Law on the organisation of working time in bakeries

on the adjustment of working time in bakeries.
The Constitutional National Assembly of the Czechoslovak Republic decided on this law:
§ 1.
(1) Unless otherwise specified, no one shall work in bakeries between 22 and 6 hours.
(2) Bakeries referred to in paragraph 1 shall also include, in particular, industrial and craft bakeries, including mill and cooperative bakeries and bakery departments, attached to other plants, private or public institutes.
§ 2.
(1) The prohibition in Article 1 does not apply to preparatory work.
(2) The preparatory work referred to in paragraph 1 shall mean the heating in kilns and the work required to prepare the dough, including its balancing (cuts), for the manufacture of white pastries.
(3) The preparatory work may not be started in the manufacture of white pastries until at least 3 o'clock and in the manufacture of bread until midnight.
(4) The Minister of Social Welfare may, by decree in the Official Journal, also in the Official Journal of Slovakia, determine the maximum permissible number of employees who may be employed by preparatory work from midnight, after the case from 3: 00 to 6: 00.
(5) Preparatory work at night (paragraph 4) may not be employed by male workers under 18 years of age and women. The exception is permitted for apprentices under 18 years of age in the last six months of teaching to be trained by preparatory work, but only until more shifts are worked in the bakery.
§ 3.
(1) If the public interest so requires, the Minister of Social Welfare may, in agreement with the Minister of Nutrition, allow derogations from the prohibition provided for in Paragraph 1 for a transitional period of time, after hearing the participating interest organisations of workers and employers involved, for the whole bakery groups or for individual bakery establishments with more than 50 employees.
(2) After hearing the participating employees' and employers' interest organisations, the County Labour Protection Office may, for a transitional period, grant derogations from the prohibition provided for in Article 1:
(a) if the necessary repair of the operating equipment which cannot be carried out without interruption of the regular production or the failure in the regular production caused by such repair is necessary, or
(b) where this is required by the public interest in respect of bakeries with a maximum of 50 employees; or
(c) if there are bakeries working for the needs of military administration.
(3) Where a derogation has been granted pursuant to paragraphs 1 or 2, its scope shall also be determined.
§ 4.
For holiday work, held between 22am and 6pm, contained in § § § § 2 and § 3, the staff member shall have an allowance for night work according to the corresponding salary adjustment.
§ 5.
(1) Supervision of the implementation of the provisions of this law and of the provisions laid down by it is the responsibility of the Ministry of Social Welfare, which also carries out it through the Regional Labour Protection Offices. The local authorities of the National Security Corps shall, at their request, assist in the exercise of oversight.
(2) The supervisory persons and authorities referred to in paragraph 1 are entitled to conduct at any time the inspection of the operating rooms of the bakery to the extent strictly necessary for the exercise of supervision (paragraph 1). In doing so, they are obliged to observe the provisions of § § 8 to 10 of the Constitutional Act of 9 April 1920, No 293 Coll., on the protection of the freedom of persons, home and secrets of letters, as well as to maintain confidentiality regarding all the facts which they have learned in their activities, in particular commercial and manufacturing secrets, and to refrain from any misuse of such secrets. The obligation of secrecy shall not cease to exist or shall cease to exist.
(3) The operator of the bakery shall take measures to ensure that the supervisory authorities and authorities referred to in paragraph 1 are able to enter the bakery operating rooms at any time without delay.
§ 6.
(1) Those who engage or employ other persons in breach of the provisions of § § § § § 1, 2 or 3, § 3, or of the provisions which will be issued pursuant to § § 2, § 4, or who prevent or impede the supervisory persons and authorities referred to in § § 5, § 1, exercise of supervision in bakeries or who act against § § 5, § 3, will be punished, first of all by a criminal offence, by the county labour protection office with an order of order from 3.000 Kčs to 10.000 Kčs; If the offence has been committed again, the offender will be punished by the District National Committee on a proposal from the Regional Labour Protection Office for an administrative offence of between 10.000 CZK and 100,000 CZK or by imprisonment of 1 to 3 months or both. The infringement of the obligations imposed on the supervisory authorities and authorities referred to in Section 5, paragraph 2 shall be punishable without prejudice to the prosecution and punishment of disciplinary or judicial national committees by administrative penalties, by a fine of between 10.000 CZK and 100.000 CZK or by imprisonment of 1 to 3 months or both.
(2) Where a penalty has been imposed as an administrative penalty, a replacement prison sentence shall be imposed at the same time in the event of its imperfections, depending on the degree of blame, within the limits of the rate of the free penalty for an act provided for.
(3) The district national committee shall withdraw from the bakery operator, on a proposal from the district labour protection authority, the trade licence for a period of at least 1 month and not more than 1 year, provided that it has been penalised at least twice in accordance with paragraph 1.
§ 7.
The provisions of this Act do not apply to military bakeries.
§ 8.
This Act shall take effect on the seventh day following its publication; It shall be carried out by the Minister for Social Welfare in agreement with participating members of the Government.
