DECLARATION
of 24 May 2012
amending Decree No. 266 / 1999 of the Ministry of Defence Coll., on the method of providing free meals, equipment and transport equipment and on the accommodation of professional soldiers, as amended
According to § 93 of Act No. 221 / 1999 Coll., on Professional Soldiers, as amended by Act No. 122 / 2012 Coll.:
Decree of the Ministry of Defence No. 266 / 1999 Coll., on the method of providing free meals, equipment and transport equipment and on the accommodation of professional soldiers, as amended by Decree No. 456 / 2002 Coll., Decree No. 69 / 2008 Coll., Decree No. 334 / 2008 Coll. and Decree No. 290 / 2010 Coll., is amended as follows:
1. in the second sentence of Article 4 (1) (g), the word 'Food' shall be replaced by 'Free meals';
2. Paragraph 14 (3) and (4) are deleted.
Paragraphs 5 to 8 shall be renumbered paragraphs 3 to 6.
3. In Paragraph 14 (3), the words "according to the duration of the service issue military equipment referred to in paragraph 3 or 4 'are replaced by the words" military equipment referred to in paragraph 1'.
4. Paragraph 14 (6) is deleted.
5. In Article 15 (2), the words "equipment material and its acquisition costs' are replaced by" military equipment components and the amount of their acquisition costs'.
6. In Paragraph 17 (1) (d), the words "the expiry of a specified duration of service, the termination of service, the withdrawal of rank or the loss of military rank by decision of the court, death of a soldier or his declaration of death 'are replaced by the words" pursuant to § 18 of Act No. 221 / 1999 Coll.';
7. In Article 17, the following paragraph 4 is added:
"(4) Unused military equipment shall be considered as unused military equipment for the payment of the refund in cash referred to in paragraph 1 or 2, provided that the military equipment is secured to the soldier in accordance with Section 15, by assigning orders for the issue of military equipment belonging to the soldier in the last 12 calendar months. ';
8. After Paragraph 17, the following Section 17a is inserted:
Cash cost of military equipment
The monthly cost of military equipment for the purposes laid down in § 91 (2) of Act No. 221 / 1999 Coll. in the trial period is CZK 250. At the end of the probationary period, these costs shall be:
a) for professional soldier 1,400 CZK,
(b) for a professional soldier serving at the Military Office of the President of the Republic, CZK 2,700,
(c) for a professional soldier serving at the Castle Guard, CZK 2,800. "
Efficacy
This Decree shall take effect on 1 June 2012.
