setting out details of the identification cards of lawyers, established European lawyers and lawyers' associates
The Ministry of Justice, after prior observations by the Czech Bar Association, provides, pursuant to § 5d (1), § 35m (3) and § 52c of Act No. 85 / 1996 Coll. on Advocacy, as amended, ("the Act '):
§ 1
Forms of identification cards
(1) The identification card shall include:
(a) a photograph of the licence holder;
(b) the name and surname of the holder of the licence and, where appropriate, his academic title;
(c) the date of birth of the licence holder;
(d) the term "lawyer" ("lawyer"), "established European lawyer" ("established European lawyer") or "barrister" ("barrister");
(e) the registration number under which the holder of the licence is entered in the list of lawyers, the list of European lawyers or the list of lawyers.
(2) The identity card of a lawyer entered in the list of lawyers under Section 5a of the Act must also contain a limitation on the scope of the provision of legal services under Section 5a (2) of the Act.
(3) The identification card of an established European lawyer must also include the professional title provided for in Paragraph 2 (1) (b) (2) of the Act.
(4) The identification card may also contain other identification marks, in particular dates allowing the electronic identification of the lawyer, established European lawyer or barrister.
§ 2
Use of identification cards
(1) The lawyer or established European lawyer shall be accompanied by an identification card when providing legal services, in particular when representing him in proceedings before courts and other authorities and when defending himself in criminal matters.
(2) The lawyer shall be accompanied by an identification card in the course of legal practice, in particular when representing a lawyer or an established European lawyer on the basis of his mandate in individual legal aid operations.
§ 3
Model identification cards
(1) The model of the lawyer identification card is set out in Annex 1 to this Order.
(2) The model identification card of an established European lawyer is set out in Annex 2 to this Decree.
(3) The model identification card of the barrister is set out in Annex 3 to this Decree.
§ 4
Efficacy
This Decree shall take effect on 1 January 2011.
