DECLARATION
of 17 June 2011
amending Decree No. 165 / 2002 Coll., on the separate ventilation of mining activities in continuous mines, as amended by Decree No. 56 / 2007 Coll., Decree No. 22 / 1989 Coll., on the safety and health at work and on the safety of operations in mining activities, and on the extraction of non-reserved minerals in the underground, as amended, Decree No. 4 / 1994 Coll., laying down requirements for the implementation and construction of buildings and equipment for the distribution and isolation of branches and the closure of mining works, as amended by Decree No. 90 / 2003 Coll., and Decree No. 52 / 1997 Coll.
According to § 6 (6) (a) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, the Czech Mining Authority provides:
Amendment of the Decree on separate ventilation in mining activities in fluent mines
Decree No. 165 / 2002 Coll., on the separate ventilation of mining activities in the fluent mines, as amended by Decree No. 56 / 2007 Coll., is amended as follows:
1. In Article 8 (2), the words "or Figure D2 'shall be inserted after the words" in the arrangement according to Figure D'.
2. in Paragraph 8 (3) (a), the words "50 m corridors or 150 m openings" are replaced by the words "200 m."
3. In Paragraph 9 (1) (d), "0,5% 'is replaced by" 1,0%'.
4. Article 11 shall be deleted, including the title.
5. In Annex No 2, point 5a is inserted after point 5 with figure D2:
"5. AND SEPARATE BREAKDOWN OF COMBINATED PHOTOGRAPHIC (WITH MAIN PHOTOGRAPHICAL BUILDING)

6. Point 7 of Annex 2 reads as follows:

Amendment of the Ordinance on Safety and Health at Work and Safety at Operation in Mining and Conquering Unreserved Minerals in Underground
Decree No. 22 / 1989 Coll., on the Safety and Health at Work and the Safety of Operation in Mining Activities and the Conquest of Unreserved Minerals in Underground, as amended by Decree No. 477 / 1991 Coll., Decree No. 340 / 1992 Coll., Decree No. 3 / 1994 Coll., Decree No. 54 / 1996 Coll., Decree No. 109 / 1998 Coll., Decree No. 434 / 2000 Coll., Decree No. 330 / 2002 Coll., Decree No. 141 / 2004 Coll., Decree No. 298 / 2005 Coll., Decree No. 282 / 2007 Coll., Decree No. 361 / 2009 Coll., and Decree No. 35 / 2010 Coll., is amended as follows:
1. In Section 157 (1), the words "approved by the testing centre designated by the Czech Mining Office 'are deleted.
2. In Articles 163 (5) and 185 (1), the words "the examination office designated by the Czech Mining Office 'are deleted.
Amendment of the Decree laying down requirements for the design and construction of buildings and equipment for the distribution and insulation of winds and the closure of mining works
Decree No. 4 / 1994 Coll., laying down requirements for the design and construction of buildings and equipment for the distribution and insulation of winds and the closure of mining works, as amended by Decree No. 90 / 2003 Coll., is amended as follows:
1. in Article 1, the following paragraph 3 is added:
"(3) This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, as amended by Directive 98 / 48 / EC. ';
2. in Sections 4 (1) (c) and 5 (1) (c), including footnote 2, the words "approved by the testing centre designated by the Czech Mining Authority (2)" shall be replaced by the words "intended for use in subcountries (2)";
2) Paragraph 6 (1) of Decree No 22 / 1989 Coll. '.
3. in Article 5 (1) (c), the words "approved by the testing laboratory designated by the Czech Mining Authority (2)" shall be replaced by the words "intended for use in subcountries (2)."
4. in Article 6 (1) (d), the words "approved by the testing laboratory designated by the Czech Mining Authority (2)" shall be replaced by the words "intended for use in subcountries (2)."
5. in Article 9 (2) (c) and (d):
"(c) for the sealing of latex, asphaltolatex emulsion, polyurethane foam, plaster, plastic paste made of clay, bentonite and the like, cement mortar, ventilation cloth and other materials intended for use in sub-earths (2);
(d) as a filling material for duplicated feathered stewed clay, sprinkled and water-coated ash, limestone powder or other compacted material intended to be used in sub-earths (2), ';
6. in § 16 (1) (c), § 17 (1) (c), § 22 (1) (e), § 22 (2) (c), the words "approved by the testing centre designated by the Czech Mining Authority (m2)" shall be replaced by the words "tested for the resistance of the barrier against explosion2)."
7. In Paragraph 16 (2), the sixth sentence is deleted.
8. Paragraph 18 (1) reads as follows:
"(1) For the construction of a barrier of fast-moving and special materials, plaster or other materials may be used if they have been tested for explosive resistance of the dam (2)."
9. in § 22 (2) (c), the words "approved by the testing laboratory designated by the Czech Mining Authority (2)" are replaced by the words "tested for resistance to explosion2)."
10. In Paragraph 23 (3), the first sentence is replaced by the following: "Equipment and products intended to be incorporated or suspended in a quay object, with the exception of the equipment referred to in paragraph 1 (e), shall be tested for resistance to explosion."
11. in Article 23, paragraph 4 is deleted;
Paragraph 5 shall become paragraph 4.
Amendment of the Decree laying down requirements to ensure safety and health at work and safety of operations in the disposal of major mining works
Decree No. 52 / 1997 Coll., laying down requirements to ensure safety and health at work and safety at the disposal of main mining works, as amended by Decree No. 32 / 2000 Coll. and Decree No. 592 / 2004 Coll., is amended as follows:
1. in Article 1, the following paragraph 3 is added:
"(3) This Decree was notified in accordance with Directive 98 / 34 / EC of the European Parliament and of the Council of 22 June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations and of rules on information society services, as amended by Directive 98 / 48 / EC. ';
2. In Article 6 (3), the words "in the examination room designated by the Czech Mining Office 'are deleted.
3. In Article 6 (4), the words "by the service designated in accordance with paragraph 3 'are deleted.
EFFECTIVE
This Decree shall take effect on 1 July 2011.
