GOVERNMENT REGULATION
of 12 June 2024
amending certain regulations of the Government on the safety of work in connection with the operation of dedicated technical installations
The Government mandates pursuant to § 23 (a), (b), (f) to (h) of Act No. 250 / 2021 Coll., on the safety of work in connection with the operation of reserved technical installations and on the amendment of related laws:
Amendment of the Government Decree on reserved technical electrical equipment and safety requirements
In Annex 4 to Government Decree No. 190 / 2022 Coll., on reserved technical electrical equipment and safety requirements, in addition to the essential maximum time limits for regular LPS revisions, point (b) is deleted.
Point (c) shall be renumbered (b).
Amendment of the Government Decree on reserved technical gas installations and requirements to ensure their safety
Government Decree 191 / 2022 Coll., on reserved technical gas installations and requirements to ensure their safety, is amended as follows:
1. In Article 21 (3), the words "depending on its type, equipment and location 'shall be inserted after the words" equipment'.
2. Annex 2, including the title, reads:

Transitional provision
The person holding a certificate of revision of the reserved gas equipment issued under Act No. 174 / 1968 Coll., on State Professional Safety Supervision, as effective before 1 July 2022, shall be deemed to comply with the professional experience and education referred to in Annex 2 to Government Decree No. 191 / 2022 Coll., as effective from the date of entry into force of this Regulation by the Government.
Amendment of government regulations on reserved technical pressure equipment and requirements to ensure their safety
In Decree No. 192 / 2022 Coll., on reserved technical pressure equipment and requirements to ensure their safety, Section 22, including the title and footnotes 11 and 12, reads as follows:
Revision and test techniques for gas containers
The training requirements and the duration of experience on dedicated pressure equipment for revision techniques and test techniques for gas containers for activities on dedicated pressure equipment shall be:
(a) revisions and tests for boilers I to III class and pressure vessels I class of secondary education with a graduate examination from the group of disciplines 23 Engineering and engineering, 26 Electrical engineering, telecommunications and computing, 28 Technical chemistry and silicate chemistry, 36 Construction, geodesy and cartography, 37 Transport and connections, 39 Special and interdisciplinary disciplines (11) if a person has 3 years of experience in the field, or higher education in the field of engineering, technology and materials, Electronics, Energy, Chemie or Stavebnictvi12) if a person has 2 years of experience in the field;
(b) revisions and tests for boilers of the IV class and pressure vessels of the 2nd class of middle education with a graduate examination from the group of disciplines 23 Engineering and engineering, 26 Electronics, telecommunications and computing, 28 Technical chemistry and silica chemistry, 36 Construction, geodesy and cartography, 37 Transport and connections, 39 Special and interdisciplinary disciplines (11) and 2 years of experience in the field, or higher education in engineering, technology and materials, Electronics, Chemistry, Chemistry or Stavebnictvi12), if a person has 1 year of experience in the field;
(c) the first and periodic tests of pressure vessels for medium-education from the group of disciplines 23 Engineering and engineering, 26 Electronics, telecommunications and computing, 36 Construction, geodesy and cartography, 39 Special or interdisciplinary disciplines (11) with a teaching list if a person has 3 years of experience in the field, or a middle education with a graduate degree from the group of disciplines 23 Engineering and engineering, 26 Electronics, telecommunications and computing techniques, 28 Technical chemistry and silica chemistry, 36 Construction, geodesia and cartography, 37 Transport and connections, 39 Special and interdisciplinary disciplines (11) if a person has 2 years of experience in the field.

Transitional provision
The person holding the certificate of revision of the restricted pressure equipment issued pursuant to Act No. 174 / 1968 Coll., on State Professional Safety Supervision, as effective before 1 July 2022, shall be deemed to comply with the professional experience and education provided for in § 22 of the Government Decree No. 192 / 2022 Coll., as effective from the date of entry into force of this Government Regulation.
Amendment of government regulations on reserved technical lifting equipment and requirements to ensure their safety
Government Decree No 193 / 2022 Coll., on reserved technical lifting equipment and requirements to ensure their safety, is amended as follows:
1. In Article 1 (b), the word "checks' shall be inserted after the word" corrections'.
2. In Article 3 (2), the words ", handling, motor and off-road carriages' shall be added at the end of the text in point (a).
3. In Article 3 (2), the words "and multifunctional lifting equipment 'shall be added at the end of the text of point (d).
4. In Article 3, the following paragraph 3 is added:
"(3) Furthermore, reserved lifting devices shall not be lifting devices referred to in paragraph 2 with replaceable attachments. ';
5. In Article 5 (1), the words "referred to in Article 3 (1) (c) 'are deleted.
6. In Section 12, the title reads: "Requirements for the eligibility of authorised persons, persons to be operated by designated lifting equipment and persons to be loaded '.
7. in Annex 2, point 1.2 (f) and point 6.1.2, the word "inspection" is replaced by "inspection visit."
8. In Annex 2, point 1.2 (k), the word "checks' is replaced by" inspection inspections'.
9. In Annex 2, point 2.5, "Daily inspection 'is replaced by" Inspection'.
10. In Annex 3, point 1.5:
"1.5. For the implementation of the crane safe operation system, the operator shall designate the authorised person in accordance with Section 10 (1) (a), who shall act as a legal or business natural person (employer) requesting handling of the load. ';
11. in Annex 3, point 2.3.2 reads:
"2.3.2. For the implementation of the work system, the operator of the work platform shall designate the authorised person in accordance with Article 10 (1) (a), who shall act as a legal or business natural person (employer) requesting the operation of the work platform. ';
12. in Annex 3, point 3.3.4 reads:
"3.3.4. In order to implement the local operating code for the operation of construction lifts, the operator shall designate the authorised person in accordance with Section 10 (1) (a), acting as a legal or commercial natural person (employer) requesting the operation of construction lifts. ';
13. in Annex 3, point 4.3.3 reads:
"4.3.3. In order to implement the local operating code for the operation of rack founders, the operator shall designate an authorised person in accordance with Article 10 (1) (a), acting as a legal or business natural person (employer) requesting the operation of rack founders. ';
14. Annex 4, including the title and footnotes 4 and 5, reads:

Transitional provision
The person holding the certificate of the revision technique reserved for lifting equipment issued pursuant to Act No. 174 / 1968 Coll., on State Professional Safety Supervision, as effective before 1 July 2022, shall be deemed to comply with the professional experience and education referred to in Annex 4 to Government Decree No. 193 / 2022 Coll., as effective from the date of entry into force of this Regulation by the Government.
Amendment of the Government Regulation on professional competence requirements for electrical equipment and competence in electrical engineering
In § 3 of Decree No. 194 / 2022 Coll., on the requirements for professional competence to perform on electrical equipment and competence in electrical engineering, paragraph 5 reads as follows:
"(5) The legal person and the individual undertaking in cooperation with the school establishment concerned shall ensure that pupils and students of electrical engineering in practical teaching before and in the vicinity of electrical equipment
(a) have been properly trained in accordance with Article 9 (1), to the extent that their activities on electrical equipment have been carried out, their knowledge has been verified and the registration has been carried out; and
(b) carry out only such activities as are consistent with their gradually acquired expertise, always under the guidance of a designated person with competence appropriate to the nature of the activity. ";
EFFECTIVE
This Regulation shall take effect on 1 July 2024.
