the first ID or ID issued after the return of legal capacity or residence abroad, the citizen shall immediately submit it to the school for registration as a school or a daily study or organisation for registration as a work relationship (7) or to the national committee for a record of his principal occupation in the activity allowed by the national committee. ';
7. Article 9 (1) (c) reads as follows:
"(c) to present at birth, adoption, death, revocation of adoption or change of surname, name or birth number of the children, together with the relevant document to the national committee responsible for the registration of this fact,"
8. Paragraph 9 shall be added to paragraph 3:
"(3) When changing the military ratio, the citizen is obliged to ask the district (district) military administration to indicate the change. At the request of the citizen, the district administration of the National Security Corps will also mark this change upon presentation of a goal card, a military book, a release note or a certificate of incompetence for military active service. In the case of a withdrawal procedure, the change in the military ratio may be indicated in the identity card of the commission. ';
9. In Section 10, the words in brackets are replaced by the words "(for example, data on educational attainment, the title of university graduate, scientific degrees) '.
10. Paragraph 12 (1) (b) (2) reads as follows:
'2. Birth (adoption), death (cancellation of adoption) or change of surname, name or birth number of children, ';
This Decree shall take effect on 1 December 1988.
