DECLARATION
of 8 April 2004
amending Decree No 31 / 2001 Coll., on driving licences and on the register of drivers, as amended by Decree No 154 / 2003 Coll.
According to Section 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll. and Act No. 53 / 2004 Coll., ("the Act '), the Ministry of Transport provides for the implementation of § 104 (5), § 109 (10), § 110 (6), § 111 (9), § 115 (8) and § 122b of the Act:
Decree No. 31 / 2001 Coll., on driving licences and on the register of drivers, as amended by Decree No. 154 / 2003 Coll., is amended as follows:
1. Paragraph 1, including the title and footnote 1, reads:
Czech driving licence
(1) The driving licence of the Czech Republic (hereinafter referred to as the "driving licence") is a document measuring 54 x 86 mm.
(2) The individual information on the driving licence referred to in paragraph 4 shall be given in the Czech language, in the letters of the Latin alphabet, except for the signature of the holder of the driving licence, which shall be drawn up by the applicant's own hand.
(3) The front of the driving licence referred to in paragraph 1 shall show:
(a) the inscription "Czech Republic,"
b) the distinguishing mark of the Czech Republic "CZ," printed in white in blue rectangle, which is placed in a circle of twelve yellow stars,
(c) a sign in the Czech language, in capital letters,
(d) the inscription "Model of the European Communities" in the Czech language and the words "driving licence" in the languages of the other Member States of the European Communities (hereinafter referred to as "Member State"), which are printed in pink and form the basis of the front of the driving licence.
(4) The front of the driving licence referred to in paragraph 1 shall bear the following particulars under the code numbers:
1. the last name of the licence holder,
2. the name and, where applicable, the name and title of the holder of the driving licence,
3. the date and place of birth of the holder of the driving licence;
4a. the date of issue of the driving licence,
4b. the date of validity of the driving licence,
4c. the name of the office which issued the driving licence (hereinafter referred to as the issuing authority),
4d. the natural number of the holder of the driving licence, if any,
5th series and driving licence number,
6. photograph or other form taken by the holder of the licence, 1)
7. signature of the holder of the licence,
8. the municipality of permanent residence of the holder of a driving licence (hereinafter referred to as "the municipality of residence"),
9. Groups and subcategories of driving licences which are certified by the holder.
(5) The following information shall appear on the back of the driving licence referred to in paragraph 1 under the code numbers:
9. Groups and subcategories of driving licences,
10. Date of first issue of a group or subgroup of driving licences; that date shall be indicated on each driving licence newly issued to its holder for exchange of a driving licence or on a duplicate of a driving licence issued for loss, theft, damage or destruction of a driving licence;
11. the expiry date of the group or subgroup of driving licences (hereinafter referred to as "the date of validity of the RID"),
12. a record of the suspension or restriction of a driving licence referred to in the harmonisation code referred to in Article 11 (hereinafter referred to as "the harmonisation code") and the national harmonisation code referred to in Article 11a (hereinafter referred to as "the national harmonisation code";
13. recording of information relevant to the management of the driving licence by the host Member State (hereinafter referred to as "the restriction of the RIA"),
14. other records.
(6) A space for the data chip shall be reserved on the back of the driving licence referred to in paragraph 1.
(7) The issue date of the driving licence referred to in paragraph 4, code number 4a shall be indicated as the date of the application for the driving licence (§ 12).
(8) The driving licence shall be valid for 10 years from the date of issue unless its validity is limited to a shorter period due to a time limitation of medical fitness under the law.
(9) The model of the driving licence is set out in Annex 1.
1) Decree No. 177 / 2000 Coll., implementing the Act on the Registration of Citizens, the Act on Civil Documents and the Act on Travel Documents, as amended by Decree No. 192 / 2001 Coll., Decree No. 248 / 2001 Coll. and Decree No. 543 / 2002 Coll. '.
2. In Article 10, in the title, paragraph 1 and paragraph 7, "II 'is replaced by" Ia'.
3. Paragraph 10 (2) reads as follows:
"(2) The individual particulars in the driving licence referred to in paragraph 1 shall be indicated in the language (s) of the Member State which issued the driving licence in the letters of the Latin alphabet, except for the signature. ';
4. in Paragraph 10 (3) (b):
"(b) the distinguishing mark of the Member State which issued the driving licence, printed in white in a blue rectangle situated in a circle of twelve yellow stars,"
5. In Paragraph 10 (3), the dot at the end of point (c) is replaced by a comma and the following point (d) is added:
"(d) the words" Model European Communities "in the language or languages of the Member State which issued the driving licence and the words" driving licence "in the other languages of the Member States."
6. Paragraph 10 (7) reads as follows:
"(7) The model driving licence of the European Communities Ia shall apply mutatis mutandis to the model driving licence set out in Annex 1. The distinguishing marks of the Member States referred to in paragraph 3 (b) and the words" driving licence "in the languages of the Member States referred to in paragraph 3 (d) are given in Annex 6. ';
7. In the introductory sentence of Section 11, the term "II 'is replaced by" Ia' and the words "may indicate 'are replaced by the words" indicate'.
8. in Article 11 (a), the harmonisation code 02 reads:
"02. Hearing aids / communication aids
02.01 Hearing aids for one ear,
02.02 Hearing aids for both ears. '
9. In Section 11, the harmonisation code "05.08 Prohibition of drunk driving 'is added at the end of point (a).
10. in Article 11 (c), in Harmonisation Code 71, the number "70.987654321" is replaced by "71.987654321."
11. after Article 11, the following Section 11a is inserted:
National harmonisation codes
The national harmonisation codes shall be indicated in the driving licence referred to in Article 1 (5) (12), which shall indicate:
105. Other health restrictions not listed in Section 11.
111. Unable to perform:
(a) a driver driving a motor vehicle in an employment relationship and for whom driving a motor vehicle is a type of work agreed in the employment contract;
(b) a driver in respect of whom the driving of a motor vehicle is the subject of a self-employed activity carried out under a special legislation, 3)
(c) teacher of training in motor vehicle driving under special legislation (4)

150. Restrictions on category A1 to 50 cm3.
172. Restriction of the driving licence of the group And only to drive a wheelchair for disabled people.
175. Restriction of driving licence group D only for driving a public road vehicle.

12. in Article 12 (1):
"(1) The driving licence shall be issued by the municipal authority of the municipality with extended competence on application for a driving licence. '.
13. in Paragraph 12 (3):
"(3) The model of the application for a driving licence is set out in Annex 7 and the model of the application for an international driving licence is set out in Annex 7a. ';
14. in Paragraph 13 (1), the words "and connections" shall be deleted;
15. In Paragraph 14, the words "or he has been given a driving licence because of the imposition of a penalty or a ban on the activity of prohibiting the driving of motor vehicles' shall be added at the end of paragraph 4.

Confirmation of loss, theft, damage or destruction of a driving licence
(1) The certificate of notification of loss, theft, damage or destruction of a driving licence (hereinafter referred to as "notification certificate") is a document of pink colour with dimensions of 105 x 74 mm, including transparent packaging. The certificate of notification and the transparent packaging shall contain protective features.
(2) On the front side of the notification certificate in the upper left corner there is a rectangle of blue colour 14 x 10 mm in which the ellipse is located. Within the ellipse are listed capital letters CZ. In addition to the blue rectangle, the inscription "RIGHTS 'appears in capital letters in blue and under it also in capital letters the inscription" PERMIS DE CONDUIRE' in blue and the inscription "CZECH REPUBLIC 'in pink. The identification of the code numbers referred to in paragraph 3 shall be in blue. The designation of the number and series of notifications shall be in red.
(3) The following information on the holder of the notification certificate shall be entered under the code numbers on the front page of the notification certificate:
1st surname,
2. name and title, if any,
3. date and place of birth,
4a. the date of issue of the notification certificate, the date of loss, theft, damage or destruction of the driving licence;
4b. date of validity,
4c. the name, registered office and stamp of the office issuing the notification certificate;
4 d. birth number, if assigned,
5th series and notification confirmation number,
6. CERTIFICATE OF NOTIFICATION OF LOSS, DESIGNATION, INJURY OR DEROGATION OF THE RIGHTING INSTALLATION,
7. signature of the holder,
8. the municipality of residence,
9. Group or subgroup of driving licences granted.
(4) The following information is given on the back of the notification certificate under the code numbers which are brown colours:
9. Groups and subcategories of driving licences,
10. Date of first grant of a group or subgroup of driving licences,
11. Date of restriction of the group or subgroup of driving licence or loss of validity;
12. harmonisation codes pursuant to Sections 11 and 11a,
13. records of suspension or restriction of a driving licence;
14. other records.
(5) The individual particulars in the notification certificate shall appear in black and shall be typed in the letters of the Latin alphabet, except for the signature of the holder of the notification certificate, which shall be drawn up by the applicant's own hand for the issue of the notification certificate.
(6) The date of validity of the notification certificate under code 4b shall be entered for a maximum period of 30 days from the date of issue of the notification certificate under code 4a.
(7) The words "PAYMENT ONLY IN THE TERRITORY OF THE CZECH REPUBLIC" shall always be entered in the other entries referred to in paragraph 4 of the Code 14.
(8) The model of the notification certificate is set out in Annex 9.
5) Article 105 (3) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws. "
17. in Article 17 (3) (b):
"(b) an application for a driving licence;"
18. in Article 17 (3), the following point (c) is inserted after point (b):
"(c) an application for an international driving licence;"
Points (c) to (j) shall be renumbered (d) to (k).

Transitional provisions
(1) Confirmation of the loss, theft, damage or destruction of a driving licence or an international driving licence issued before the date of application of this Order shall be valid until the period indicated therein.
(2) The forms of application for a driving licence and an international driving licence valid before the date of application of this Order may be used to submit an application for an international driving licence until the stocks of such forms are exhausted, but no later than 31 December 2009.
Efficacy
This Decree shall take effect on 1 May 2004.
