GOVERNMENT REGULATION
of 12 June 2024
amending Government Regulation No 463 / 2013 Coll., on substance lists, as amended
The Government orders pursuant to § 44c paragraphs 1 and 2 of Act No. 167 / 1998 Coll., on addictive substances and on the amendment of certain other laws, as amended by Act No. 273 / 2013 Coll. and Act No. 366 / 2021 Coll.:
Government Regulation No. 463 / 2013 Coll., on substance lists, as amended by Government Regulation No. 243 / 2015 Coll., Government Regulation No. 46 / 2017 Coll., Government Regulation No. 30 / 2018 Coll., Government Regulation No. 242 / 2018 Coll., Government Regulation No. 184 / 2021 Coll., Government Regulation No. 159 / 2022 Coll., Government Regulation No. 228 / 2023 Coll., Government Regulation No. 52 / 2024 Coll., is amended as follows:
1. In the table in Annex No 4, a new line is inserted under the line in the column headed "Other International Non-Proprietary Name or Other General Name ', containing the word" FUB-PB-22' in the column headed "International Non-Proprietary Name (INN) in the Czech language / common name 'in the column entitled" Hexahydrokanabiforol', the word "6,6,9-trimethyl-3-heptyl-6a, 7,8,9,10,10ahexahydrobenzo [c] chromen- 1-ol 'in the column entitled" Chemical Name according to IUPAC'.
2. In the table in Annex No 4, a new line is inserted above the line in the column headed "International non-proprietary name (INN) in the Czech language / common name ', containing the word" Hexahydrokanabinol' in the column headed "International non-proprietary name (INN) in the Czech language / common name ', the word" Hexahydrokanabihexol' in the column headed "Further international non-proprietary name or other generic name 'in the column headed" HHC- C6' and the word "Chemical name according to IUPAC 'in the column entitled" 6,6,9-trimethyl-3-hexyl-6a, 7,8,9,10,10ahexahydrobenzo [c] chromen- 1-ol'.
3. In the table in Annex No 4, under the row in the column headed "International non-proprietary name (INN) in the Czech language / common name ', the word" Hexahydrokanabinol-O- acetate' is inserted under the heading "International non-proprietary name (INN) in the Czech language / common name ', the word" Hexahydrocanabioctyl', the word "6,6,9-trimethyl-3-octyl-6a, 7,8,9,10,10a-hexahydrobenzo [c] chromen- 1-ol 'is inserted in the column headed" Hexahydrocanabinolyl'.
4. In the table in Annex No 4, the word "Hexedron 'is inserted above the line in the column headed" International Non-Proprietary Name (INN) in the Czech language / common name', the word "Hexahydrokanabutol 'in the column entitled" Hexedron', the word "Other International Non-Proprietary Name or the other common name 'is inserted, the words" HHCB; HHC-C4; HHC-C4' in the column headed "Chemical name according to IUPAC ', the word" 6,6,9-trimethyl-3-butyl-6a, 7,8,9,10,10a-hexahydrobenzo [c] chromen- 1ol'.
5. In the table in Annex No 4, a new line is inserted above the column headed "International non-proprietary name (INN) in the Czech language / common name 'containing the word" Tetrahydrokanabinol' in the column entitled "International non-proprietary name (INN) in the Czech language / common name 'in the column entitled" Tetrahydrokanabihexol', the word "(6aR, 10aR) -3-hexyl-6,9-trimethyl-6a, 7,8,10atetrahydrobenzo 'in the column entitled" Chemical name according to IUPAC' and the column entitled "Note 'are entered in the column entitled" Including delta-'. Except THCH, when contained in a plant of technical hemp, technical hemp, hemp extract and tincture and a preparation of technical hemp of less than 0,3%. This derogation shall not apply to food. '.
6. In the table in Annex No 4, under the row in the column headed "International non-proprietary name (INN) in the Czech language / common name ', the word" Tetrahydrokanabinol' is inserted, under the column headed "International non-proprietary name (INN) in the Czech language / common name 'contains the word" Tetrahydrokanabioctyl', the word "(6aR, 10aR) -3-octyl -6,9-trimethyl-6a, 7,8,10a-tetrahydropenzo [c] chromen- 1ol 'and the column entitled" Note' is entered in the column "Including delta- 8-isomer '.
7. In the table in Annex No 4, the word "Thionordazepam 'is inserted above the line in the column entitled" International non-proprietary name (INN) in the Czech language / common name', the word "Tetrahydrokanabutol 'in the column entitled" Thionordazepam' in the column entitled "International non-proprietary name (INN) in the Czech language / common name ', the word" (6aR, 10aR) -3-butyl-6,9-trimethyl-6a, 7,8,10atetrahydrobenzo [c] chromen- 1ol' in the column entitled "Note 'is entered in the column" Including delta-'. 8. 9. In Annex 4, footnote 4, under the table, the words "labelling and salts' are replaced by the words" labelling and salt and esters'.
10. In the table of Annex 5, in the row in the column headed "International non-proprietary name (INN) in Czech ', the word" Dronabinol' is added to the column headed "Chemical name according to IUPAC ', the words" and esters' are added.
11. In the table in Annex No 4, the words "Hexahydrokanabihexol '," Hexahydrokanabioctyl', "Hexahydrokanabioctyl '," Hexahydrokanabioctyl', the word "Hexahydrokanabutol ', the word" Tetrahydrokanabihexol', the word "Tetrahydrokanabioctyl 'and the word" Tetrahydrokanabutol' are deleted.
Technical Regulation
This Regulation has been notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Efficacy
This Regulation shall enter into force on 1 July 2024, with the exception of Article I (11), which shall take effect on 1 January 2025.
