DECLARATION
of 3 July 2019
amending Decree No 22 / 2013 Coll., on education in the area of animal protection against abuse, as amended by Decree No 372 / 2013 Coll.
According to § 29 (1) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 359 / 2012 Coll., for the implementation of § 8b (7), § 14b (4), § 15d (7) and § 15e (3) of the Act:
Čl. I
Decree No. 22 / 2013 Coll., on education in the section on the protection of animals against abuse, as amended by Decree No. 372 / 2013 Coll., is amended as follows:
1. Paragraph 9 (4) reads as follows:
"(4) At the end of the course referred to in paragraph 1, the examination shall be carried out in the form of a written test and a written examination of the knowledge obtained. The written test is prepared by the Ministry of Agriculture and contains 30 test questions. Three possible answers are assigned to each question, one of which is correct. The duration of the written test shall be 45 minutes. The written test shall be evaluated by the Examination Committee by assessing each correct response with one point. The written examination includes the identification of 30 species of wild animals that are normally found in the wild in the Czech Republic. Photographs, drawings or preparations of specified species of wild animals may be used for the written recognition test. A period of 45 minutes shall be set for the preparation of the written examination. The written recognition exam is evaluated by the Examination Committee by assessing each correct answer with one point. In order to pass the test successfully, at least 80 per cent of the total number of points in the written test and at the same time the correct identification of at least 80 per cent of the total number of wild animal species determined in the written examination shall be achieved. The test result has been evaluated successfully or failed. ';
2. in Articles 10 (2) (a) and 12 (2) (a), the words "relating to the protection of experimental animals" shall be deleted;
3. in Article 10 (2) (b) and Article 12 (2) (b):
"(b) other legislation of the Czech Republic relating to the acquisition, breeding, care and use of animals for scientific purposes, in particular veterinary law, criminal code, legislation governing the organisation of work and working practices, which the employer is obliged to ensure in the course of work related to animal husbandry, the law on the conservation of nature and landscape, the law on hunting and the law on fishing,"
4. In Article 10 (2), the words "including the capture of wild animals' shall be added at the end of the text in point (p).
5. in Article 11 (1) and in Article 13 (1), "10" is replaced by "6."
6. In Article 11, the following paragraph 4 is added:
"(4) The course participant referred to in paragraph 1 shall demonstrate to the training centre that he holds the certificate referred to in § 15d (3) or § 15e (1) of the Act. To this end, the application shall be accompanied by a copy of that certificate. '
7. In Article 12, at the end of paragraph 2, the dot is replaced by a comma and the following point (o) is added:
"(o) catching wild animals."
8. In Article 13, the following paragraph 4 is added:
"(4) The course participant referred to in paragraph 1 shall demonstrate to the training centre that he holds the certificate referred to in § 15d (4) or § 15e (2) of the Act. To this end, the application shall be accompanied by a copy of that certificate. '
9. Paragraph 14 (2) reads as follows:
"(2) At least one lecturer shall:
(a) have a university degree at least in a Master's degree in law at a university in the Czech Republic; or
(b) be an employee of the State Veterinary Administration and be qualified under Section 26 (1) of the Act. ';
10. In Paragraph 14, the following paragraph 3 is added:
"(3) Paragraph 1 shall apply to the courses referred to in Sections 10 to 13. Paragraph 2 shall apply to the courses referred to in Sections 10 and 12. ';
11. In Paragraph 15, the word "common 'is replaced by" common'; paragraph 2 is deleted and the designation of paragraph 1 is deleted.
12. in Paragraph 19 (3):
"(3) The test in the experimental animal protection section referred to in Sections 10 and 12 contains 60 test questions. Three possible answers are assigned to each question, one of which is correct. The duration of the written test shall be 90 minutes. Paragraph 1 shall apply mutatis mutandis to the test in the experimental animal protection section referred to in paragraphs 11 and 13. ';
13. Annex 3 reads as follows:

Model of licence for drivers and guides of road vehicles transporting animals in connection with economic activity

"
Čl. II
Transitional provision
The certificate of competence for drivers and guides of road vehicles transporting animals in the context of an economic activity in the form of a licence issued before the date of entry into force of this decree shall remain valid until the date stated therein.
Čl. III
Efficacy
This Decision shall enter into force on 1 August 2019.
