The Ministry of Labour and Social Affairs provides according to § 177a of Act No. 100 / 1988 Coll., on Social Security, as amended by the Act of the Czech National Council No. 37 / 1993 Coll.:

Article 12 (2) reads as follows:
"(2) The gross earnings for each single full calendar year for determining the five best-earned calendar years shall be the sum of the earnings referred to in Sections 11 (1) and (2) and 11 (a) which shall be deductible in that year. Where the periods referred to in paragraph 7 are excluded in the calendar year, the sum of the earnings referred to in paragraphs 1 and 11a (1) shall be adjusted proportionally according to the length of those periods. ';
Article 19 (5) reads as follows:
"(5) The comparable earnings shall be determined as the product of the average monthly earnings from which the partial invalidity pension is calculated but unlimited in accordance with Paragraph 12 (6) of the Act and the conversion rate. If a citizen is partially disabled at the time of preparation for employment, comparable earnings shall be established as the product of the monthly average of the gross earnings earned by the workers in the employment for which the citizen was preparing during the period before the pension was granted and the conversion rate. The conversion rate shall be determined by the number of years of pension payment; is 1,25 for one year of pension, 1,44 for two years of pension, 1,58 for three years of pension and 1,58 for each subsequent year of pension, the conversion rate shall be multiplied by 1,02. The payment of a pension shall mean the payment of a partial invalidity pension and also the payment of an invalidity pension where the citizen, immediately before the granting of a partial invalidity pension, has benefited from an invalidity pension if the partial invalidity pension has been calculated from the same average monthly earnings as the invalidity pension. ';
3. In Paragraph 19 (8), the words "assessment base87) 'are replaced by the words" one twelfth per calendar month of the assessment basis for determining premiums or the monthly assessment basis for setting advance payments for premiums'.
4. in Article 24 (1) (a), the words "combined studies" shall be replaced by the words "and combined studies, where the child is employed or otherwise employed at the time of such studies, or receives physical security for jobseekers,";
5. In Paragraph 169, paragraph 1 is replaced by the following: "Before 1 January 1993 'and paragraph 2 is inserted after paragraph 1:
"(2) Paragraph 11a shall apply mutatis mutandis to the determination of the gross earnings of the professional soldier after 31 December 1992. '
Paragraph 2 shall become paragraph 3 and paragraph 3 shall be deleted.
This Decree shall take effect on 1 July 1993.
