DECLARATION
of 5 June 2009
laying down the details of the application for accreditation of the training programme, the organisation of training in the retraining establishment and the manner in which it is to be completed
The Ministry of Education, Youth and Sports, in agreement with the Ministry of Labour and Social Affairs, provides, pursuant to Section 108 (8) of Act No. 435 / 2004 Coll., on Employment, as amended by Act No. 382 / 2008 Coll., hereinafter referred to as "the Act":
Forms of application for accreditation of the training programme
(1) The application for accreditation of the training programme pursuant to Article 108 (3) of the Act (hereinafter referred to as the "retraining programme") contains:
(a) proof of entitlement to the provision of educational services if they are to be provided as a trade or any other document indicating that the provision of educational services is the subject of the activity;
(b) the name of the retraining programme;
(c) the work for which the retraining will take place;
(d) a profile of the graduate showing verifiable training results under the retraining programme;
(e) the entry conditions for admission of a natural person to education under the retraining programme;
(f) the form of training under the retraining programme and the teaching method;
(g) the framework timetable for education;
(h) the method of verifying the knowledge and skills acquired (§ 3 (1)), the composition of the examination committee, unless otherwise specified in paragraph 2 or 3;
(i) the model of the retraining certificate referred to in Article 5 or the certificate of participation in an accredited training programme referred to in Article 5a;
(j) a curriculum containing a list of thematic units with a minimum hourly subsidy and a minimum total number of hours of teaching, with a theoretical and practical separation, in the case of training combined in accordance with § 2 (1) (c) with a division of teaching into presentation and distance,
(k) syllables which include the content of the curriculum developed in such a way as to make it clear what is the content and the result of teaching for the individual thematic units of the curriculum;
(l) a description of the course of practical training, where it forms an integral part of the retraining programme, including information on its organisational and technical security;
(m) the list of compulsory and recommended literature, for the distance form of education, the standard study material;
(n) the name, names and surname, date of birth and, where applicable, academic degrees and scientific rank of the natural person responsible for the professional level of retraining and proper conduct of the final examinations under the retraining programme (§ 4), evidence of his education and professional experience and his agreement to be responsible for the professional level of retraining and proper conduct of the final examinations (§ 4),
(o) the name, names and surname and, where applicable, academic degrees and scientific grades of the lecturer for the teaching of individual thematic units, their qualifications and professional and pedagogical practices, and their agreement to carry out teaching activities;
(p) information on the spatial, material and technical security of training under the retraining programme provided by the applicant; proof of the contractual provision of the spatial, material and technical security of the training where it is not owned by the applicant,
(q) information on the manner and form of keeping documentation on the course and evaluation of training under the retraining programme and on the registration of certificates of retraining or certificates of participation in an accredited training programme issued to training participants, which shall be conducted for the purpose of ensuring the conduct of the retraining programme;
(r) proof of payment of the administrative charge (2).
(2) Where the method of verifying acquired knowledge and skills is provided for by another legislation or prepares training to obtain qualifications under another legislation, the application for accreditation of the training programme shall be made in place of the requirement referred to in paragraph 1 (b). (h) it shall contain an indication by which the legislation is governed by the method of verifying the knowledge and skills acquired and the composition of the examination committee.
(3) Where training is prepared to obtain qualifications under the Law on the Recognition of Result of Further Training, the application for accreditation of the training programme instead of the requirement laid down in paragraph 1 (b). (h) it shall include an indication that the method of verifying the knowledge and skills acquired is governed by the law on the recognition of the results of continuing education, and the name and surname, if any, and any academic titles and scientific degrees, or the name of the authorised person or persons with whom it is secured and their consent to the security.
Training organisation under the retraining programme
(1) Education in a retraining establishment under Section 108 (2) (a) of the Act is carried out in the form of:
(a) representative,
(b) distance,
(c) a combination of the forms referred to in (a) and (b).
(2) The teaching hour of theoretical teaching lasts 45 minutes. The teaching hour of practical teaching lasts 60 minutes, unless otherwise provided for in other legislation.
(3) Practical training means a professionally managed training activity which leads to the acquisition and restoration of practical knowledge and skills of the training participant under the retraining programme (hereinafter referred to as the participant). Practical instruction may take place at the workplace of natural or legal persons who are authorised to work in relation to the retraining in question, unless otherwise provided for by other legislation, and which will create conditions for participants to ensure their safety and health at the workplace.
Discontinuation of training
(1) The training in the retraining establishment referred to in Article 108 (2) (a) of the Act is terminated by successfully verifying the acquired knowledge and skills by means of a final examination under the retraining programme (hereinafter referred to as the "final examination") no later than 15 days after the end of the training period, unless the method of verifying the acquired knowledge and skills provides for a different legislation or prepares the training of the participant to obtain a qualification under another legislation.
(2) In case of successful completion of the final examination referred to in Article 4, the participant shall be entitled to issue a certificate of retraining.
Conditions for issuing a certificate of participation in an accredited training programme
If the knowledge and skills acquired under Section 4 are not verified, the participant shall be entitled to issue a certificate of participation in an accredited training programme if he has completed at least 80% of the training from the total hourly training grant under the retraining programme.
Final test
(1) The final test is public and takes the form of:
(a) in writing,
(b) oral,
(c) practical; or
(d) a combination of at least the two forms referred to in (a) to (c).
(2) A participant may hold a final examination if he has completed at least 80% of the training under the retraining programme and if his identity is verified by an identity card before commencing.
(3) The final examination shall take place before a three-member examination panel [Paragraph 1 (1) (h)].
(4) The chair of the Examination Board shall be the natural person responsible for carrying out the final examination in accordance with Paragraph 1 (1) (n).
(5) A participant has succeeded in the final examination if it successfully passes all its parts in the case of the procedure referred to in paragraph 1 (d).
(6) In the event that the participant has failed the final examination, the repair final examination may take place no more than once, within a time limit set by the examination panel, but no later than 30 days after the proper final examination.
(7) If the participant does not show up for the final examination, but if he or she fails to make his or her absence duly to the Chairman of the Examination Committee no later than 3 working days after the date of the final examination, he or she may take a replacement final examination within a time limit set by the Examination Board, but no later than 30 days after the end of the course.
Forms of the retraining certificate
The retraining certificate shall include:
(a) the identification of the retraining facility pursuant to Article 5 of the Act;
(b) the reference number and the date of accreditation;
(c) the name of the legislation under which the training programme has been accredited and implemented;
(d) the name and, where applicable, the names and surnames, any academic titles and degrees, date and place of birth of the graduate of education;
(e) the name of the retraining programme;
(f) the work for which the retraining was carried out;
(g) the date of commencement and termination of training under the retraining programme;
(h) the total hourly grant of training under the retraining programme and the hourly grant of teaching by thematic unit with the division of teaching into theoretical and practical, in the case of training combined in accordance with § 2 (1) (c) with the division of teaching into presentation and distance,
(i) the date of successful completion of the final examination referred to in Section 4;
(j) the place and date of issue of the retraining certificate;
(k) the name, if any, the names and surnames, any academic titles and scientific degrees and the signature of the Chairman of the Examination Committee and the name and, where appropriate, the surnames, any academic titles and scientific degrees and the signature of the person authorised to act as a retraining establishment.
Forms of certificate of participation in an accredited training programme
The certificate of participation in an accredited training programme shall include:
(a) the information provided for in Article 5 (a) to (h);
(b) an indication that this certificate of participation in an accredited training programme does not replace proof of successful verification of acquired knowledge and skills under another legislation;
(c) the place and date of issue of the certificate of participation in an accredited training programme;
(d) the name and, where applicable, the names and surnames, any academic degrees and degrees and the signature of the natural person responsible for the professional level of retraining referred to in Article 1 (1) (n) and the signature of the person who is entitled to act as a retraining establishment.
Repeal
Decree No. 524 / 2004 Coll., on the accreditation of establishments for the re-qualification of jobseekers and jobseekers shall be repealed.
Efficacy
This Decree shall take effect on the 60th day following its publication.
