Government Regulation
of 19 December 1950
the manner and extent of execution against cooperatives and other legal persons. *)
The Government of the Czechoslovak Republic orders pursuant to § 438 of Act No. 142 / 1950 Coll., on Civil Procedure (Civil Code):
(1) Enforcement against:
(a) to people's cooperatives registered in the company register, in the sections for single agricultural cooperatives, folk monetary institutions, folk housing cooperatives and other folk cooperatives;
b) Velkoditribuční společnost, enlisted fellowship s ručení obmezeného, in Prague and Veľkodzibučného podniku, družstvo s o. r., in Bratislava,
c) Ústí pro šádí pro šáčování výrobky, předené společnost s ručení obmezného, v Praha a Družstvu pre hospodárenie s poľnohodárskymi produkami, družství s ručení obmedzenou, v Bratislava,
may be conducted only in the manner and to the extent specified in Paragraph 437 (1) of the Civil Code.
(2) The Supervisory Body within the meaning of § 437 (1) of the Civil Code is the Central Council of Cooperatives in Prague for Cooperatives in Czech and Slovak Cooperatives for Cooperatives in Slovakia; for single agricultural cooperatives, the competent district national committee, for folk money institutions, for cooperatives referred to in paragraph 1 (b) and (c) of the Ministry of Internal Trade.
Paragraph 1 (1) also applies to legal persons for whom the general interest, in particular the development of the national economy, requires increased protection. The calculation of these legal persons and competent supervisory authorities shall be determined by the Minister of Justice.
The execution permitted against the provisions of § § § 1 and § 2, as well as all execution acts performed, shall be void. The Court of First Instance shall abolish the execution and all official enforcement acts (Section 437 (2) of the Civil Code).
This Regulation shall enter into force on 1 January 1951. They shall be carried out by the Minister of Justice in agreement with the ministers involved.
