THE LAW
of 18 July 2018
amending Act No 500 / 2004 Coll., the Administrative Rules, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 500 / 2004 Coll., Administrative Order, as amended by Act No. 413 / 2005 Coll., Act No. 384 / 2008 Coll., Act No. 7 / 2009 Coll., Act No. 227 / 2009 Coll., Act No. 167 / 2012 Coll., Act No. 303 / 2013 Coll., Act No. 250 / 2014 Coll., Act No. 243 / 2016 Coll., Act No. 298 / 2016 Coll., Act No. 183 / 2017 Coll. and Act No. 225 / 2017 Coll., is amended as follows:
1. In Paragraph 14, the following paragraph 2 is inserted after paragraph 1:
"(2) The official person shall not be excluded in accordance with paragraph 1 if the doubt about his or her unfairness is raised by his or her professional relationship with the State or the territorial authority. ';
Paragraphs 2 to 7 shall be renumbered paragraphs 3 to 8.
2. In Paragraph 14 (8), "4 'is replaced by" 5'.
3. In Article 134 (4), the text "Article 14 (2) 'is replaced by the text" Article 14 (3)' and the text "Article 14 (4) 'is replaced by the text" Article 14 (5)'.
Transitional provisions
1. The proceedings initiated which were not definitively concluded before the date of entry into force of this Act shall be completed in accordance with Act No. 500 / 2004 Coll., as effective before the date of entry into force of this Act.
2. If the procedure has been definitively terminated before the date of entry into force of this Act, the review procedure or the new procedure under this Act shall be followed.
Efficacy
That law shall take effect on the first day of the third calendar month following its publication.
