amending Article 10 of the Decree of 16 October 1924, No 220 Coll., on the requirement of means of transport for military purposes.
The Government of the Czechoslovak Republic hereby orders pursuant to Section 7, Section 7 of the Act of 13 May 1924, No. 117 Coll., to require means of transport for military purposes:
Čl. I.
Paragraph 10 of the Decree of 16 October 1924, No 220 Coll., concerning the requirement of means of transport for military purposes, is amended and read as follows:
„§ 10.
Agree settlement of claims for damages.
Article 7 (7) of the Law.
(1) The Commission for the Recovery of Means of Transport (§ 7 (2) of the Act and § 7 of this Regulation), set up by the District National Committee, decides on claims for compensation, if the claim does not exceed the amount of 10.000.- CZK. If there is a claim for compensation for more damage, the Commission shall carry out the necessary inquiries and submit the file for a decision to the Commission set up by the Regional National Committee, in Slovakia, to the Commission set up by the internal mandates; the Commission decides on such claims for damages applied itself, if the claim applied exceeds the amount of 10.000.- Kčs, but does not exceed 30.000.- Kčs. In other cases, the Interministerial Commission of the Ministry of Defence shall decide definitively on claims for damages.
(2) An appeal may be lodged with the Regional National Committee on the decision which it makes on the claim for compensation of the recovery committee set up by the District National Committee within 15 days of the date of service of the decision to the Regional National Committee to the Commission set up by the Regional National Committee, Slovakia, to the Commission set up by the delegation of the Interior, which shall decide on it definitively. The decision taken by the Commission set up with the Regional National Committee in Slovakia by the Commission set up with the Internal Council, in the first chair, may, within 15 days of the date of service of the decision, be lodged with the Regional National Committee, in Slovakia with the Internal Council, an appeal to the Interministerial Commission of the Ministry of National Defence, which shall decide on it definitively.
(3) Rules on administrative procedures shall apply to proceedings in matters falling within the competence of the commissions referred to in the preceding paragraphs, save as otherwise provided in this Regulation. The material needs of the commissions shall be provided by the commissions and their office work shall be provided by the national committees, the mandates of the interior and the Ministry of National Defence with which the commissions are set up. ';
Čl. II.
The applicability of the Decree of 28 October 1938, No 263 Coll., amending Article 10 of the Decree of 16 October 1924, No 220 Coll., on the requirement of means of transport for military purposes, is hereby revoked.
Čl. III.
This Regulation shall enter into force on the day of its publication; they shall be carried out by the Minister for National Defence in agreement with the ministers involved.
