DECLARATION
of 14 April 2006
amending Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended
The Ministry of the Environment provides pursuant to § 28 (1), § 33 (1), § 35 (1), § 38 (7), § 40 (4) and § 48 (3) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Decree No. 395 / 1992 Coll., implementing certain provisions of Act No. 114 / 1992 Coll., on Nature and Landscape Protection, as amended, as amended, as amended, Decree No. 105 / 1997 Coll., Decree No. 200 / 1999 Coll., Decree No. 85 / 2000 Coll., Decree No. 190 / 2000 Coll., Decree No. 116 / 2004 Coll., Decree No. 381 / 2004 Coll., Decree No. 573 / 2004 Coll., Decree No. 574 / 2004 Coll. and Decree No. 452 / 2005 Coll., are amended as follows:
1. In the first sentence of Article 8 (3), the words "or other authorised user 'shall be inserted after the words" or lessee'.
2. in Paragraph 8 (3) (b):
"(b) proof of ownership, unless it is possible to verify them in the property register or in the lease or user relationship of the applicant to land and timber growing outside the forest,";
3. In Article 16 (4), the word "district 'is replaced by" county'.
4. In the first sentence of Article 16 (6), "authorisation issued 'is replaced by" exemptions granted'.
5. In the second sentence of Article 16 (6), the words "authorisation 'are replaced by the words" exemption' and the words "in it 'are replaced by the words" authorisation'.
6. In the third sentence of Article 16 (6), "authorisation 'is replaced by" exemption'.
7. In Annex II, point 2, the words:
"aldrovanda bladders (Aldrovanda vesiculosa)"
"Raspberry (Minuartia smékalii)"
"nibbles (Coelanthus subtilis)"
"Halibut (Trichomanes speciosum)"
"Czech bell (Campanula bohemica)"
"flint (Luronium natans) '.
8. In Annex II, point 3, the words "European bell (Campanula bohemica) 'are deleted.
9. In Annex III, the following shall be added to point 1 in the Avertebrata group:
"Whitefish (Leptidea morsei)"
"spiny brown (Hyporyas maturna)"
"Hake (Lopinga achine)"
"diver (Graphoderus bilineatus)"
"Thin grenadier (Anisus vorticulus) '.
10. In Annex III, point 1, in the Amphibia group, the following is added in alphabetical order:
"albacore (Triturus carnifex)"
"sharpnose jumper (Rana arvalis) '.
The words "spiderfish (Pelobates fuscus)," "spiny lentils (Triturus cristatus)" and "small jumper (Rana lessonae)" are deleted.
11. In Annex III, the following shall be added in alphabetical order to point 1 in the group Plazi (Reptilia):
"brick lizard (Podarcis muralis)"
"flaming fish (Natrix tessellata) '.
12. In Annex III, the following shall be added to point 1 of the Group of Mammals (Mamalia) in alphabetical order:
"Brvina bat (Myotis emarginatus)"
"Black bat (Barbastella barbastellus)"
"bat coastal (Myotis dasycnem)"
"large bat (Myotis myotis)"
"steppes (Mustela eversmanii) '.
the words "European beaver (Castor fiber) 'shall be deleted;
13. In Annex III, point 2 of the Invertebrates Group (Avertebrata), the following is added in alphabetical order:
"white lady l (Nymphalis vau-album)"
"demersal spiny (Eriogaster catax)"
"horned wedge (Ophiogomphus cecilia)"
"yellow-legged wedge (Stylarus flavipes)"
"Red whiting (Cucujus cinnaberinus)"
"turbot (Proserpinus proserpina)"

The words "seed brown (Hyporyas maturna) 'are deleted.
14. In Annex III, point 2, in the Group of Fish (Pisces) and Cyclostomata (Cyclostomata), the words "Danube hedgehog (Gymnocephalus baloni) 'are added.
15. In Annex III, point 2, in the Amphibia group, the following is added in alphabetical order:
"spotted grenadier (Pelobates fuscus)"
"albacore (Triturus cristatus)"
"fireball"
"Yellow-bellied duck (Bombin variegata)"
"Green toad (Bufo viridis)"
"small jumper (Rana lessonae) '.
The words "peat jumper (Rana arvalis) 'are deleted.
16. In Annex III, in point 2, in the Reptilia (Plazi) group, the words "flounder (Natrix tessellata) 'are deleted.
17. In Annex III, the following shall be added to point 2 of the Group of Mammals (Mamalia) in alphabetical order:
"European beaver (Castor fiber)"
"Field hamster (Cricetus cricetus)"
"bats (other species) (Microchiroptera)"
"Whiting (Dryomys nitedula)"
"Fillfish (Muscardinus avellanarius)"
The words "black bat (Barbastella barbastellus)," "park bat (Pipistrellus nathusii)," "coastal bat (Myotis dasycnem)," "tree bat (Nyctalus leisleri)," "large bat (Myotis bechsteini)" and "large bat (Myotis myotis)" are deleted.
18. In Annex III, in point 3, in the Amphibia group, the words "fiery duck (Bombin Bombin) '," yellow-bellied duck (Bombin variegata)' and "Green toad (Bufo viridis) 'are deleted.
19. In Annex III, in point 3, the words "field hamster (Cricetus cricetus) '," Brandt's bat (Myotis brandti)', "Brawling bat (Myotis emarginatus) '," Long-tailed bat (Plecotus austriacus)', "Common bat (Vespertilio murinus) '," Forest plach (Dryomys nitedula)' and "Steppus eversmanii 'are deleted.
20. In Annex IV, Type I. The word "surname 'and the words" birth number' are deleted after the words "name a 'are inserted.
21. In Annex IV, Type II. A guard's service card shall be inserted after the words "name and 'and the words" birth number' shall be deleted.
22. In Annex IV, Type III, The rapporteur's card shall be inserted after the word "name 'by the words" and surname'.
Efficacy
This Decree shall take effect on 8 May 2006.
